According to the documents NBC 7 Investigates reviewed, one of the school workers said, “it’s all about control.” In addition, one school employee said Arabella told them that she slept on the floor, without a bed or bedsheets, with a pillow as a form of punishment. They said Arabella spoke with a school worker about the movie “Annie.” The report states Arabella told the worker, “she is not like Annie because when Annie got adopted, all her hurts were gone; however, the child states that she is still hurting.”

According to a July 13 non-conformed lawsuit obtained by CBS 8, the young sisters describe what were horrendous conditions and abuse inside the family home as well as repeated failures from church members and a San Diego police officer to report the abuse.

The lawsuit states that when deputies arrived at the home, Arabella weighed 40 pounds, her bones protruding from her small frame, her teeth yellow and calcified, and her body blanketed with bruises, scars, and cuts and riddled with broken bones.

The two young sisters, whose identities will remain anonymous, were not in much better condition than their sister, says the lawsuit.

"Both appeared younger than their ages due to underdevelopment. They suffered from re-feeding syndrome (a phenomenon identified following World War II when prisoners of war were provided with food after a prolonged period of starvation and subsequently died from cardiac failure) and had to be nourished gradually. They were hospitalized and received treatment that saved their lives," reads the complaint.

The Investigation


In their lawsuit, attorneys for the girls outline what were repeated failures on the part of numerous people who were classified as mandated reporters by the state, responsible for alerting law enforcement of abuse and mistreatment.

According to the lawsuit, two of those reporters were employed by the Rock Church.

The girl's mother, Leticia McCormack, served as an elder and ministry leadership coordinator at the Rock Church. McCormack worked alongside a church member, who, according to the lawsuit, had visited the family home and described the girls as "little ghosts."

Reads the lawsuit, "Ms. McCormack told the prayer group that Arabella had 'bad behaviors,' that they couldn't have people over, and that there was 'spiritual warfare' and 'demonic activity' with Arabella."

Yet, despite what were clear warnings, the lawsuit alleges that the church member failed to follow up or report the behavior.

But that church member was not the only one aware of the dire and dangerous situation inside the McCormack home.

The Rock Church's "Child Abuse Investigator," also a San Diego Firefighter and a minister at the Rock Church, according to the lawsuit, visited the girls on several occasions, the latest visit just one week before Arabella's death.

At the time of the visit, reads the lawsuit, "all three girls were severely emaciated, underdeveloped, and the victims of prolonged starvation, isolation, lack of medical care, torture, and abuse."

It was one of several complaints made to Child Welfare Services that went unanswered and further evidence of the utter failure by numerous agencies and officials whose sole task was to keep Arabella safe, says attorney Craig McClellan.


This lawsuit hopes to accomplish two things," McClellan told CBS 8. First, it seeks to make amends for the losses that these young girls have endured, not only for the horrific torture and starvation they suffered but for the death of their big sister. These cases are frustrating. There’s obviously a pattern we see her on WS of children being fostered/adopted, homeschooled, and abused/tortured/murdered.

Resources obviously don’t allow in our current structure, but follow up visits after adopting could be a good process. Some type of welfare check in for homeschool kids.

Our system just seems unfixable. My family started the foster system years ago and it was borderline ridiculous. We had a nice house, extra bedrooms. They required a house water test (?) which I found odd when you see stories of foster kids living in squalor. But what stopped us was they made it so difficult in our state. Kids had to remain at their current school for stability , which I understand (we lived in a great school district and most of the kids to be fostered went to an inner city district a town over, same county). So they wouldn’t be able to take the bus with our kids or go to the same after school program. Additionally, because we were looking to foster then adopt, we wanted school age which we were told was fine to request only school aged kids. But when we went thru the process, they said we will call you in the middle of the night with any age kids and you can just say no. (Like I can turn down a toddler in need). But the approved daycare centers had waiting lists so we’d be paying out of pocket for daycare (could be thousand a month). We just wanted to add older kids to our household, could easily pass background checks, kids would have a stable home, references etc but the barriers were too much.

