Attorneys for Wilson's parents today said they will announce a civil suit against Mario Flavio Garcia on April 24, when National Crime Victims' Rights Week will be observed.

Auburn attorneys Nina Salarno Ashford and Corecia Woo had scheduled a news conference today to talk about the intended suit but, instead, announced its postponement. They confirmed that the suit would be filed on behalf of Wilson's mother, Debbie Boyd, and Wilson's stepfather, Patrick Boyd, both of Gilroy. Neither the attorneys nor the Boyds would discuss the contents of the pending suit.

Defense attorneys for Mario Garcia, the man charged with the murder of Christie Wilson, are seeking to suppress bloodstain evidence taken from the backseat of his car.

In Placer County Superior Court Wednesday afternoon, Garcia's attorneys argued the evidence was obtained without a warrant and should be inadmissable.

The family of Christie Wilson, who has been missing October, announced Monday that they have filed a wrongful death lawsuit against Mario Garcia and his wife.

Garcia is accused of killing Wilson, though her body has not been found.

The lawsuit also alleges conspiracy, because the family claims Garcia transferred the deed to his house to his wife after Wilson's disappearance.

Ah Chico - you beat me to it - posting about the lawsuit....

But the newspaper article did mention the next court date for the murder - and it is June 19th. So I'll be headed down to Sacramento that day!

Also the paper mentioned that the Civil suit case is scheduled to be heard on August 14th at 8:30am at the Placer County Superior Court. I'll "see" what I'm doing that day & see if I go to that one - just to report back to you all! :)

During an event at the Capitol focusing on crime victims and their families, a local attorney chose the backdrop to announce a civil lawsuit on behalf of Christie Wilson's family.

Nina Salarno-Ashford, who made the announcement, knows something about being a crime victim. Her sister was murdered in 1979.

She said Debbie Boyd, on behalf of her daughter, is suing Mario and Jean Garcia of Auburn for more than $25,000 in damages in the wrongful-death suit.

"We and the family want everyone to understand that this (suit) isn't about money it's about justice," said Salarno-Ashford. "Our hope is that this action will hold (the Garcias) accountable."

A Placer Superior Court judge has again denied a motion to suppress evidence for the upcoming murder trial of Mario Flavio Garcia, who is accused of killing a woman last seen at the Thunder Valley Casino near Lincoln.

Judge Larry D. Gaddis today rejected arguments by Garcia's attorneys that Placer County Sheriff's detectives conducted illegal searches on their client's car in January and February.

I wonder if they will ever find Christie's body. I feel certain this murderer will not tell where he put her. I guess that she may be found accidentally by someone walking through the woods somewhere.

Probably nanandjim! I know that chico has been going out on the searches for her... don't know if there are any more planned in the future though.

I'm planning on attending the first day of court... hopefully I'll get some good notes to pass along to the forum here!

I'm hoping she is found too. I see lots of workers out on the sides of the road picking up garbage and hope they find her. I also have noticed birds swarming certain areas and wonder if she is there. Likely by this time she is only bones.

I wonder what time Garcia got home from the casino....if his wife would tell the truth. They know what time him and Christy left the casino and maybe if we knew what time he got home we could get an idea of how far he could have driven to get rid of Christy's body.

Has anyone heard about when the court case is? I am praying he figures out he isn't going to win and tells where her remains are, so that her family can put her to rest.

Trial Delayed for Garcia
The trial has been delayed for an Auburn man accused of murdering a woman after an evening of gambling. Both prosecutors and defense attorneys for Mario Garcia agreed they need more time to prepare for the trial.

The trial, which was set to begin on April 24, will now start a month-and-a-half later with jury selection now scheduled to start on June 12 in Sacramento. 03/27/06 News 10

~snip~

However, both the defense and prosecution have agreed to postpone the trial until September. The trial has been moved to Sacramento County because of extensive publicity in Placer County.

Now the trial is postponed until September.....more time for Christie to be found though.

Geez, chicoliving - you beat me to it again!! LOL!

I'll just add a few lines from my news paper:

Jury selection is expected the week of Sept. 11 in the Sacramento County courtroom. Expect opening statements to begin Sept. 18th!

So I shall move my reminder to the 9/18!

Mario Flavio Garcia, awaiting trial on a charge of murdering a woman whose body has not been found, was placed on suicide watch in the Placer County jail during a six-day period last month, a sheriff's official said.

Undersheriff Steve D'Arcy said jail officers conducted a random search of Garcia's cell on April 13 and found 60 pills of medication.

"The pills are issued to him as part of his daily medication for a heart condition," D'Arcy said. "We don't know why he wasn't taking them and why he decided to hoard them."

Hmmm I'm not sure if he was hoarding them for a one time finale or to cause health problems for trial delays or a chance for tests outside the jail....maybe he's getting worried Christie will be found. I hope his nights are filled with nightmares and visions of hell.

Good grief they changed the trial date twice. If he is hoarding pills he must be getting kind of worried. Bet he won't get the chance to hoard again. A nurse will stand right there to make sure he takes his meds and swallows them. Stupid fool. Why doesn't he tell what he did with her. I hope her body is found between now and Sept.

``We have opened a recovery fund for Christie,'' said her mother, Debbie Boyd, who now lives in Gilroy. ``We know she has passed on, but it is a living nightmare as a mother knowing your child is lying in a ditch or a field somewhere. We need to find her and bring her home.''

A separate suit filed by Wilson's family against Garcia and his wife, Jean, alleges fraud in the transfer of the deed for the couple's $850,000 Auburn home to Jean Garcia in January to avoid any potential liens or civil judgments against the property.

``We don't believe the Garcias should benefit at all from the proceeds of that house,'' said Boyd's attorney Nina Salarno Ashford of Auburn. ``All those dollars should be used for the recovery of Christie Wilson's body.''

The suits were filed in Placer County. Garcia's attorneys did not return phone calls for comment.

``This is not about money,'' said Boyd's other attorney, Sandra Amara of Auburn. ``This is about justice for Christie Wilson.''

Wilson was born in San Jose and graduated from Gunderson High School in 1996. She had been living in Sacramento but was set to accept a job offer in Silicon Valley and move back to San Jose.

Her stepfather, Patrick Boyd, is a sergeant with the San Jose Police Department.

``To be a seasoned detective but relegated to sitting on the sidelines and not be able to do what you do best for your family is sheer torture for my husband,'' Debbie Boyd said.

I would imagine that it is hard to be a detective and not be the lead detective in his stepdaughter's case. That isn't to say that he couldn't use some of his skills in looking for Christy. I hope her body is found so her parents can have a proper buriel for her. It must be so hard knowing that your daughter is laying out there somewhere alone and you can't do anything about it. My heart goes out to her parents.
