Crown: "Mr. Smich, you wanted the drugs and you wanted the murder weapon...

molly hayes ‏@mollyhayes 22s23 seconds ago
Fraser argues Smich wanted the drugs and the murder weapon, because that was his conversation with Millard. #Bosma

Susan Clairmont ‏@susanclairmont 14s15 seconds ago
"...because that's the conversation you had with Mr. Millard 15 minutes before he gets arrested."

Lisa Hepfner ‏@HefCHCHNews 44s45 seconds ago
They lied about the toolbox, Smich says of Michalski and Hagerman. "It's not a plan by me sir, I did not ask for it."

Adam Carter ‏@AdamCarterCBC 37s38 seconds ago
"Mr. Smich, you wanted the drugs, and you wanted the murder weapon, because of a discussion you had with Mr. Millard," Fraser says. #Bosma

Adam Carter ‏@AdamCarterCBC 29s30 seconds ago
Smich says no, Hagerman and Michalski lied about that toolbox to police. "We'll let the jury decide who they believe," Fraser says. #Bosma

molly hayes ‏@mollyhayes 10s11 seconds ago
Smich says he never asked for that. Fraser asks "was this a coincidence or a plan?" #Bosma

Susan Clairmont ‏@susanclairmont 37s38 seconds ago
Dungey had asked Michalski if May 10/11 he knew #Bosma and truck were missing? Michalski said yes and he was aware Dell stole truck.

Smich" with utmost respect, they lied about the tool box.' Fraser' "we w let the jury decide who lied. Answer the question." @AM900CHML

Lisa Hepfner ‏@HefCHCHNews 18s18 seconds ago
Under cross by Smich lawyer, Michalski testified that he knew Millard had stolen #TimBosma truck by May 10-11. Didn't go to police

Susan Clairmont ‏@susanclairmont 27s27 seconds ago
Michalski's own testimony says he knew on May 10/11 Millard was likely involved with #Bosma.

Susan Clairmont ‏@susanclairmont 12s12 seconds ago
Michalski didn't go to police, got drugs/toolbox "because Mark wanted it."

Lisa Hepfner ‏@HefCHCHNews 24s25 seconds ago
"Andrew Michalski was consistent in his evidence that you asked for that toolbox," Fraser says. "There was no frame up."

Susan Clairmont ‏@susanclairmont 30s31 seconds ago
Michalski was consistent in evidence that Smich wanted him to get drugs & toolbox, says Fraser. Smich: "I did not ask him for the toolbox."

Adam Carter ‏@AdamCarterCBC 23s24 seconds ago
"Andrew Michalski was consistent in his evidence that absolutely you were the one who asked him for that toolbox," Fraser says. #Bosma

molly hayes ‏@mollyhayes 33s34 seconds ago
Smich says he didn't even know Matt Hagerman was coming with Michalski. #Bosma

Lisa Hepfner ‏@HefCHCHNews 47s48 seconds ago
The only evidence that Millard was trying to frame Smich, Fraser says, was supposedly dropping the gun as a surprise on Smich

molly hayes ‏@mollyhayes 27s28 seconds ago
"Coincidence or plan, Mr. Smich?" Fraser says. #Bosma

  • #204
Susan Clairmont ‏@susanclairmont 34s34 seconds ago
Coincidence that Michalski sends text to Hagerman one minute after hanging up with Smich? And that they drop off drugs/toolbox?

molly hayes ‏@mollyhayes 23s23 seconds ago
Smich says the two of them have conflicting testimony in court about this. He says Hagerman said Dell would've wanted it to go to him.

molly hayes ‏@mollyhayes 44s45 seconds ago
He says Andrew said he didn't know what was in the bag, despite packing it.

Lisa Hepfner ‏@HefCHCHNews 44s45 seconds ago
Smich says Hagerman and Michalski contradicted each other, "The same toolbox they lied about," Smich says.

molly hayes ‏@mollyhayes 25s26 seconds ago
Smich says they lied to police about the toolbox, the thing he didn't ask for. #Bosma

Adam Carter ‏@AdamCarterCBC 11s12 seconds ago
Smich says from his recollection, Michalski and Hagerman gave conflicting testimony. "They lied to police about that toolbox " #Bosma

Lisa Hepfner ‏@HefCHCHNews 42s42 seconds ago
"They lied to police about the same thing, the toolbox," Smich says, voice rising. He's usually very quiet. Getting riled, it seems

Adam Carter ‏@AdamCarterCBC 35s35 seconds ago
... the same exact thing we're talking about right now," Smich says. #Bosma

Susan Clairmont ‏@susanclairmont 55s55 seconds ago
Smich vehemently disagrees with Crown. Says Michalski & Hagerman gave conflicting statements, lied to police.

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Smich is getting feisty. He's raising his voice at Fraser about the toolbox saying he never wanted it. #Bosma

Susan Clairmont ‏@susanclairmont 49s50 seconds ago
Says he never asked for toolbox. Crown: "Are you done?"

