"They're excuses. They're not actions," Fraser says. "Unless it's a plan, you don't follow him."
by Adam Carter 11:27 AM

Fraser now listing all the things Smich did, saying it was a plan all along. "I felt threatened sir. I felt scared," he says.
by Adam Carter 11:27 AM

Fraser says if you look at Millard and Smich's text's, there's no fear there.

I think Fraser was trying to establish that TB felt intimidated by the two accused given the unusual circumstances of the test drive and MS's sketchy demeanour, then the odd text and detour to the field before the test drive barely got underway. Fraser succeeded IMO demonstrating that TB was more than likely feeling concerned and sensing trouble from the get go. It just makes sense.

All MOO.

There was no activity on #Bosma's phone between 9:05 at 10pm, when it was powered down. No attempt to call Sharlene or 911.

Susan Clairmont ‏@susanclairmont 1m1 minute ago
No activity on Bosma phone from 9:05 (Bosma/Bates) until it's powered down at 10:02 pm. No attempts to call Sharlene or 911, says Crown.

molly hayes ‏@mollyhayes 1m1 minute ago
No activity on #Bosma phone until it is "powered down" at 10:01pm that night, Fraser says. No attempts to call his wife or 911.

Lisa Hepfner ‏@HefCHCHNews 58s58 seconds ago
#TimBosma's phone was found at Kemira, a business close to Bobcat of Brantford. "You had a dead and bleeding #TimBosma..."

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Smich says he saw #Bosma phone being "wiped" by Millard while they had "a dead and bleeding Mr. Bosma," says Crown.

molly hayes ‏@mollyhayes 1m1 minute ago
Fraser suggests by the Brantford stop, they had a "dead and bleeding Mr Bosma in that truck."

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Fraser suggests they ditched #TimBosma's phone in Brantford. "You had a dead and bleeding #TimBosma in that truck." #Bosma

molly hayes ‏@mollyhayes 41s42 seconds ago
Fraser says Smich "made a choice" that night to follow the truck and Mr. Millard. #Bosma

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
And you had to do something at that point. in front of Bobcat, Fraser says. Smich seems very confused by his questions.

Susan Clairmont ‏@susanclairmont 1m1 minute ago
"Really Mr. Smich, all you had to do was go left, and you're out of there," says Crown.

Colin Butler ‏@ColinButlerCBC 53s54 seconds ago
Fraser suggests Smich chose to follow Millard after #TimBosma was shot. If it was such a shock, he wouldn't follow him for 23km.

molly hayes ‏@mollyhayes 52s53 seconds ago
Fraser suggests if the murder had been "such a shock" and "so awful," you don't follow that man...you get out of there . #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
But instead he went right and followed Millard. "That's a choice you made," says Crown. "You follow lunatic Dell for 23 km."

molly hayes ‏@mollyhayes 1m1 minute ago
Smich says he was shocked and didn't know what to do. #Bosma

Lisa Hepfner ‏@HefCHCHNews 50s51 seconds ago
If everything was such a shock to Smich, why did he follow Millard all the way to the farm and hangar? I was shocked, I didn't know wh to do

molly hayes ‏@mollyhayes 1m1 minute ago
Fraser says these things - "shock, fear, confusion" etc - are explanations. Not actions. #Bosma

molly hayes ‏@mollyhayes 55s55 seconds ago
"Unless it's a plan," he says, you don't follow. Unless it's a plan you don't strip truck. Wash it. Burn evidence. #Bosma

Lisa Hepfner ‏@HefCHCHNews 44s44 seconds ago
Unless it's a plan, you don't follow, you don't take an Xacto knife to the truck, you don't go back and clean the Eliminator & burn evidence

Susan Clairmont ‏@susanclairmont 42s42 seconds ago
Smich says he was "in shock." Crown says that's an excuse. Smich: "I didn't know what to do sir."

molly hayes ‏@mollyhayes 1m1 minute ago
"I felt threatened sir. I felt scared. I did what he told me to do," Smich says. #Bosma

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Fraser says unless its a plan you don't follow the truck, cut the carpet out and burn the evidence. #TimBosma

molly hayes ‏@mollyhayes 41s41 seconds ago
Fraser references texts between them. Shows there was no discomfort between them. No fear there. #Bosma

Lisa Hepfner ‏@HefCHCHNews 23s23 seconds ago
The comfort level between Smich and Millard doesn't change, and it shows in their text messages. It was planned together, Fraser says

Susan Clairmont ‏@susanclairmont 41s42 seconds ago
Crown: "Unless it's a plan..." & he rhymes off things they did together. eg. "You don't show up the next night and move that Eliminator."