So I see these stories, so many of them. And think how did these people get thru the system? Why make it so difficult with stupid things! Focus more on the background checks, references etc to weed out the bad parents. You see these stories of the abuse suffered. Many times you think whatever these little kids went thru with their bio parents was better than they ended up with.
This is exactly why I never went through with fostering children. The system is so whacked out. These horror stories are everywhere and then you have people like you and I. People who have the room and love to give, but they make it too hard. It’s bizarre

SAN DIEGO — A pair of sisters, aged 7 and 9 years old, want answers as to why San Diego Police and members of their church refused to prevent the death of their oldest sister, Arabella McCormack.
Arabella McCormack, just 11 years old at the time of her death on August 30 of last year, died from severe malnutrition and abuse at the hands of their adoptive parents, Brian and Leticia McCormack.

McCormack was reportedly just 40 pounds when Sheriff's deputies arrived at the family's Spring Valley home on a report of a child in distress. McCormack died shortly after from heart failure.
The girls' adopted father, Brian McCormack, a Border Patrol Agent, shot himself to death inside his truck hours after deputies were called to the home.
The girls' mother, Leticia McCormack, and her parents have since been charged with murder in Arabella's death.

In the week following Arabelleas death, the head pastor and founder of the Rock Church, also a former San Diego Charger football player, Miles McPherson, posted the following message to the church's website:
“I want to address a very sad situation that was in the news this week that one of our former volunteers was arrested for the death of her adopted daughter… She was a volunteer for law enforcement, was background checked by law enforcement, background checked by child protective services because she was a foster mother then adopted parents… And then, obviously, we did a background check after all that, and nothing revealed that anything like this could happen,” McPherson told the congregation. The Rock Church also posted a statement regarding Leticia McCormack on its website.
In addition to her role at the Rock Church, the girls' adoptive mother, Leticia McCormack also volunteered as a "Crisis Intervention Specialist" for the San Diego Police Department. McCormack's parents, the girls' adoptive grandparents, Stanley and Adella Tom also volunteered with the department.
The legal complaint alleges that McCormack worked alongside a San Diego Police Officer who visited the family's home and witnessed Brian and Leticia McCormack prohibiting the girls from eating food and when they did forced them to chew their food very slowly.
But that wasn't all, alleges the lawsuit.
The police officer also provided wooden paddles for the adoptive parents to hit the girls with.
Reads the complaint, "Rather than report the girls' neglected and abused condition to the authorities as required by law, [the officer] provided Ms. McCormack with a wood paddle to strike and inflict pain on the girls. When the first wood paddle broke, [the officer] provided Ms. McCormack with two more paddles. [The officer] did not merely fail to report the neglect and abuse, she became complicit in and aided and abetted it when [they] provided the paddles."
he complaint also states that San Diego County's Child Welfare Services was notified of potential abuse at the home as far back as August 2018. It was then that administrators at Arabella McCormack's elementary school notified the county that the adoptive parents, "withheld water from Arabella and limited her drinking to one Dixie cup per day. The school reported that the McCormacks controlled what and when Arabella could eat, punished her by making her sleep on the floor without a pillow, and called her a liar."
It was one of several complaints made to Child Welfare Services that went unanswered and further evidence of the utter failure by numerous agencies and officials whose sole task was to keep Arabella safe, says attorney Craig McClellan.
"This lawsuit hopes to accomplish two things," McClellan told CBS 8. In a statement to CBS 8, a representative for the Rock Church wrote, "Given the pending litigation, the Rock Church cannot provide any additional comment or information at this time.."

OMG, tragic, absolutely tragic. She was so malnourished that Aarabella's eye sockets were hollow. She and her siblings had "Starvation Syndrome". Adoptive mother told church members there was "spiritual warfare" going on with Arabella. A police officer gave the adoptive mother a wooden paddle to use on the kids, and when it broke from beating them, the police officer gave her two more!!! WHAT?!!!