Susan Clairmont ‏@susanclairmont 43s43 seconds ago
Crown: Are you saying Michalski got it wrong when you said you wanted that toolbox in no uncertain terms? Smich: Yes, he got it wrong.

Adam Carter ‏@AdamCarterCBC 40s41 seconds ago
"Are you saying Michalski got it wrong?" Fraser says, listing all the other people who Smich also says got a detail wrong. #Bosma

Adam Carter ‏@AdamCarterCBC 57s58 seconds ago
Smich agrees that the two of them were very much in love at the time. #TimBosma #Bosma

molly hayes ‏@mollyhayes 47s48 seconds ago
Fraser suggests there's no question they were in love at the time. Marlena said Smich was a good person & Smich called her a very good girl.

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Crown: Smich and Meneses in love. She thought he was a good person. Smich described her as "a very good girl."

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
"Marlena is a very good girl," Smich said on the stand. She treated Smich better than he treated her. He wouldn't say anything bad about her

molly hayes ‏@mollyhayes 54s54 seconds ago

molly hayes ‏@mollyhayes 50s51 seconds ago
Fraser suggests Marlena is an honest person. He agrees. #Bosma

Lisa Hepfner ‏@HefCHCHNews 50s51 seconds ago
Meneses testified that Smich told her Millard did everything. Killed & burned #TimBosma. "Marlena is an honest person, isn't she?"

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Marlena testified that Smich told her "Dell did everything." That Dell killed and burned #Bosma. Smich agrees with Crown Marlena is honest.

(Can someone explain the significance of the guy seeing two trucks pull out of the lane? Is it a timeline issue or is it because it's a different location than MS claims? Insert my standard disclaimer about not being able to follow the truck movements well..)

For some reason MS is afraid to admit that they were ever in the actual field. Small detail, big meaning. A concious Tim would not be going along with this willingly.

Perhaps I shouldn't weigh in on GSR because I'm not well versed on the subject, but IIRC Abro suggested that since there was only a few spots of blood in the back seat of TB's truck and the GSR was mainly found in the front of the Ram that the backseat passenger MS would not necessarily have had much blood or GSR on their person, or perhaps a very minimal amount that would not likely be transferred to the Yukon.

I attach this Wikipedia page link: https://en.wikipedia.org/wiki/Gunshot_residue In it, it's explained about how GSR is tested on a person's clothing or hands but LE had no opportunity to test either suspect's hand right after the crime or later, their clothing - only DM's satchel was tested I believe and that had been washed. The suspects got rid of the clothing they wore at the scene of the crime, IMO.

"Law enforcement investigators test the clothing and skin of people for GSR to determine if they were near a gun when it discharged. Gunshot residue can travel over 3–5 feet (0.9–1.5 meters) from the gun. At the farthest distance, only a few trace particles may be present."

It goes on to say: "A negative result can mean that the person was nowhere near the gun when it was fired, or that they were near it but not close enough for GSR to land on them, or it can mean that the GSR deposited on them wore off. GSR is the consistency of flour and typically only stays on the hands of a living person for 4–6 hours. Wiping the hands on anything, even putting them in and out of pockets can transfer GSR off the hands. Victims don't always get GSR on them; even suicide victims can test negative for GSR."

I think it very possible that a MS wiped his hands on something before entering the Yukon and may have transferred only a minute amount of GSR if any into the Yukon.Several days later when the DM and the Yukon was in LE custody and the vehicle tested (assuming it was tested?) then perhaps there was no detectable trace evidence of GSR in the Yukon at that time.

Apologies in advance if I misinterpreted Abro's previous explanation or if I'm misinterpreting what I'm reading here about GSR. HTH.

All MOO.

Yes, but there was a ton of GSR in TB's truck when tested a week later and that is after it being scrubbed, wiped and hosed down

I actually do believe it possible that MS didn't ask for the toolbox knowing it had the murder weapon inside of it. Why would he have wanted DM's gun on him when he thought police may be coming for him next?

I believe MS had his own murder weapon to deal with and didn't want DM's as well. Perhaps once MS received the gun from DM via MH and AM, and MS knew that DM was in custody, MS worried that it was a signal that DM would try to pin the murder on MS. MS's concern about being blamed for everything by DM could indeed induce paranoia in MS. They acted together to murder TB but both later tried to say the other was solely responsible. That's how criminals behave - they can't be trusted to hold up their end of the bargain when the heat is on.

I also believe the Crown's story about how quickly the murder took place in the field. DM would have taken the risk to leave the Yukon unattended with the dog left inside, windows rolled down for air, but only for a short amount of time. I also believe MS and/or DM scoped out TB's area by mapping it ahead online, or physically driving in the area to find the perfect spot not only to park but to murder TB.

All MOO.

  • #217
Very interesting that MS was contacting Iisho on the 10th. I still believe that the gun eventually may have made it's way back to him.

MOO

I don't believe for one sec that it was buried by MS, never have.
