The parents of Christie Wilson came face-to-face with the man now charged with her murder Monday.

Wilson's parents sat just feet from Mario Garcia, as he faced a judge on weapons charges. Those charges were dropped and the murder charges took center stage.

Mario Garcia will be back in court tommorow to face the murder charges.

Auburn resident Mario Flavio Garcia is scheduled to be arraigned today on a charge that he murdered Christie Wilson, who has been missing since Oct. 5.

On Monday, the Placer County District Attorney's Office dismissed the weapons charges against Garcia in a procedural move so that he can be arraigned today on the murder charge.

Why would she borrow money from a stranger? Are we talking a small amount of cash, like gas money, or did she lose a lot of money? I would have to be pretty desparate to borrow money from some creepy guy I didn't know.

So, the hair was in the trunk like we thought. I bet there's more evidense in the trunk.

The complaint against Garcia accuses him of murdering Wilson on October 5, the day she went missing. It also accuses him of having a billy club in his possession. The documents make note of his 1981 felony conviction for assault with a deadly weapon, which it says counts as a strike against him.

Mario Flavio Garcia of Auburn entered a plea of not guilty Tuesday to a charge that he murdered 27-year-old Christie Wilson, who has been missing since Oct. 5.
Garcia's plea was made during an arraignment procedure in Placer Superior Court during which he also was charged with possession of a deadly weapon - a billy club.

Deputy District Attorney Garen Horst said after Monday's hearing that the Garcia case is believed to be the first in Placer County in which a person will be tried for murder without a body being found.

"We will use circumstantial evidence," Horst said. "Sometimes, circumstantial evidence is even more persuasive than direct evidence."

Garcia's attorneys, Ron Peters and David Dratman, declined to say what evidence has been presented to them thus far by the prosecution.

But Peters said they asked for a preliminary hearing and a trial date "to reach some sort of resolution as quickly as possible."

Judge J. Richard Couzens chose Nov. 14 for assigning Garcia a possible trial date and Nov. 15 or 16 for a preliminary hearing, during which a judge will determine whether there is enough evidence for Garcia to stand trial.

In addition to the murder and deadly-weapons charges, the Placer County District Attorney's Office is alleging a prior felony strike for a 1981 conviction of Garcia in Alameda County.

How did the police find out about this? Was there an eyewitness who saw this happen?

That's a lot of money to ask for or to receive from a stranger. I wonder how it all transpired and if Garcia was acting like he was made of money.

I think the borrowing of the money may have occured at one of the tables since this info was released just after all three witnesses (table game participants) were located and interviewed. Or.....there could be an image from the casino surveillance showing an exchange of money between the two....but to say "borrowed" leans me towards it occuring at the table and was overheard/seen by the other players.

here's an update in my local paper The Auburn Journal from Friday 11/3:

For nearly a month law enforcement and volunteers have searched hundreds of miles of grasslands, lakes, rivers, culverts and mountainous terrain to no avail. WIlson's body has not been found.
Many questions about Garcia's background & what he knows about Wilson's disappearance remain unanswered.
"He continues to be uncooperative," said Lt George Malim, spokesman for the Placer Cnty Sheriff's Dept.
Officials have confirmed that Garcia has been suspected of kidnapping and rape, but those charges were dropped. Garcia's Auburn neighbor, Lynn XXXXXX, has said it was her understanding that the 1979 dispute involved a former girlfriend.
Documents show that Garcia has gone by the names of Mario Flabio Garcia, Mario Johnson & Mario Flavio Garcia-Johnson.
Garcia married Jean in March 1984 and they have two teenage sons. Although not much is known about his previous relationships, one woman claims to be his biological daughter.
Aileen M.xxxx wrote in an email sent to the journal's sister paper, that Garcia is her father. She wrote in part, "I (have) just see(n) him a couple of times, but he was always violent..."
"He didn't get along with his family either."
...wife has reportedly not spoken to law enfocement officials about her husband's involement with Wilson. Ron Peters is also representing her. Why she has retained an attorney in unknown.
Each time Garcia has appeared in court, he has kept his gaze down, only glancing up to answer questions posed by the court. He appears sullen. Roach said he has seen a different side. "He seemed to be an angry person; Nothing ever seems to be happy."

Okay - I see in the above from chico - that the prelim is either 11/15 or the 16th - I guess I'll have to wait for 11/14 and 'see' what the judge decides. I'll let my boss know that I'll be taking off either one of those days and 'see' if I can get in & take some notes for you all!! Wish I had a laptop...

Placer County sheriff's detectives investigating the Oct. 5 disappearance of Christie Wilson believe she put up a valiant fight against an attacker, scratching and clawing his arms and chest and blackening his left eye before she was murdered, according to documents made public Friday.

Detectives stated their belief in a request for a search warrant seeking medical records for her alleged attacker, Mario Flavio Garcia, 53, of Auburn, who has been charged with her murder although her body has not been found.

The documents, which were placed in Garcia's court file Friday, indicate that Garcia went to the UC Davis Medical Group clinic at 3200 Bell Road in Auburn on Oct. 6 to seek attention for scratches on his arms and chest and for a black eye.

Here's part of an article that was in my local paper called "Perspective" written by Jim Ruffalo (Looking Behind the Scenes):

...We keep hearing that a hair belonging to Wilson was found in Garcia's Toyota, and then we're told it was found elsewhere. Tell me, Mr. Wizard, was it discovered in the car or elsewhere? The correct answer is "yes," because this particular evidence is actually two hairs - one found in the handle of the front seat passenger door, and a second in the car's trunk.
The one in the door handle still had its follicle, suggesting that the hair was yanked out rather than fell out naturally. By the way, both hairs have been DNA tested, and both belong to Wilson.
Not sure if any of this will come up at Garcia's bail hearing tomorrow afternoon in the jail court, (this article was written Sun, 11/6, so this is for Monday 11/7 hearing) but it surely will be discussed at the Nov. 14th preliminary hearing. The court dates are coming fast and furious because Garcia declined to waive his right to a speedy trial, no doubt hoping the prosecution won't have all it's T's crossed in time.

so... I don't know about the rest of you, but I hadn't heard about TWO hairs being found!

Also, I see that this guy says the prelim is going to be Monday 11/14 - so I'll have to find out at WHAT TIME this starts - if 9am, I can still go to work in the afternoon - but if in afternoon - say 1:30pm, I believe they usually start, I can go to work in the morning and leave for court then... If anyone hears about WHEN it should start, before I do - please post!! it would be appreciated! Now the other item WHICH court house - in Old Town Auburn, or the DeWitt Center court house - if anyone hears - again please post!!
