Swain was convicted by a jury for killing his second wife, Shelley Arden Tyre, in 1999 while the two were scuba diving during a vacation in Tortola, the most populated of the British Virgin Islands. He was sentenced to 25 years.

On Sept. 29, a panel of three appeals court judges ordered Swain to be released after it found the instructions that were read to the jury by the judge in the trial unacceptable. The appeals panel did not order a new trial, saying that it would be difficult to recall defense witnesses because of the length of time that had passed since Tyre’s death.
