According to arrest documents, Hernandez told police she left the car running with the air conditioning on.

However, investigators said they found the vehicle was warm when they arrived and later learned it had an automatic shut-off feature that turns the engine off after an hour.

This mother was so concerned with her appearance she left her babies in her car mobile oven for hours to get a cosmetic procedure (I really want to know what procedure was so very important it trumped her kids).

According to a police offense report obtained by 23ABC News, prior to arriving to her appointment, Hernandez messaged spa personnel asking if she could bring her children inside, receiving a response, “Sure if you don't mind them waiting in the waiting room hun."

Documents say the cosmetic procedure done on Hernandez only took 15 to 20 minutes, but the children were left in the car for almost two hours. It states that at no point did Hernandez come out to check on her kids.

Reports state that Amillio's internal temperature was 107 degrees when he arrived at the hospital.

Hernandez's second child had a temperature of 99 degrees. Documents quote medical personnel as saying that children over the age of two are better able to regulate their body temperature since they're able to sweat, whereas babies are not.

The spa shares some guilt (morally if not legally) here. Once they heard she had children in the car they should have either insisted they be brought in or refused to treat her.

It said they didn't know she brought them along, as she didn't bring them inside. They may have thought she found childcare arrangements after all.

I'm really wondering why she was inside for so long if the procedure was done quickly.
1. She didn't bring them inside even though she was told beforehand it was ok
2. She was inside the med spa for two and half hours but her procedure only took around 15 minutes
3. She didn't go to check on them at all

I'm inclined to assume she very much wanted to risk it.

Somehow I doubt that if the spa staff knew the ages of her children (1 and 2!) that they would have replied as they did, saying fine to bring them in but they must stay in the waiting room. Children that young cannot be left unsupervised even in the waiting room of a doctor office, and it's not the staff's responsibility to babysit their client's kids.

But it IS the parent's responsibility to take care of their kids, and it should be obvious to anyone that leaving them ALONE in a car for that long is NOT taking care of them. But somehow, we keep hearing these stories.

My neighbour's son works security in a local casino. He said one of the main problems in the large parking structure is finding children left all alone in cars, while parents or grandparents are inside gambling. :mad:

Hernandez is accused of leaving her two sons in her Toyota Corolla for hours in the afternoon of June 29 while she went into a medical spa to get a lip filler injection. The temperature that afternoon rose to 101 degrees.

The trial is set to begin Sept. 8. Hernandez is being held on $1,080,000 bail.


Wow, look at that bail!! Good, maybe the rest of the negligent parenting crowd will think twice about leaving kids in the car. I swear, what could she even have been thinking?

BAKERSFIELD, Calif. (KGET) — The defense’s request to dismiss the murder charge against a woman accused of leaving her two young children in a hot car for hours, leading to the 1-year-old child’s death, was denied on Wednesday.

Maya Hernandez, 20, of Visalia is charged with first-degree murder, involuntary manslaughter and two counts of child cruelty, according to court records.

Ahead of the hearing on Wednesday, Hernandez’s defense counsel filed a motion to dismiss the first-degree murder charge in her case. Deputy Public Defender Teryl Wakeman argued the charge should be dropped due to there not being enough evidence.

Kern County Superior Court Judge Charles Brehmer denied the request, ruling that there is enough evidence for Hernandez to be held to answer on the murder charge.

Hernandez allegedly told police she left the air conditioning running in her car, but investigators learned the car shuts off after an hour if there’s no action taken.

A medical spa nurse messaged Hernandez earlier in the day and told her she could bring her children into the spa, according to documents.

However, Hernandez did not bring her children in. Neither the staff nor the patrons in the spa seemed to have known there were children in her car, according to documents and testimonies.