Susan Clairmont ‏@susanclairmont 44s44 seconds ago
Smich: "I felt threatened sir. I felt scared. I did what he told me to do."

First we're seeing the text from Millard where he texts "airport politics" to his employees, and they're told not to go in.
by Adam Carter 11:29 AM

Fraser says he told employees not to go in because the place was still a "bloody mess." Smich agrees.
by Adam Carter 11:29 AM

"I couldn't come to terms with the reality of the situation of the time," Smich says. "These are words, excuses and justifications Mr. Smich," Fraser says.
by Adam Carter 11:30 AM

I think the fireside furniture and sausages texts must have somehow got argued out, after briefly being mentioned when the Crown was going through the texts and messages from MS. I can't imagine why else we haven't heard the Crown talk more about them.

  • #66
(Can someone explain the significance of the guy seeing two trucks pull out of the lane? Is it a timeline issue or is it because it's a different location than MS claims? Insert my standard disclaimer about not being able to follow the truck movements well..)

molly hayes ‏@mollyhayes 1m1 minute ago
Fraser is showing texts from May 7.

Susan Clairmont ‏@susanclairmont 29s29 seconds ago
Crown says there is "comfort level" in texts between Smich and Millard in days following murder that don't show Smich was scared.

Colin Butler ‏@ColinButlerCBC 29s29 seconds ago
Jury now seeing texts between Millard and Smich from the morning after #TimBosma's death.

molly hayes ‏@mollyhayes 28s28 seconds ago
Millard texts his employees this morning "airport politics. No one goes to the hangar today, not even just to grab something." #Bosma

Lisa Hepfner ‏@HefCHCHNews 52s53 seconds ago
Morning May 7, 2013, Millard writes to all employees not to go to hangar, not even to grab something. "The scene was still a mess."

molly hayes ‏@mollyhayes 39s40 seconds ago
Fraser suggests this is because the scene was still a "bloody mess." There was cleaning up to do. Smich agrees. #Bosma

Lisa Hepfner ‏@HefCHCHNews 37s38 seconds ago
"It was a bloody mess." Yes sir. Smich agrees. There was still a lot to clean up. They went home to let incinerator cool, Fraser suggests

Colin Butler ‏@ColinButlerCBC 33s34 seconds ago
Smich agrees the scene was still a bloody mess at 7am when Millard sent the airport politics text. #TimBosma

molly hayes ‏@mollyhayes 50s50 seconds ago
Fraser suggests the eliminator at that point was "too hot" to clean out. So they went home to sleep, and headed back again later together.

Susan Clairmont ‏@susanclairmont 48s48 seconds ago
"The scene was a mess. It was a blood mess," says Crown of Eliminator after incinerating Tim. Go home, come back to clean up after...

Susan Clairmont ‏@susanclairmont 43s44 seconds ago
....Eliminator cooled, says Crown. Smich says that's not what happened.

molly hayes ‏@mollyhayes 42s43 seconds ago
Smich disagrees.

Lisa Hepfner ‏@HefCHCHNews 35s35 seconds ago
Smich has excuses and justifications, Fraser says. Not answers. 11am, May 7 Millard texts Smich: changed my mind bro, after 7pm.

Susan Clairmont ‏@susanclairmont 19s19 seconds ago
May 7 morning, Millard texts Smich: "changed my mind bro, after 7 p.m." Crown says it's a plan to go back to hangar to clean up.

Lisa Hepfner ‏@HefCHCHNews 21s22 seconds ago
Smich was home with gf Meneses at the time. Smich agrees he went back to the hangar with Millard that night.

molly hayes ‏@mollyhayes 14s15 seconds ago
Back to texts. Millard texts Smich "changed my mind bro, after 7pm." Smich writes back that aft "oh snap." #Bosma

Colin Butler ‏@ColinButlerCBC 12s13 seconds ago
Fraser asks if Smich went to the hangar on May 7 after some confusion he says yes. #TimBosma

  • #68
(Can someone explain the significance of the guy seeing two trucks pull out of the lane? Is it a timeline issue or is it because it's a different location than MS claims? Insert my standard disclaimer about not being able to follow the truck movements well..)

Because the Crown is suggesting they both pulled into the laneway and shot TB then. And then both left together, MS knowing and participating in the death.

On May 7 at 11 a.m., Millard texts Smich: "Changed my mind bro, after 7pm."
by Adam Carter 11:31 AM

Smich responds just before 2 p.m.: "Oh snap. Well in that case I should go back to bed at some point, and she cant reach with us bcuz she work early next day. Link me when you're awake."
by Adam Carter 11:32 AM

Smich says Millard had suggesting involving Smich's girlfriend to clean up. He says he didn't talk about it with her.

molly hayes ‏@mollyhayes 14s14 seconds ago
Smich says he believes Millard was asking if Marlena could come with them (In next text he writes she can't "reach" w them because of work).

