Now onto the Noudga letters. Leitch says they highlight "a guilty conscience by Mr. Millard for the murder of Tim #Bosma."

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
The letters show Millard is guilty of #TimBosma murder, Leitch says

molly hayes ‏@mollyhayes 3m3 minutes ago
Leitch says the letter show that "he killed Tim Bosma and would do anything to avoid a conviction for murder." #Bosma

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
Now seeing excerpts from letters on screens. Millard was willing to perjure, willing to enlist Noudga.

molly hayes ‏@mollyhayes 2m2 minutes ago
He says Millard is pushing for perjury and witness tampering. #Bosma

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
"Only the craftiest of coyotes" will get away with this, Millard writes. "Be my secret agent"

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
"Be my secret agent; effectively my saviour," writes Millard. "He was grasping for a lie to work on you, the jury," says Leitch.

molly hayes ‏@mollyhayes 3m3 minutes ago
"We can't know what to say until disclosure is fully in," Millard writes. Leitch says this is "pure and utter attempts" of perjury. #Bosma

molly hayes ‏@mollyhayes 2m2 minutes ago
In the letters, Millard repeatedly asks Noudga for info to corroborate stories. "We need to get our stories straight. Be my secret agent?"

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
"Clearly waiting for disclosure to tailor a false story," says Crown. He wrote Noudga "a rough draft."

molly hayes ‏@mollyhayes 3m3 minutes ago
In the letters, Millard identifies Andrew Michalski as his main problem. #Bosma

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
He scripts a false story for Noudga to tell the jury, Leitch says. His problem was Andrew Michalski.

molly hayes ‏@mollyhayes 2m2 minutes ago
To support his stories, Millard is writing Noudga "a false story for her to tell you," Leitch says. #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Scripted "a false story for her to tell to you." Problem is Andrew Michalski evidence of "Steal truck from nice guy or *******?"

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Michalski told police Millard wanted to steal a truck. Millard wanted him to say police coached him to give false evidence

molly hayes ‏@mollyhayes 2m2 minutes ago
He needs Noudga and Michalski on side, Leitch suggests. #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Trump card would be Noudga's false testimony. "It is vital to my case that his statement be discredited," Millard writes of Michalski.

  • #242
molly hayes ‏@mollyhayes 2m2 minutes ago
Millard says he needs Michalski's story (after he talks to police) to be "discredited." #Bosma

molly hayes ‏@mollyhayes 2m2 minutes ago
Millard wanted Michalski to say he was looking to "buy" a truck--not steal. But he abandoned that story in trial, Leitch tells jury. #Bosma

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Noudga's false testimony was going to be his ace, Leitch says. "It is vital to my case" Michalski testimony is discredited, he says

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Hearing audio of Noudga testimony about Millard changing his defence story. His fabricated story.

molly hayes ‏@mollyhayes 1m1 minute ago
Leitch plays audio of Noudga's testimony in court, when she admits Millard was constantly changing his defence story. #Bosma

Susan Clairmont ‏@susanclairmont 59s59 seconds ago
Then Millard tries "for the home run," says Crown. Wants to try to say he wasn't even there. "That's not what he says now," Crown adds.

Lisa Hepfner ‏@HefCHCHNews 58s58 seconds ago
Even Noudga, on the stand, agreed Millard was crafting a false story in his letters. Leitch replayed her testimony

molly hayes ‏@mollyhayes 46s46 seconds ago
He comes up with another "false story" in his letters. One that puts the blame on Smich, and suggests he wasn't even there. #Bosma

molly hayes ‏@mollyhayes 1m1 minute ago
"I wasn't there, right?" the letter reads. #Bosma

molly hayes ‏@mollyhayes 50s51 seconds ago
Leitch says he interspersed these pleas for help with professions of love to Noudga--attempts to "emotionally box her in...get her on side."

usan Clairmont ‏@susanclairmont 48s49 seconds ago
Scattered through letters are attempts to manipulate Noudga with promises of love, lust...even the possibility of children.

