Then a little further down AR says in an e mail " when you have time with her" So are they saying there is a third person that can have a few hrs with her?

I really want to know about that rental house on MJ's property. If rented who lives there? I really wonder if that's his torture chamber and what did he plan on doing with that machine after he used it. These depraved sickos escalate so we know. Did LE recover that equipment? If so where? I just think no one got Gagnon's picture going into or coming out of court. Here where I am from, no cameras or video cameras are allowed in Federal Court.

IF the FEDS want Gagnon to testify against Jacques, the only deal needs to be LWOP as opposed to the DP as they will be going for for Jacques. (IMO)

Maybe they are going to cut Gagnon some kind of deal and put him the witness protection prgram and don't want his face out there. :chicken:

I understand that, but the way in was stated in the e mail it sounds like she knows exactly who the other person is.

However, if MJ is convicted under the Adam Walsh statute, and the statute is held to be unconstitutional on appeal for some reason that overturns MJ's conviction, he can be tried again in the VT courts for the same crime.

The sex-offender registry portion of this act has been ruled unconstitutional by federal Judge Gregory Presnell in Orlando, FL, on April 18, 2008.

Now, that ruling does not apply anywhere except in the district court in Judge Presnell's jurisdiction. At some point, if the federal appellate courts disagree on the constitutionality of the statute or parts thereof, the issue will go to the Supreme Court for a definitive decision.

I am pointing this out because the status of being convicted under the Adam Walsh Act does not mean it will stick, constitutionally speaking.

It's not double jeopardy, though, to try MJ for the same crime in the VT courts, if his eventual and hoped-for federal conviction is overturned on constitutional grounds, or on any grounds.

I posted a link yesterday about this. The uncle is going to be charged federally and the Adam Walsh Bill used. It'll be the first time the DP has been applied under this. DP if a victim (child) dies during a kidnapping.

I cannot even see a newspaper pic or video of Jacques without getting sick. It is a shame sometimes it is not an 'eye for an eye, and a tooth for a tooth.' No matter whatever happens to Jacques and Gagnon, it will never be enough.

Just wishfull thinking, I suppose, that she would have been drugged rather than fully comprehending and feeling what was happening to her.

I believe in the eye for an eye / tooth for a tooth concept totally.

They had better make sure both are in complete body armor because I think somebody would love to put either or both out of there misery.

I was the one who posted that his picture was on the front page of the Burlington Free Press yesterday. No, in that picture he was not bald...I don't think he is the same guy at the MJ arraignment...that man was thinner than RG is. If my scanner was hooked up, I'd scan it for you but we just moved recently and it's not hooked up yet.

One thing that struck me and AFAIK we have seen no follow up on is: leading to his previous conviction there was testimony that he claimed to have killed a 12 year old girl in Arizona...is the FBI looking into this NOW if it was not done before??

I believe he said he 'killed a 12 year old Arizona girl.'

Therefore, the girl could technically have been FROM Arizona instead of IN Arizona.

That's if that claim was even true.... it's also possible he just said that to scare the victim.

Fox news just showed for a fleeting second a Marshall's poster of Gagnon. I heard them and just got a split second view.
He looks like the guy that was in the courtroom at Jacques arraignment!

I don't think Gagnon was at Jacques arraignment because I believe he has been in jail since the day of his arrest. I may have missed them but I don't recall any articles reporting he made bail.

This is one instance when IMO it would be fitting to have punishments from days gone by before the world became kinder and gentler.
Something like all the limbs torn from the body and taken to the 4 corners of the state and the head put up on a post as a warning to other spos's out there.

Does anyone have an idea of how long it takes for the inmates on death row in a federal prison to be executed?

Also, if MJ serves his term in a federal prison isn't that a better type prison than state?

They will have to exhaust their appeals first, in my opinion.

A Federal Prison is better than a state prison unless you are a maximum security inmate. Again, my opinion. Jacques and Gagnon will be not be welcomed among his fellow inmates. Inmates are 'classified' upon inception into prison. Some prisons, as Dark Shadows said, have an alotted space or wing for Sexual Predators, Child Molesters, Child Rapists, etc. These monsters will have the hardest times of any inmates.

Also, if the inmate is a minimum security inmate, some Federal Prisons are too much like a 'country club' setting. I am sure you have probably heard that one before. It's true.

Well, it was on the front page of the BFP...so they had to have let it out...the BFP is VERY VERY careful about things like this (I have an inside BFP source, although not on this case specifically).
