I cannot believe the defense tried to get Dr. Murray's revised story entered into evidence via hearsay through his expert witnesses. I believe this would mean the experts can only testify as to the evidence before the court or Dr. Murray will have to testify. I am even hoping Dr. Murray testifies just to see the cross. I also cannot imagine one's memory becoming clearer almost two years after an event. jmo

So far I have agreed with all of Judge Pastor's rulings. The State had a great day IMO :)

— Ruled out the use of statements made by Murray to his forensic experts in which he appeared to change some of the details previously given to police about Jackson’s treatment.

The judge said experts cannot act as “parrots” to get hearsay statements of the defendant before the jury.

The prosecution suggested if Murray wants to tell his story, he should do it from the witness stand.

I thought this was interesting. Wouldn't you think this would apply to MJ's home? I know it is obviously very unusual that anesthesia would be administered in a home setting but the laws seem like they still would cover this as "out-patient" or am I totally off-base here?

California Outpatient Surgery Organizations

In addition to the AAAHC standards found in the Handbook, outpatient surgery organizations in California must also be in compliance with the following laws:
AB 595 (Speier) effective July 1, 1996

This law states: "no physician and surgeon shall perform procedures in an outpatient setting using anesthesia, except local anesthesia or peripheral nerve blocks, or both, complying with the community standard of practice, in doses that, when administered, have the probability of placing a patient at risk for loss of the patient's life-preserving protective reflexes, unless the setting is specified in Section 1248.1 of the Health and Safety Codes. Outpatient settings where anxiolytics and analgesics are administered are excluded when administered, in compliance with the community standard of practice, in doses that do not have the probability of placing the patient at risk for loss of the patient's life-preserving protective reflexes."

Added in 2000:
A minimum of two staff persons must be on the premises, one of whom shall be a licensed physician and surgeon and/or a licensed health care professional with current certification in advanced cardiac life support (ACLS), as long as a patient is present who has not been discharged from supervised care.

Trial won't feature unreleased Jackson footage

By ANTHONY McCARTNEY - AP Entertainment Writer | AP – 26 mins ago

"There is absolutely nothing in those materials that could have been of assistance to the defense," Pastor said.

:woohoo: Judge Pastor

Huge blow to DT.
But I have never understood why they are trying to prove Michael was in such poor health since it makes defendant look even worse for pumping Michael full of a deadly cocktail.

Attorneys for Michael Jackson's doctor face court deadline

Lawyers defending Michael Jackson's last doctor in his involuntary manslaughter case face a Tuesday deadline to satisfy a judge's order ahead of the trial's start.

The lawyers for Dr. Conrad Murray have been ordered to hand over to prosecutors all of the statements and reports gathered from potential defense witnesses.

California court rules require both sides to meet certain discovery requirements 30 days before a trial starts, which is Tuesday in the case of Murray, who is charged in Jackson's 2009 death.

"We've been down this road before, and I hope we don't have to go down it again," Los Angeles County Superior Court Judge Michael Pastor said during a hearing Monday after prosecutors complained that the defense was holding back.

Perhaps to suggest MJ died of natural causes from poor health and not from any drugs. Or, if MJ gave himself drugs, the drugs and poor health caused his death. Lungs or heart most likely would be the suggestion. But I really don't know.

I do believe there will be a lot of reasonable doubt produced at the trial by the defense team. I think Dr Murray will be found not guilty.
