If it's part of the standard statutory voire dire ban, it can be heard as soon as the jury retires to deliberate. I'm sure some of those stories are already written, and in a competetive media environment they won't be able to click the publish button soon enough.

Dude got out of those 98 charges laid against him and two others, including the AK-47. Couldn't prove it was his residence.

Not sure if he is out now, but he was being held for selling guns to DM, including the one used on WM.

I don't think it was a good move for TD to mention how MS is exhausted after 9 days on the stand and that MS has trouble sleeping at Barton Street jail. The first thing that came into my head is that MS can't sleep because he has a guilty conscience, and my next thought was how trivial a thing to mention in front of the victim's family who by comparison are rightfully exhausted and likely don't sleep well ever since TB's murder. And lastly it was an odd way to introduce TD's last questions of MS which came across to me as an obligatory attempt by TD to reduce MS's 9 days of testimony into a few salient points.

A week? Seriously? I can see giving the lawyers a few days to prepare but there's no reason they need a week. They should have been made to be ready for Monday morning.

Wanted to add that it's potentially not just voire dire material that has been held back. I read an email exchange with Christie Blatchford during the Luka Magnotta trial - when asked why she wasn't explaining to her readers that the Logan Valentini that was testifying was Karla Homolka's sister, something she assuredly knew because of her deep involvement in Homolka reporting, she said that she wasn't able to talk about anything that the jury hadn't heard. So this wasn't a trial or voire dire fact, just a fact that was "out there" that she sidestepped in her reporting during the trial. So it's possible that other digging and investigative work of interest by journalists may surface soon as well.

Agreed, IIRC the only thing they have mentioned finding was a lighter.

I'm of the camp that thinks if MS was in fact in the Ram when TB was shot, there would have been, in the least, a trace of GSR or blood in the Yukon.

Still catching up so this may have been pointed out already. But maybe there was? and maybe it was evidence that was thrown out... I dont think we can say that there was NONE for sure. Just that none was put forward as evidence. MOO.

Unfortunately for Ward-Jackson, despite the discharge from Justice Di Zio, he’s still in the new and newly notorious Toronto South super jail due to another set of charges he faces, allegedly selling guns to Dellen Millard.

I took as "I'm limiting this because you are exhausted and done, so here are the key points". It's also a lawyer's way of communicating, or trying to, that will all that questioning the Crown still hadn't proven the key issue at hand. So kind of a tactic of convenience given a tired client, and potentially a read on a tired jury who he was trying to score some points with.

And isn't he still at Toronto East? Not important, but..

There were two others charged with gun trafficking at the same time as MWJ, both of whom are out on bail (or the charges against them have been dropped - there isn't a lot of information out there).

I caught the reference to MS staying at the Barton street facility also......it occured to me that MS may have been temporarily transferred for the time period of his testimony in order to avoid the lenghty drive 2x's each day from Toronto East.
Noted the comment that Barton Street as a facility is not very suitable.
Interesting way to show MS that he has actually been well off these past 3 years as opposed to what may have been available to him (DM has been housed at Barton Street for 3 years now).

I personally do not think MS did himself any favours by testifying. It allowed the Crown to get all of this extra information in that they otherwise would not have been able to, other than to reference some of it during their closing argument. Much more effective to be throwing it all right at one of the defendants in a cross exam. I think at the end of the Crown's case in chief, there were a lot more fence sitters with regards to MS's culpability in this crime. At this point, it seems like there are very few, if any, left who do not believe that he was involved in the planning, execution and clean up of a truck theft and murder.

I totally agree that he did himself no favours by testifying. His consistent lying was pathetic and his bouts of going in and out of amnesia, just laughable.

I had some hope that he might just come clean and let the chips fall where they may. Instead, he did the opposite.

I'm curious to know how people feel about jury verdicts. If you have come to a conclusion about DM or MS's guilt but the jury acquits one or both of them, would you respect the jury's decision?

Likewise, if you still have reasonable doubt about one or both accused after the closing statements, and the jury finds one or both accused guilty, would you respect the jury's decision?

For me, I'm certain about what I think at this point about both accused being guilty of first degree murder, but if the jury decides differently I will respect their decision and accept it. After verdicts are delivered, is there ongoing debate on these forums between members about them? Just curious about what to expect next after the verdicts come down.

I think TD always knew MS had nothing to lose. I think he was always going to get first-degree even if he didn't testify IMO.

MS had a lot to use. Testifying was a huge gamble for him. If he pulled it off, he'd just go down on charges of tampering with evidence and likely do a couple of years. If he blew it, he'd go down for murder and be forced to do hard time as a rat. DM kept his mouth closed and never pointed his finger at MS. His lawyer pointed his finger and according to the code, that is ok. the time that DM does will likely be much easier than MS's time, if MS does in fact go down.
