I think they just used the last day she was seen alive. There is no way after a week they would be able to determine the exact day of death.................unless someone has told them otherwise???

i think the feds caught on too quickly for him, and that he actually thought he could fool them.. Not enough time for him to sanitize his house etc...enough time for him to lose his hard drive however. perhaps he did not expect AR to cave as fast...

Believe09, that sounds like it could be just what happened. He may have been suspected a few times of pedophilia, pornographic material and always talked his way out of it with the local cops - he knew them and knew how to run a scam on them. But the Feds are different - they are good at computers and reading emotions, facial expressions! They made him sweat! They came on the scene and he was overwhelmed. I'm not denigrating the local police at all - but this guy had years of family upbringing in sick ideas - he learned from relatives how to work the locals - police, probation officers, town people, teachers, etc. The Feds were a different breed.

Here is the link to the Gagnon affidavit. PDF pg.9 and item 19 is where he states he "assumed" there was child porn in the safe. Why assume that unless you had a reason too.

Also PDF pg.9 item 20. What the heck were RG and MJ talking about for a total of 47 minutes? I'm pretty dang sure it wasn't just about changing the myspace page.

He must have deluded himself that nobody would check his phone or email records. He banked on the cover story being bought 100%...the police would be looking for a runaway in Texas.

But, I don't understand the point of getting AR's boyfriend's semen unless he was going to blame the BF for Brooke's death. Getting the semen was part of the planning so he had to have intended to plant it.

Either he was going to use it to keep the BF quiet or to frame him..

Another possibility is that he never thought they'd compare it to the BF's DNA, so it would just be a big mystery of the case. I'm assuming his DNA isn't in any LE database. So MJ might have just been looking for some "clean" DNA to leave behind.

I think he really thought this story would be more credible, that AR would alibi both him and BF, and that they would never be seriously looked at as suspects. He really thought the myspace thing would fly.