Lisa Hepfner ‏@HefCHCHNews 47s48 seconds ago
Millard's lie would change to fit the disclosure, Leitch says. Eventually Millard's scenario has him not there when #TimBosma murdered

  • #243
In one of the letters, Millard concocts a story where he wasn't there when Bosma died. "That's not what he says now," Leitch says.
by Adam Carter 2:07 PM

Throughout the letters, Millard is trying to play Noudga when he's talking about his love for her, Leitch says.
by Adam Carter 2:07 PM

Leitch says Millard has concocted four defences. "How can you have any doubt with this pattern of fabricated defences that the one presented here is fabricated too?"
by Adam Carter 2:09 PM

  • #244
Susan Clairmont ‏@susanclairmont 17s18 seconds ago
Noudga audio saying Millard had to come up with fabricated evidence. Third approach by Millard was he only planned to scope and steal.

Lisa Hepfner ‏@HefCHCHNews 12s13 seconds ago
Millard also started promising lots of romantic plans with Noudga, to further rope her in, Leitch says

molly hayes ‏@mollyhayes 36s36 seconds ago
Leitch notes the "I wasn't there" defence was abandoned-so was the "buy not steal" story. Then he went with "I only wanted to steal." #Bosma

Susan Clairmont ‏@susanclairmont now7 seconds ago
Fourth fabricated defence was Mark shot Tim on the road, the version we have at trial. "It's all an attempt to fabricate," Leitch says.

Adam Carter ‏@AdamCarterCBC now7 seconds ago
"How can you have any doubt with this pattern of fabricated defences that the one presented here is fabricated too?" #Bosma

Lisa Hepfner ‏@HefCHCHNews 29s30 seconds ago
The jury can't put any stock in the letters, they are all perjury, Leitch says

Susan Clairmont ‏@susanclairmont 8s9 seconds ago
"Mark Smich's evidence is a lie," says Leitch. "Tim Bosma's planned murder was going to happen." Jury should "reject" Smich testimony.

molly hayes ‏@mollyhayes 4s5 seconds ago
He says Smich's story too is an attempt "to trick you," because it was desgined to fit the Crown's evidence. #Bosma

Lisa Hepfner ‏@HefCHCHNews 18s19 seconds ago
The jury should reject Mark Smich's testimony entirely, Leitch says. He is just trying to save his own skin.

molly hayes ‏@mollyhayes 15s16 seconds ago
Smich has a criminal record, Leitch says. But he says the "substance of his evidence" is "unbelievable." #Bosma

molly hayes ‏@mollyhayes 16s17 seconds ago
Smich several times says he "would've" done this or that, rather than what he did. Leitch says that is the language of someone who is lying.

Susan Clairmont ‏@susanclairmont 9s10 seconds ago
Smich has 7 criminal convictions. "Some for dishonesty." In testimony he said "I would have done this, I would have done that." Red flag.

Lisa Hepfner ‏@HefCHCHNews now
Hundreds of times Smich said "he would have done" something instead of he did something. That's a red flag for lying, says Leitch

molly hayes ‏@mollyhayes 28s29 seconds ago
Leitch says he is vague about many things because he doesn't wanted to be tested or pinned down in cross-examination. #Bosma

molly hayes ‏@mollyhayes 15s15 seconds ago
"He was weaving a story to fit the evidence. A story he hopes will help you to doubt his guilt," Leitch says. #Bosma

  • #245
Smich's evidence is a lie, Leitch says. "It's fabricated to trick you into believing he had no idea about any of this ... He was trying to deceive you, and save his skin."
by Adam Carter 2:10 PM

Leitch says Smich often said "I would have done this" while a person who told the truth would have said "I did this." "He also had a very vague memory for most things, except the things that would help him."
by Adam Carter 2:11 PM

"He was weaving a story to fit the evidence."

Susan Clairmont ‏@susanclairmont 4m4 minutes ago
Millard turned Bates phone off. Left own phone on because he figured cops would track the Bates phone.

