GUILTY CA - Annie Hung 'Kim' Pham, 23, dies from beating outside Santa Ana nightclub

Here is a report on the row between the DA and Public Defenders in Orange
county. Notice the Dekraai case blew up just as the Pham case started. The opinion of "TRUTH for Mrs. Xu Theresa Annie Hung Kim Pham Khanh" is that the Pham case is far from over.

You can get transcripts of the hearings with the following URL and Case identification:

case number 14CF0205 FA Brito, Candace Marie / Zavala, Vanessa Tapia

DA and Public Defender had a public face-to-face confrontation last night (2/29/2016, 1930)

roundtheworld16 was present.

I think it is unfortunate and a little insensitive that the Crosby has relaunched as the North Left with a huge fanfare, the same week Kim's murder trial gets underway. It just doesn't do the owners (who are the same people) any favors, in my opinion.

I wonder if their security's improved any, or do people still risk getting kicked to death waiting in line outside their door?

Here is what I saw yesterday (2/29/2016) at 400 North Broadway: Mrs. Xu Theresa Annie Hung Kim Pham Khanh's picture and words are still visible on the traffic signal control box. The North Left has closed; a large sign in the window announces the coming of a Philippine themed restaurant. Santa Ana Police have enhanced their patrols in the alcohol dispensing part of the old town.

I don't recall the media reporting past the sidebar after Officer Navarro gave pre-trial testimony.

Do you have access to transcripts and/or doc dumps? Otherwise, they aren't freely available for us to review.

Your post is intriguiging, but I have to admit, I am confused. One cannot discuss what you are asking without having the same access to info that you do - so please enlighten us.

TIA....

I now have the Minutes and CRIS Transcript for the 11/11/14 Sentencing hearing. I notice that the Minutes and Transcript give 3 different names for the person (Pham's father) making the last Victim Impact Statement. Also, the transcript of the Victim Impact Statement doesn't quite match what I remember hearing.

Reading the OC Weekly quote Kim's father restores my faith in humanity.

Amidst this insane world in which he lost his beloved daughter, he is able to express his wisdom, his ability to forgive.

Gosh, I am struggling put it into words. :(

He reminds me of my elders, and literally epitomizes the word. In our culture, they garner our respect, for their knowledge of life, gained through life experiences. He has suffered great losses, and yet he has not allowed them to embitter his heart or soul.

I hope I can find it in my heart to reconcile what happened to Kim on that January night with the justice that has been meted out. I admit, I am not there yet. :sigh:

Kim, her entire family, and everyone who loves her, remain in my thoughts and prayers.

Documentation from the source:
Go to http://www.courts.ca.gov/ continue to first division fourth district (San Diego) enter case number D070940 The People vs. Britto et al. read the Docket. Oral Arguments are now on the calendar for Wednesday, January 11, 2017, at 1:30 p.m.

(This date is the week before the third anniversary of the event under adjudication.)

Personal Opinion:
We the people of "TRUTH for Mrs. Xu Theresa Annie Hung Kim Pham Khanh" continue to look forward to the day that, based on material/DNA evidence from the scene of the event and reports of Mrs. Khanh's behavior prior to this incident and prior to the DUI in November, 2008, CMB and VTZ will be awarded total exoneration and immediate release with no criminal record. We continue to be motivated by DJP's words on November 14, 2014.

Thank you Kimi_SFC

Interesting article that mentions Kim's case here, with quote from a former OC DA that seems to confirm the legality of sending an undercover officer into Zavala's cell.

There is evidently a row going on though, between several defence lawyers and the OC DA's office.

The "row going on ... between several defense lawyers and the OC DA" went to appeal. The three primary parties in the row are all parties to the Pham case: Judge Thomas M. Goethals, OC DA, OC SD. The opinion published by the Appeals Court can be found at

ETA: This was in reply to roundtheworld16, post 113 above. I keep forgetting to quote reply with the new layout, for some reason.

I think the forensic investigators and the medical examiner in this case are very good. I think they will have collected all evidence possible.

I don't think tox results have been released to the public, and don't think they will be until the cause of death is discussed at the trial.

Go to courts.ca.gov! The Pham case (14CF0205 F A Brito et al.) went to appeal. During the criminal trial, the forensic report was given, but OCR reporter did not include the report in her published article. She sent me the report in a private e-mail. The California Supreme Court granted a change of venue to San Diego giving the appeal Case Number D070940 Brito et al. The Oral Arguments were presented to the court on January 11, 2017, just days short of three years after the event. I, roundtheworld16, was present. No Vietnamese nor Latinos/as were present. The Oral Arguments, in very limited time, were inconclusive. Material/DNA exhibits from the scene of the crime were noticeably lacking, such as CMB's murder weapon footwear and AKP's Blue button-down cardigan. The one, potentially lethal injury to the back of AKP's head was discussed at length. Material evidence of the blunt object that caused this trauma was washed away when step-sister, KN, washed AKP's hair while AKP was on life support identified as an accident victim.

The Appeals Court has 90 days (to April 10, 2017) to publish an Opinion.

I don't know if I mentioned it before, but I really, really hope the artist who will memorialize the box will include some of Kim's words, as well as her image. That's so important, I think.

Here is the memorialized traffic signal control box 3 years after the event. Image and words are present as requested.

Criminal Court decision sustained.

"TRUTH for Mrs. Xu Theresa Annie Hung Kim Pham Khanh" continues to assert that Annie's premeditated criminal behavior being "great provocation by the victim" [footnote 6, page15] was not given adequate presentation in the trial as motivation for the violent behavior displayed by Calderon, Brito, and Zavala. The fact that Calderon was pregnant at the time of the incident was not published until after the sentencing. Brito and Zavala were acting to save an unborn child from a vicious, systematic attacker.

Opinion also notes that Prosecution and Forensics never established a clear cause of death. [Page 20] "reasonable doubt" could have been established by forensic analysis of Brito's "murder weapon" boot, but we find no indication the the actual "murder weapon" ever appeared in court.

The committee, TRUTH for Mrs. Xu Theresa Annie Hung Kim Pham Khanh," is still committed to pursuing the 5 instructions given in September, 2014.

2017.04.29, the Committee "TRUTH for Mrs. Xu Theresa Annie Hung Kim Pham Khanh paid our respects by walking in the 15th Donate Life Run/Walk in Fullerton, CA. We spoke with the OC Coroners Office about a Coroner's Inquest (line 119: Homicide, Accidental, or Suicide) We maintain 2 assertions. Mrs. Xu Theresa Annie Hung Kim Pham Khan, in case 14 CF0205FA - D070940, is the truthfully confessed, premeditated perpetrator of all the criminal activity in the incident and is the falsely convicted victim. Also, in Case G051696, Assistant Deputy District Attorney Troy Pino is a participant in the collusion to deny due process.