Lisa Hepfner ‏@HefCHCHNews 30s30 seconds ago
One of Smich's messages "oh snap" Fraser is asking what it means. Doesn't get an answer. Smich says Millard wanted Marlena to help clean up.

molly hayes ‏@mollyhayes 26s26 seconds ago
Fraser asks if they were discussing involving Marlena in this. Smich says there was talk of her helping w cleanup. He said she couldn't.

Susan Clairmont ‏@susanclairmont 21s21 seconds ago
Millard suggested in text Marlena should help clean up. Smich replied she had to work.

Colin Butler ‏@ColinButlerCBC 33s33 seconds ago
Smich says Millard wanted to get Meneses involved in the cleanup. Smich didn't want her there. He says never told her about it. #TimBosma

Lisa Hepfner ‏@HefCHCHNews 26s26 seconds ago
Marlena had to work early the following day so she couldn't have gone, but Smich says Millard suggested Marlena help clean up evidence

molly hayes ‏@mollyhayes 24s24 seconds ago
"You're saying you would have that conversation with her?" Fraser asks. Smich says no he doesn't recall having that conversation. #Bosma

Susan Clairmont ‏@susanclairmont 5s5 seconds ago
Smich says he doesn't remember having that discussion with Marlena. Crown: "It's a horrendous suggestion."

molly hayes ‏@mollyhayes 29s29 seconds ago
Fraser says "well how about 'never in a million years' would I have that conversation with her because it's horrendous..." #Bosma

Lisa Hepfner ‏@HefCHCHNews 26s26 seconds ago
"It's a horrendous suggestion," Fraser says. You were still playing along? Smich agrees. #TimBosma

Colin Butler ‏@ColinButlerCBC 25s25 seconds ago
Fraser suggests Millard's proposition was "horrendous" and asks "is this a playing along example?" #TimBosma

Colin Butler ‏@ColinButlerCBC 10s10 seconds ago
Yessir, Smich says. #TimBosma

(Can someone explain the significance of the guy seeing two trucks pull out of the lane? Is it a timeline issue or is it because it's a different location than MS claims? Insert my standard disclaimer about not being able to follow the truck movements well..)

It indicates that they didn't stop Tim's truck on the road and MS just get in the Yukon and leave like MS claims. Bullman saw the two trucks in the field.

  • #72
Because the Crown is suggesting they both pulled into the laneway and shot TB then. And then both left together, MS knowing and participating in the death.

Thanks. Is it significantly different from MS's story of pulling around the corner due to fake friend?

(No longer believe MS didn't know the plan. I just don't understand why this witness was a "mic drop" moment since I thought MS already admitted to stopping and then following in the Yukon.)

  • #73
Smich agrees this is an example of him, "playing along."
by Adam Carter 11:34 AM

We're now taking the morning break. Back in 20 mins.

There's a call from Smich to Millard that night around 6pm. Then he gets picked up. #Bosma

Susan Clairmont ‏@susanclairmont 9s10 seconds ago
They arrive at hangar around 9 pm, leave around 11:30 pm, says Crown.

Alex Pierson ‏@AlexpiersonAMP 43s44 seconds ago
Fraser mocks smich pointing out he was too scared to do anything other than clean up. And see DM. @AM900CHML

Susan Clairmont ‏@susanclairmont 41s41 seconds ago
Millard picks him up, drops him off after moving Eliminator from hangar to barn...Jury getting morning break. #Bosma

Lisa Hepfner ‏@HefCHCHNews 44s44 seconds ago
Court break #TimBosma

molly hayes ‏@mollyhayes 52s52 seconds ago
We are taking the morning recess. #Bosma

Because the Crown is suggesting they both pulled into the laneway and shot TB then. And then both left together, MS knowing and participating in the death.

To add to this...MS' story is that he was let out of the truck on Book Road and then DM made a U-turn in Tim's truck while he (MS) went into the field and got into the Yukon. He then pulled out of the field and followed in behind DM driving Tim's truck. This story is put into question when compared to the neighbor's who saw BOTH vehicles pull out of the field. MOO

Ok, this "on the road" thing may be part of my confusion, I thought pretty much all testimonies/fake stories/etc had the Yukon stashed in more or less the same place.

  • #77
If TB was killed in that field as the Crown suggests, wouldn't Bullman have heard the gunshot?

Ah, ok, I think I've finally got it--in MS's version, Tim's truck was never in what people call "the field"?

Thanks all.
