Pillay says there was "no objective clarification" in Plaxton's mind about the timestamp.
by Adam Carter 12:17 PM

Basically, it comes down to this -- of you believe the Crown/Plaxton, and the video is three hours off, it discounts Pillay's theory as to what happened.
by Adam Carter 12:18 PM

Pillay now playing audio from one of those witnesses' testimony. He agrees in the audio that he's ballparking it.

I thought of that too before I posted.

We recently had a car listed privately. We gave everyone our spare key that wasn't with any other keys.

  • #143
So far, everything I expected. They are grasping at straws. Good Luck!

  • #144
I understand what Pillay is trying to do....cast doubt on Crown's witnesses and MS's story.......but at the end of the day, whether that is TB's truck in the first two passes of the SS video is irrelevant to DM's guilt. MOO

"A ballparking estimate is very dangerous," Pillay says.
by Adam Carter 12:21 PM

Pillay also saying that the police officer here didn't make proper notes about the timestamp being off -- something he should have done.
by Adam Carter 12:22 PM

The officer had no objective note of verifying the timestamp, Pillay says. "All you have is that testimony," Pillay says -- three years later.
by Adam Carter 12:27 PM

"The evidence on this score is simply incredible," Pillay says.
by Adam Carter 12:28 PM

"How convenient is it for the video to be exactly three hours behind?" Pillay asks, saying that the timestamp evidence is incorrect.
by Adam Carter 12:29 PM

"It's not 9:05 p.m. It's sometime after that."
by Adam Carter 12:29 PM

Pillay says the timestamp from the Bobcat of Brantford video helps his theory.
by Adam Carter 12:30 PM

Google suggests the route from Supersucker to Bobcat of Brantford takes 18 minutes.
by Adam Carter 12:30 PM

Pillay says that given a person has been shot and killed, we can assume they're going fast. Even without that, nine minutes are unaccounted for, Pillay says.

is it just me? i''m struggling to even hear/absorb what Pillay is saying.

I want to respect the justice system, the rights of the defendants and consider what is being said (presume innocent until the charge from the judge)...but for every point Pillay brings up in defense, I find myself countering with 2 or three questions based on evidence that I don't even know if he will even address... and without THOSE answers, all I start hearing is 'blah blah blah' as his points are tweeted (that's pretty bad, eh?)

I've never listened to closing arguments before, maybe I have to be more patient and try hard to concentrate...how do jury member's minds not drift through these long monologues??

edit:I think I'll leave for now, and read the summary later...

Pillay says a 9:47 p.m. arrival time at Bobcat of Brantford would actually make it 9:29 p.m. on the Supersucker video.
by Adam Carter 12:33 PM

That allows his suggestion to be possible.
by Adam Carter 12:33 PM

"They're going to take the fastest route. They're going to take the highway. They want to get out of there," Pillay says.
by Adam Carter 12:34 PM

can someone post the map with the two video locations marked please? Wonder if they took back roads instead of highway?

MS testified that they did take back roads - not the highway - but whether that's true or not is anyone's guess.

Or are they going to take back roads because there is less chance of anyone seeing anything suspicious? Which would account for the extra time getting to Bobcat. MOO

Classic DM lawyer strategy of taking 60 minutes to make a point that everyone could understand in 10 minutes.

  • #154
Pillay ays that Millard and Smich are walking up the Bosma driveway at 9:05 p.m. The first trip past Supersucker happened at 9:05 p.m. The second trip past the camera is 9:25 p.m., and just before Bosma is shot, Pillay says.
by Adam Carter 12:36 PM

Pillay now talking about "expectation bias."
by Adam Carter 12:37 PM

That's what Pillay is saying happened here. "The video doesn't lie, ladies and gentlemen."
by Adam Carter 12:37 PM

I think Pillay is doing a pretty good job of knocking holes in Mark's story. But the problem is, I'm not sure he's knocking holes in his client's involvement.

Pillay says the phones were turned off right after Bosma was shot. Millard's phone, it should be noted, wasn't turned off. "The timing wasn't a coincidence ... it's the precise time around when Bosma was shot," Pillay says.
by Adam Carter 12:40 PM

The fact that the Bate phone and Smich's phone were shut off at the same time shows that Millard and Smich were in the same vehicle at 9:23 p.m., Pillay says.
by Adam Carter 12:41 PM

Pillay is alleging that Bosma was shot just before 9:23 p.m., when the two phones go offline.

Except there is no proof all 3 instances of a truck on that video were in fact the Bosma truck. If the expert himself could not say if in fact they were the same truck, why does Pillay expect the jury to believe they were, that Smich lied, and happy-go-lucky Millard was just minding his own business while planning to steal Tim's truck and Smich shot him?

  • #158
Wait, I'm confused. I thought they said he was shot on the 403 to Brantford? Does this work @ 923? I thought the timeline he just gave has them going to Bobcat at 930-947 (17 min)?

Yep. I made a comment during the cross-examination of MS that DM's lawyers are pretty much resigned to the fact that he is going down for 1st Degree but they want to make sure MS goes down with him. MOO

Pillay says that because this is a rural area, it's unlikely that a similar truck would be travelling past the camera twice. "That renders the probability of random chance even more remote."
by Adam Carter 12:44 PM

"The video camera does not lie. It does not forget. Officer Stoltz? That's another story," Pillay says.
by Adam Carter 12:45 PM

"The Supersucker video shows that Mr. Smich lied to you, under oath," Pillay says.
