I went with both guilty. They both knew that there was a probability the gun would be used.

We know both knew the gun existed.
Both are charged with other murders - little cheating on my part using this info
MS not only said Gone, Gone Gone, but also told MM not to tell them anything. At this point he knew he was being arrested for murder.
DM put too much effort into cleaning up the botched crime, and sometimes without MS being around.

MS's turn will come when MM testifies and their text message exchanges are presented.

I have complete faith in the prosecution team, and look forward to their 'smoking gun' finale.

While I find this case interesting, I get a gut wrenching feeling when thinking about the pain all those who were in Tim's life have to endure with overwhelming evidence of the horrible end to Tim's life.

Guilty as hell. Proven, and no doubt about it, No doubts about the verdict either - at least in terms of Millard.

In the case of Mark Smich - I think he was an accomplice, an accessory, he was complicit .. but do I think he was the driving force?

Nope.

Dellen Millard murdered Tim Bosma and most likely his own former girlfriend and father. Mark Smich was an obedient sidekick impressed by his wealthy, confident friend is how I see it at the moment. He deserves to serve some time .. but do I think he is as rotten to the core as DM - no I don't.

I'm impressed by the way he has conducted himself in court (based upon the reports we have received) and I think his lawyer is a thousand times better than Millard's if recent reports are anything to go by.

I'm not excusing Smich for a single second .. but I have no doubt in my mind who the real psycho is here. He's tall, he's rich and he smirks and smiles in court,

Both are guilty. Both were there. Both knew the plan, as did other friends. Nothing I have heard from trial tweets or media articles has indicated any show of conscience, sorrow, remorse or anything remotely close to how a truly innocent person would act in similar circumstances.

These two are pure evil, and no amount of rehab in prison will change them for the better. Drugs, guns, theft, murder, lies, and more of the same is the lifestyle these losers have chosen.

At this point I really don't think there is enough evidence against Smich. He has not even positively been placed at the scene. The only evidence we have is that his cell phone was in that area that night. The video at the hangar shows someone of his build, but certainly far from a positive identification. Nothing incriminating was found in his home but a toolbox that the prosecution can only say may have contained a weapon. Smich left no fingerprints, and his DNA was not found in any of the cleanup gloves. While Millard was scrambling to hide evidence, Smich was observed hanging with friends. There was no motive for him as he didn't need a truck. There were no incriminating texts or internet searches. I'm not saying he's innocent because he isn't. He's just a better criminal than Millard, more careful and far better at covering his tracks.

Both equally Guilty. None tried to stop the plan. Both likely lifted the body into the incinerator. Both are mentally ill. IMO.

So after 40 voters, 90% think DM is guilty and 75% think MS is. Just making a note of that to see how things shift!

After 100 voters, we're at 94% DM guilty, 77% MS guilty

Both guilty of murder first degree. Both knew about it. Both participated in test drive, killing and cleanup. No remorse shown by both. No conscience. Neither one called LE after the fact. Both lied up until now.

Both guilty. At the very least they both cleaned up and disposed of the body, since it's doubtful they'll find out who actually shot him. They had a plan and carried it out together. It will be interesting to see how the the trial plays out and what the defence is going to do.

I voted both guilty as charged. I'm curious as to if those who voted not guilty still feel that way and why, particularly for DM. I wondered if there is something I'm not thinking of, a loophole.

I can't vote because the question is too loosey-goosey, would have liked it if it was broken down more, ie guilty of 1st, 2nd, other(?), or not-guilty. Some may feel guilty, but not as charged, and so would the answer be 'guilty', or 'not guilty' in that case? ie if someone believed they would both be found guilty of 2nd degree, rather than what they are charged with, to me, the answer to the poll should be 'not guilty', because I'm *assuming* that the question is asking about 'as charged', rather than something unknown. Or.. is 'guilty' just general overall guilty, doesn't really matter on what charge?

Both MS and DM will be found guilty of 1st Degree Murder.

It will make no difference who pulled the trigger. Both MS and DM have no credibility whatsoever(especially MS) so whatever they actually say will not matter.

Both guilty. Lots of evidence of pre-planning by DM
texts about fireworks, and fireside furniture, sausage pics by MS - in concert with conext and the rest of the evidence, the texts establish guilt beyond a reasonable doubt IMO
