Judge is reprising evidence of Christina Noudga. She said Millard told her incinerator was to burn animals.

I'm confused. I thought she testified that DM told her it was to melt metal?

Yes, I am certain she said it was to "burn metal"

I'll have to go back and look because I do not remember that. I thought It was to burn metal then changed to melt metal. She didn't have knowledge of pet cremation business. I'll go look.

I don't recall MS admitting to anything to do with the Eliminator

  • #37
Wow! We have obviously MISSED lots or the Judge is confused.
I'm still reading CN'S trial testimony and still nothing about animals. Just burning and for DM'S Aviation company he wanted to start.
Now MS helped clean the incinerator out on May 7th? I don't recall that either.

Goodman says that the jury can only determine what the facts are by the evidence. "Suggestions or theories put to a witness by a lawyer and not agreed to or adopted by that witness, is not evidence," Goodman says.
by Adam Carter 10:22 AM

Goodman says there "is not foundation whatsoever" that the shooting happened on the 403, like MIllard's lawyers suggested.
by Adam Carter 10:22 AM

Goodman says there's also no weight to suggestions the Crown made, like Millard was preparing to flee before his arrest. "You must disregard them entirely," Goodman says.

Crown said Bosma on test drive may have tried to get back to his family

Susan Clairmont ‏@susanclairmont · 3m3 minutes ago
None of those things are facts, says judge. Jury cannot consider them.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
Also, Dungey repeatedly said there was no evidence about certain things, except that from his client. That was not always true.

Susan Clairmont ‏@susanclairmont · 1m1 minute ago
Crown in closing talked about Bosma's life and effect of his death on his family "and all of us." Jury cannot consider that "victimization."

  • #40
"A lawyer's personal opinion is not helpful, or relevant to you," Goodman says, about how Dungey referred to Millard in his closing.
by Adam Carter 10:24 AM

For the second time, Goodman tells the jury to ignore what the Crown said about considering Bosma's family. "You shall not internalize and victimization of this crime in the evidence," Goodman says.
by Adam Carter 10:25 AM

Goodman is now turning to his decision trees -- essentially, they're flow charts to reach a verdict. There are four of them.