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
Millard didn't turn odd his personal phone because he didn't think police would be able to trace him so quickly, Leitch says

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
"Millard never thought they'd be able to make that association between the two phones as quick as they did. And it was pretty quick."

molly hayes ‏@mollyhayes 4m4 minutes ago
It is roughly an 18 minute trip from SuperSuckers to Bobcat of Brantford (on hwy 403). Leitch says Smich says they took back roads. #Bosma

Susan Clairmont ‏@susanclairmont 4m4 minutes ago
Crown believes they took back roads to Brantford. "Why would you take a dead man out on the highway?"

molly hayes ‏@mollyhayes 3m3 minutes ago
Leitch says back roads make a lot more sense--you don't take a dead man on the highway, with all the passing cars and lights. #Bosma

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
That can account for longer trip to Brantford, according to Brantford video.

molly hayes ‏@mollyhayes 3m3 minutes ago
It takes them 27 minutes to get to Bobcat of Brantford. #Bosma

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
Smich says they took back roads to Brantford, arr 27 minutes later. Makes sense, Leitch says. Video of vehicles there & #Bosma phone found.

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
Smich testified shooting happened in Brantford. Crown says no. Makes sense #Bosma's phone was taken off him there, thrown out of car.

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
Unlike defence closings, Leitch admits to jury several times that Crown doesn't know everything. But offers logical, strong possibilities.

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
9:48 pm #Bosma truck pulls up to Bobcat of Brantford, followed by Yukon. Smich admitted that was them.

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Crown accepts two vehicles in Brantford video are Yukon and Bosma truck. See Bosma phone shuts down at 10:01 p.m., fits with Brantford stop.

molly hayes ‏@mollyhayes 2m2 minutes ago
Tim #Bosma's phone was shut down at 10:01 p.m. Which Leitch says is "completely consistent" with stop in Brantford.

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
#TimBosma phone is shut down at 10:01pm. They realized it was on and they needed to shut it down so they can't be tracked.

molly hayes ‏@mollyhayes 1m1 minute ago
Leitch tells the jury to look carefully at these videos. "There's no flashlight," Leitch says (as Smich claimed). #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Leitch on videos: "Look at them very carefully." Says no flashlight in the frames, contradicting Smich testimony of changing plates.

Lisa Hepfner ‏@HefCHCHNews 37s37 seconds ago
You can see the back of the vehicles in the BobCat video, Leitch says. No sign of a flashlight or Smich changing plates, as he testified

Ted Bundy hauled dead bodies in the passenger seat of his VW all the time! I would think time would be the factor of concern for hauling dead bodies. The 403 is faster.

It's truly amazing that some of the most powerful pieces of evidence against DM were crafted by DM himself- the letters. Seriously- MS may not be bright, but DM is just plain stupid. There's a rule in business- if you have to tell people to delete it after they read it...don't send it. If it's that confidential it should never be reduced to writing. None of the testimony or evidence is going to do as much damage to DM as those letters- and as TD eluded to- it shows us the way a criminal mind works.
Leitch is doing a great job getting the Jury to focus on the key elements.

IMHO, there will be no doubt in the Jury's mind that this was planned and deliberate by both of them. The D's have tried their best, but the words coming out of TL's mouth this afternoon should be sending shivers up the spines of the accused. There is no way out- no rebuttal-no more excuses and innuendo's and thankfully, no more Pellay and Sachak! lol OK...I know they're good lawyers, but I couldn't handle listening to them for another minute! MOO

It's not about the money saved. Bet the coolest folks at the Baja towed their vehicles with diesel trucks, and DM wanted to be one of the coolest.

Leitch says Smich destroyed his SIM card to destroy evidence.
by Adam Carter 2:12 PM

Smich also always passed blame to Millard. "You might feel Millard deserved it," but those repeated attempts show how "self serving it is," Leitch says.
by Adam Carter 2:13 PM

Leitch says Smich's counsel didn't ask critical questions about Smich's story to witnesses, like whether they asked Tumanenko about a GPS in the truck.

Smich was weaving a story to fit the evidence so you have doubt, says Leitch.

