Whaaaaaaat??????? now I'm confused. :waitasec:

To me this means that they may be considering MS's verdict but have come to the agreement that DM was the actual killer (principal, I think Goodman said was the term).

So they go down this tree if they have decided which of the two was the principal killer but are considering and deliberating on the other person's verdict.

All, MOO.

I'm thinking 1st degree for both. MS taking the stand sealed it for me. He placed himself away from every part of the whole event and clearly used the evidence (and only the evidence) to set up his version of events. So much so that I didn't believe anything he said. So why would I believe him when he said DM pulled the trigger?

I agree, however my concern is that when you start applying the decision trees some real consideration has to happen on a number of fronts. That's all I was trying to say.

Smich does not have exact recall of timing of events on night of May 6. Judge outlining several possible timelines for the murder.

Smich ramrod straight in his chair, looking at judge. Millard taking notes.

Why is Millard constantly taking notes and Smich rarely does it seems? What do you all take their body language to mean?
I've read that lawyers tell their clients to write things down just so they look like they are doing something and paying attention, not looking bored or annoyed, etc.

He could be drawing pictures over there for all we know. Think it's more for presentation for the jury than for his own use.

Must of missed the full explanation of the following tweet.

Goodman tells the jury to consider Smich testified he had no intention to kill anyone, and that Millard blamed Smich.
by Adam Carter 1:53 PM

Did MS not also blame DM? Was he referring specifically to the letters?

Should he not be balancing out his examples?

<rsbm>

Not really .. he's addressing salient points of evidence or lack of evidence with his interpretations and judicial analysis capabilities. JMO

Wow.....this has become almost impossible to fully comprehend without visual aids in hand as Justice Goodman speaks.
Following on line with minimal information from tweets and no handouts.....I'm thinking we are pretty much SOL until this evening when the different media outlets start putting out something we can print out.

Brain flash.....WSers have a unique and powerful resource. It's Billandrew. I can't think of a single other person who could better organize all of the Decision Trees and choices.

Poor guy ... Would hate to add to his workload, lol [emoji4]

by Adam Carter 3:28 PM

Hah, I guess AC is getting tired of typing out the same things over and over.
