GUILTY CA - Classic (Orson West, 3) & Cincere (Orrin West, 4), still missing, Calif. City, *Mistrial on counts 4 & 5)* 21 Dec 2020 #8

Does anyone know if these guilty verdicts will have any impact, be considered or factor into a potential retrial for Orson’s murder?
I don’t see that happening, JMO. Hopefully it influences his decision in sentencing. I’m not sure what additional evidence could be presented in a retrial?

Thank you, good point! Imo I hope they get put away for a long long time! Each of those innocent little boys’ lives was precious! They both deserve justice!

I agree. The judge saw the evidence. He knows who killed those children. I am guessing, LWOP.

In addition to the boys and their bio family and adoptive sibs, I feel horrible for Trazell's father. His testimony really got to me.

If the boys are ever found, then additional evidence will be available. Without them both or at least without Orson if they are not together, however, I don't see what any jury could have done differently. There really wasn't a lot of evidence - without the brother's information, it was mostly about a difficult gate and no one having seen the boys. I think the jury did the best they could with what they were given. JMO.

So they were found guilty of one child's murder and a hung jury on the other? TIA

Criminal Defense Attorney Mark Raimondo said it is now up to District Attorney Cynthia Zimmer if she wants to pursue a retrial.

“I think the District Attorney’s going to take in great consideration the family’s feelings in addition to what is the cost benefit analysis of that is. I mean they’re going to get mandatory life sentences already,” he said. “Personally I’d be surprised if they do go forward given the multiple life sentences each of the defendants face.”

Raimondo said that as the family processes the verdict, a retrial could force them to relive the emotions of the trial all over again.

“A trial is very trying on the families as well and emotionally draining on the families as well so they may all want some closure. I wouldn’t be surprised if the family does seek some closure once the sentence is imposed,” Raimondo said.

Another option could be the Wests negotiating their sentences by confessing where Orrin and Orson are, if they know where the boys are. Raimondo said a confession seems unlikely at this point.

In a case like this... I tend to use the birth name. Classic, Cincere. For example, in another thread I use Sarasvati (Sherin Mathews), her name from the orphanage, rather than the name from her murderer/s.

It's harder when the abuser/murderer is the biofamily and there is no other name. Then, I just hope that they liked their name, and that at least once or twice, someone spoke that name to them kindly, with love.

If only these poor mites had a chance to grow up and choose their name. You either identify with a name or you don't. As someone who's endured abuse, sometimes the most empowering thing you can do is choose a name for yourself, whether that's the one you already had, or one that's brand new.

MOO

Everybody fell in love with these two little brothers straight away. I agree and my preference is they are known as Classic and Cincere. Elegant names for sweet little boys.

I'll choose to remember the cute photos of them smiling rather than what T&J did to them.

Names are important. When Gannon's father spoke his powerful victim's statement recently, he requested that Leticia could no longer carry the name Stauch.

Following Orrin and Orson's case from the beginning, I am frustrated jury was unable to reach an agreement on a guilty verdict for Orson's murder (charges 4 and 5). I figured if a reasonable person could conclude that Orrin was murdered, then that same person would conclude Orson was also murdered. I just hope Judge dishes out the harshest sentence the law allows on the other charges.... life in prison
MOO

Excellent statement. One child is no more nor any less important than the other. Since T&J's press conference in the street outside their home, we knew things weren't right.

The boys were together and then they weren't seen again. Juries get hung up on not having the body of the victims. IGI. They'll oft give the defendant the benefit of the doubt rather than see an innocent man incarcerated.

I couldn't watch the trial but I am so glad everyone here stood in the gap for them.

The lawsuits for both bio parents against Kern County Human Services accuse the county of wrongfully taking Orrin and Orson away from their biological parents, not allowing the family a chance to get them back, for taking the boys away from their first foster mother and for giving them to Trezell and Jacqueline.

Eyewitness News asked attorneys from both parents what evidence from the criminal trial they will use in their cases.

"Certainly the police investigative interviews of Jacqueline and Trezell West we will use" Waukeen McCoy, plaintiff's attorney at McCoy Law Firm said. "I know there were some facts that pertain to the boys being mistreated in their care."

[...]

Castillo, who represents Charles Pettus, the bio father of Orson, said the testimony of the Wests' four other sons is key. He said their testimony shows there was a breakdown in the process and oversight procedures of child protective services during the fostering and adoption process. Castillo said the county is supposed to have wellness check-in visits.

[...]

Castillo said there's a hearing on June 1st, where a juvenile court will decide if Kern County Human Services needs to give the files of the removal and adoption process of Orrin and Orson to him and his legal team.

I am interested in how the boys ended up in placement with the Wests, and the oversight. Let's have a FOIA and see EVERYTHING!

I actually think what will happen is a quick settlement and bury everything.

MOO, is that Kern County wants to keep the adoption completely under cover. The lack of transparency is disturbing to me. As it should be to anyone.

If there is nothing wrong, then lay it all out. Make it public. Stating it is "protecting children" is a sick joke, because the kids in question are dead.

I am still interested in how the Wests were chosen as adoptive parents so fast for the boys, it seems like the adoption was fast tracked, without even a cursory assessment.