Susan Clairmont ‏@susanclairmont 42s42 seconds ago
Smich's vague memory means he was lying, says Crown. "He would have committed these important events to memory if he was telling the truth."

molly hayes ‏@mollyhayes 1m1 minute ago

molly hayes ‏@mollyhayes 42s42 seconds ago

molly hayes ‏@mollyhayes 13s13 seconds ago
The first place Dellen Millard went after police spoke to him, Leitch says, was to Mark Smich. #Bosma

molly hayes ‏@mollyhayes 27s27 seconds ago
Smich claimed his friend Brendan Daly was there, which is why they didn't discuss the gun. Daly was never asked about this. #Bosma

Susan Clairmont ‏@susanclairmont 22s22 seconds ago
Smich said Daly was there May 10 when Millard came by just before his arrest. Daly never asked on stand about it.

molly hayes ‏@mollyhayes 26s27 seconds ago
Leitch says Smich's lawyer asked no questions to Bullmann about the vehicles coming out of the field. It went "unchallenged," Leitch says.

Lisa Hepfner ‏@HefCHCHNews 28s28 seconds ago
Bullmann wasn't asked about Smich's version of events, which contradicted the 2 trucks he saw leaving field.

Susan Clairmont ‏@susanclairmont 5s5 seconds ago

Smich's evidence contradicts with Tumanenko. Tumanenko said the "temperature changed" in the truck after the Isreali Army talk, but Smich claims there was no reaction.
by Adam Carter 2:19 PM

Rick Bullman also said the truck and the SUV were deeper in the field than Smich said. Leitch says they should believe Bullman.
by Adam Carter 2:21 PM

Smich's evidence also conflicts with Sharlene Bosma and Wayne De Boer. Smich says the two walked towards them. Leitch says they said no.

I think Art Jennings was in a very precarious position on the day he was fired.
Mere steps away from a psychopathic killer with a loaded gun.who is now extremely pissed off at him.

The fact that DM didn't pop him tells me that there was some boundaries in DM's mind. Scared of cops.

I think DM couldn't kill someone like Jennings on top of the other murders. Each murder is like a ping on a cellphone tower. Triangulating the murder pings could lead the police to DM.

I think DM purposefully exposed his ability to steal, murder & dispose of bodies. He wanted to show his power but also covertly threaten anyone who might turn him in. He also gave some of them enough involvement in his smaller crimes to implicate or connect themselves to the murders- he thought it would silence them.

Noudga testified that Smich called her on May 10, and told her some "deep **** went down." Smich's lawyer suggested this never happened.

Susan Clairmont ‏@susanclairmont 20s20 seconds ago
"No chance to say it didn't happen," says Leitch.

molly hayes ‏@mollyhayes 14s14 seconds ago
Leitch is essentially laying out all the questions Mark Smich's lawyer failed to ask, that should lead the jury to disbelieve his story.

Lisa Hepfner ‏@HefCHCHNews 45s45 seconds ago
Noudga testified that Smich called her & said sh** went down. Smich says she talked to Marlena. Marlena wasn't asked.

molly hayes ‏@mollyhayes 29s30 seconds ago
There is "deep conflict" btwn Smich's testimony and others'. Leitch suggests if they believe others over him, they should disregard his.

Lisa Hepfner ‏@HefCHCHNews 18s19 seconds ago
These conflicts are important because they mean Smich is lying. Tumanenko says temp changed in car when he said he was from Israeli Army

Smich evidence in "deep conflict" with many reliable witnesses, says Crown.

These are some excellent points being raised about Smich's testimony and how his counsel never asked critical questions of the Crown's witnesses to help support his story. Igor, Schlatman, Meneses, Daly, Noudga, Bullman, etc. These witnesses were not cross-examined against the points Smich would later make on the stand.

  • Dungey never put to Igor if they asked about GPS in his truck, yet Smich said they did.
  • The officer was never asked about whether Smich told Meneses, upon arrest, to get a lawyer. Officer said Smich yelled to stay quiet.
  • Schlatman was never asked about whether he taught them both to steal cars.
  • Daly was never asked if Smich and Millard talked right before his arrest. Smich said they did, and Daly was there.
  • Bullman was never asked about the vehicles coming out of the field. It went "unchallenged".
  • Noudga testified that Smich called her on May 10, and told her some "deep **** went down." Smich's lawyer suggested this never happened.
