Is it possible that TB was shot before MS got into the Yukon?

There must be some evidence that the Crown was unable to put forth that tells them unequivocally that Tim was killed in that field.

I know the area quite well (drive past the field at least once a week) and have a really hard time believing that this was where it happened. It is so close to the Bosma home and it means that it happened so incredibly fast.

The Crown appears adamant that this is where it happened. I think we're missing something.

Again with the withholding of pertinent evidence. Why couldn't it be admitted? How is that unfair to the accused? If evidence exists, obviously DM and MS put it there, or caused it to exist!!!!

Mystery of MB not being in court has been solved.

I would be extremely surprised if MB showed up in court. If I were MB I'd be too embarrassed to show my face in public. She must know by now how people feel about her now that we know about her participation in events after the fact.

Who knows though...she may just show up.

Not to sound crass but that in no way should influence a jury's decision on guilty or not guilty. We all feel for the Bosma's and we all want justice.

Putting a human spin on the aftermath of these losers crime spree brings it down to a relatable feeling for jury too. They are human too.

The best refresher course on the guilt of these two : Yesterday's testimony around 11:00 to about 1:00. I had to miss around that time and thought i skimmed back - not far enough.> man that is some damning text there! Why does it seem like the incinerator was going in and out of the barn even a year prior-a fare bit?! (home made one) The white van modification is the craziest bit of knowledge. so glad these guys were caught!!

MB and CN both belong in jail too. Wonder how they sleep at night.

There are numerous reasons why certain pieces of evidence are not admissible at trial. It could be that the evidence was not collected properly, evidence was lost or corrupted. Both Defence Lawyers may have successfully argued to have certain evidence thrown out based on various reasons. It happens all the time.

We are going to hear about some of this evidence that was not presented once the Jury has been sequestered. I think, some things will not be divulged because they go to the LB and WM trials.

We shall see. MOO

It's also equally rare for someone who is guilty to voluntarily take the stand

According to your theory then, guilty people don't take the stand.

Will the judge tell the jury that? Guilty people rarely take the stand therefore you should believe Mark Smich.

And BTW the OP is right that guilty people don't confess on the stand -- except in the movies and very exceptional circumstances.

Didn't the judge say that the jury is not supposed to form an opinion until after the closing by the three parties? Is Honourable Justice Goodman promoting fence sittingship in your opinion?

Sure. But IMO I think it's naive to think jurors haven't already started to slowly form opinions. They're human beings at the end of the day.

Whether the victims family is there or not, i would think that any juror would want justice for the victim and the victims family. If it was my loved one who was murdered in cold blood I would want anyone involved in the crime before, during and after punished to the maximum the law allows. If I was a juror I would want to see this happen. I am confident. Sharlene Bosma and her family are there to make sure that they have done everything they can to ensure justice. I commend them. I cannot imagine what they must be feeling. So many testifying with large gaps and crimes of omission in my opinion. A very bitter pill to swallow I would think.

Not sure if mentioned before, if so please forgive me. And please enlighten me.
If the plan was to test/scope TB's truck and come back later to steal it as planned (ALLNIGHTER) They did bring a change of clothes, duct tape (for who knows what) and not even a screw driver to change the plates. And we know of one gun.
How in the world were they planning on stealing it without the keys?

I'm having a difficult time believingTB was shot at the lane way, that close to home. Without any neighbours hearing a loud bang from a gunshot. Especially at that time of day, shortly after 9 PM.

Back in the early 80's undercover police officers from TO would come to my farm to practice shoot, and I have no doubt in my mind, given that time of day, someone should have heard a bang.
However, I can not say how muffled a shot would be from inside a vehicle with the windows closed.
It would be deafening to those inside,to say the least.

RBBM - Thank you for the information regarding the gunshots.

I have the same question about the keys to the truck: were the keys to TB's truck chipped?

ETA: could someone please post the link to the timeline - thank you in advance!

Any guesses on how long the deliberations will take?

My guess is less than a day.

I think if it's quick, we see both get first degree. The longer deliberations go, the more likely we see MS get a lesser charge. MOO

I suspect that finding Dellen Millard guilty won't take much time at all. I think the only points of discussion will surround Mark Smich. Clearly there are muddy waters here for some and not for others.

If I were a juror, I would be very comfortable finding them both guilty of first degree murder, but I'm not a juror, so we wait and see.

I do wonder if the Crown spent so much time on the plan and the aftermath of the murder with Smich because they did not want to pile onto the Millard defense of Smich did it and Millard did not. Getting Smich on the pre and post allows for the Crown to make sure that the jury realizes that both are guilty rather than a pick one situation or the jury feeling like they don't have enough on Millard because he did not testify.

I think if evidence he was killed in that field existed, it would have been presented. TBH I think the crown came up with what they thought was most likely the series of events, then presented it during their cross of MS in the hopes that it would catch him off guard, causing the jury to believe that it exactly what happened. I'm not sure it worked though

Couple of questions if people don't mind--I've been slammed at work all week and can't keep up.

1) Did the Crown ask about the infamous sausage/furniture texts?

2) Was any time/place/personnel ever clarified for the clean-out of the eliminator?

3) Going to assume "hosegate" never came up again?

CJPrincess, if you're here, one of your posts earlier mentions something about the blood in the "box" of the truck, I assume you mean the luminol results in the bed of the truck? Did that get explained or theorized?

Thanks in advance.

His name has come up a few times in the Ontario courts dockets with him filing against the Queen. I think I've read somewhere that he was complaining about his food while in jail and was taking his case to court over it. It was around the time when he was late getting to court and court was delayed a bit.

He's truly going to get what's coming to him if he's found guilty and I believe he will. He's entitled and thinks he deserves special treatment. Unfortunately for him in prison there are no special favors - no matter how much money you have. Wentworth is notoriously awful. Even the guards and officers agree. I hope that's his life now forever. He deserves it. Btw inmates are familiar with Millard (i.e. this article) http://thespecgraphics-hamilton.com/BartonStreetJail/index.html
