Proximate causation is a slippery slope and can be manipulated to serve many needs, for hyperbolic example:

If Jon hadn't enlisted
If the Marines hadn't transferred him to 29 Palms
If the housing staff hadn't put them next door to CL
If EC's car hadn't worked
If EC's and JC's parents hadn't moved to Oak Ridge
If Japan hadn't bombed Pearl Harbor
If CL's parents had just played pinochle instead the night he was conceived
If NL's grandparents had argued the night her mother was conceived

I've just managed to use proximate causation to blame JC, the Marine Corps, a housing clerk, EC's mechanic, EC and JC's parents, Emperor Hirohito, CL's parents and NL's grandparents.

It goes to motive, sure, but nothing Erin did caused her death, proximately or otherwise. CL caused her death. Plain and simple.

That's very funny. It's a fairly well reasoned argument as well. Not quite there yet though.

California law is very clear about the murder of an unborn child, San Bernardino County District Attorney Michael Ramos told The Desert Sun on Wednesday.

In addition to a murder charge for the death of the mother, a murder charge can be filed for an unborn child of just four to six weeks development.

Whether Erin Corwin, whose body was found 140 feet down a mine shaft Saturday in the Rose of Peru Mining District east of Joshua Tree National Park, was pregnant and how pregnant is an ongoing "part of the investigation," Ramos said. The additional charge "is a possibility."

Why wouldn't it be a certainty, if they find she is pregnant? Or is that not what they are saying? I would think it would not be debatable; if she was, then yes, if not, then no. Not sure they can charge if no physical proof of pregnancy. Jmo

The math is not wrong. You are 4 weeks when you find out you are pregnant. So, if she found out (positive test) on 6/15/14 and told JC on that same day (Father's Day), that would make her an additional 13 days pregnant at time of death. So, 5 weeks and 6 days pregnant, at minimum.

If she did...to appear cooperative? Or did she say the last she saw of it, it was here, for example.
I just do not see how her telling LE about the gun and where it is points to her involvement.For me it points to nothing or her not knowing the significance of it.If she said she knew nothing about guns in the house then LE found it would that point to her guilt or innocents.

I've been having that same problem. Even when I refresh and the thanks button is there and I click on it, it disappears and no thanks shows up from me for the post.

We don't actually know if that was the motive. Only Erin and CL know what led up to that outing and why it went down the way it did. We just don't know.

True, however, it doesn't stop us from trying to figure it out just like we tried to figure out if she was dead or alive or where she could be. It's all part of the process.

A normal pregnancy is 40weeks. Doctor told me 38-42 is considered full term.

Why would CL have been afraid that NL would take his child away if she found out about an affair (with/without a resulting pregnancy)? Having an affair is not a reason for a court to refuse a parent liberal visitation rights with children after a divorce.

I have a feeling that, if it is true that NL found out about the affair earlier in the year, NL told her husband if he ever dared cheat on her again that she would divorce him, take his child away from him, and he would never see either of them again. While a woman doesn't have the power to actually do all of that, under normal circumstances, the threat to do it is no less real and women can make it extremely difficult for a man to have any sort of relationship with his child if she is hell bent on doing it. Most twenty-something year old men don't have a clue about their rights as a father in regards to divorce and custody.

I don't either and I doubt that would be why LE is looking at her as a possible accomplice after the fact, or a co-conspirator, jmo.

No, in the State of California he would still be obligated to pay child support for his child once paternity was established, regardless of whether or not he wanted to be a part of the child's life. The hiccup is that, in the State of California, CL could not be established as the father as long as EC was married to someone else. "By law, a man is presumed to be the legal father when he is married to the mother at the time the child is conceived" so, as long as EC remained in California, CL would NOT have been responsible to pay child support, health insurance, military benefit, etc. on their child, once born, unless Erin divorced JC and then established paternity or without a declaration from the court.

Question: Why is it important to establish paternity?
Answer: If you don't establish paternity, your child will not be able to get child support or health insurance. Establishing paternity as soon as possible makes collecting child support easier in the future. Also, establishing paternity grants the child rights to certain social entitlements, such as social security and pension, and /or veterans benefits, inheritance protection, and access to family medical records. It is also necessary to establish paternity before custody/visitation can be established.

Question: I am separated from my husband, but not divorced yet. Can my boyfriend, who is the baby’s biological father, sign the Declaration of Paternity?
Answer: No. The law presumes that as long as you are legally married, the husband is the father of the baby. Only the court can establish paternity with someone other than your legal husband. Only unmarried women can sign the Declaration of Paternity.

Question: Can a father that is married sign a Declaration of Paternity for a child he fathered outside of the marriage?
Answer: Yes. The father, although married to someone else, can sign the Declaration of Paternity to have his name entered on the child’s birth certificate as the legal father. However, the mother must not be married because only unmarried women can sign the Declaration of Paternity.

When the PC and SW came out, it said they found spent .40 caliber shell casings in the Jeep. But they didn't find a .40 caliber gun in the search. They found a .22 caliber in the closet of the house of IM during the search there. When they discovered Erin's body, they said along with it they found some .22 caliber shell casings. So where is the .40 caliber gun and why does the arrest warrant say now they were .22 caliber shell casings they found in the Jeep during the search???

The Underground Explorers website is where I have researched a lot of the mines in the area in which Erin was located as their photos and documentation of mines in that area (and pretty much ALL around) are incredible. They just stated on their FB page that a news station (KFMB News) used one of their photos without permission or credit and published it along with a story about where Erin was found (the news station has since edited their story to include credit to them for the photo.) They also state that the photo they are using IS NOT of the mine in which Erin was found. I believe them (they know their stuff!)

It's scheduled to arrive 40 weeks from the last time Auntie Flo came to visit, or 38 weeks from when mummy and daddy loved each other very much.

I have been having the same problem. It drives me crazy! The only way to actually thank someone, after the triangle comes up is to refresh the page. But that gets old real fast.