OMG! literally everyone who should have protected these girls was complicit in their abuse and torture! I am just gobsmacked by this bit!


Except for teachers, who went unheeded time and again when they did as mandated and reported! This is horrific and I hope the suit hangs every last one of the abusers and their accomplices out to dry.

Remember also that the adoptive father was a Border Patrol Agent who killed himself immediately in front of police when they came to the home to investigate Aarabella's death. It was reported he was seen being rough with Aarabella at the school. It's like this entire adoptive family was allowed torture Aarabella every which way and nobody stopped them. You have to wonder why the adoptive father didn't want to stick around to answer for his actions.

I totally agree, I don't care who filed suit, someone needed to because this shocking and shameful case requires answers and a suit is the only way to get them and possibly protect future children from this horror. IMO and MOO
 
After I posted last night, I thought of another analogy. Say that a couple divorces. One spouse dies in some tragedy and there is a lawsuit. Then does the ex-spouse get to profit from that death? Maybe, despite the dirvorce, the surviving spouse still has some genuine feelings for the one who died. Maybe they would have even gotten back together someday. But, they were legally divorced. So in my mind, the surviving spouse does NOT get money related to the death. Parents, siblings, children, maybe, but not the ex-spouse.

Florey said social workers didn’t properly vet the McCormacks, didn’t properly investigate suspected abuse reports and didn’t ensure Aarabella was receiving proper medical care.

“The county needs to be held responsible for the death of my daughter,” Florey told NBC 7. “I’m not going to let it go. And I’m not going to stand down for my daughter. My daughter is going to have a voice.”
The claim says the county took custody of Aarabella and her two younger sisters in 2016. Florey said she was in a tumultuous relationship at the time, and the county did not want the children exposed to domestic violence between the couple. She is adamant she was never accused of abusing her girls. Florey said she is in a much better place now, has gone through therapy and is fighting to regain custody of her two youngest daughters. For now, the girls have been placed with a foster family.

^^^ I'm glad there are others here that understand this horrific abuse to those adopted children has to be brought to light via a law suit against all responsible parties.

I really had to take up for the bio mother's cause earlier in this case, but I hope now others realize how, of course, the bio mother was as sick with grief, as we all are, to hear the torture the adoptive family put those children through. MOO-- Giving a child up for adoption doesn't mean you don't care, sometimes it's to give the child(ren) a better future.

Bio mother is to be commended for filing the law suit and forcing the facts out. The biological mother is bi-polar, I believe, she says treatment has helped her. She expressed wanting to regain custody of her other two daughters.

That will be a whole different battle and will depend what is best for the children. Whatever the outcome of the custody issue, I suspect and hope the award from this law suit will probably be set aside in a trust for the two siblings of Aarabella. Any award from this law suit should definitely go predominately to the two children. All MOO.
 
Anyone know if this "police officer" (and I use that term very loosely) - is going to get criminal charges of any kind? I might have missed it though...
I don't know, but I think the police officer should face actual criminal charges. Bet they won't though. I don't think the money awarded from even this law suit comes out of any of the agencies employees' pockets, so... Are they fired or what negative impact do they actually face? Anybody know?

The three girls moved in the McCormack residence in 2017 as foster children & were adopted 2 years later. The three suspects allegedly abused & tortured McCormack’s three daughters for about five & a half years, leading up to Aarabella’s death in late August, 2022.

3/6/23 Update: Adella: bail review hearing: Judge Kathleen Lewis granted bail set at $100K & said she granted Tom bail based on her age, lack of a car or ability to drive, lack of specialized medical care in jail & her agreement to use a private GPS monitoring system. Tom will live with friends in San Bernardino County. Tom cannot leave the San Bernardino home other than to see her doctor/specialist & pick up medical & other necessary supplies. She is also not allowed to reach out to the victims or to the codefendants (her husband & daughter) & she agreed to a 4th amendment waiver. Preliminary exam hearing for all on 5/23/23.
5/23/23 Update: Preliminary exam hearing was rescheduled on 8/29/23 for all.
