Either that or the conversation wasn't reported correctly in the first place. I don't have a lot of confidence in the source, if you know what I mean.

With all due respect carbuff, I think she knew EXACTLY what was going on and I hope they nail her for any part she may have played. I'm not meaning to take it out on you I just have such mixed emotions right now with the top emotion being PISSED! I'm so sorry for this family and for the loss of such a young, naive girl who was, in my opinion, bulled over by older, more experienced adults.

I'm wondering how difficult it may be to determine much about the pregnancy given the time that has elapsed since her death? Especially with not being far along.

I am wondering if she had secretly gone to a doctor to verify the pregnancy.... So there would be doctor files...

However... Conflicts would arise from getting such information due to doctor/patient confidentiality...

and people suspecting pregnancy may rely on home pregnancy tests...

sorry if this has already been addressed...

Yes, that's what happened with Laci and Conner Peterson :rose: :rose:

He meets multiple criteria from this article!

"The law applies only to certain offenses over which the United States government has jurisdiction, including certain crimes committed on Federal properties, against certain Federal officials and employees, and by members of the military."

I think that CL just might take the full blame for it, if for no other reason then their daughter. I'd bet IM was supposed to be NL's alibi.

Mel.

That's if he has any conscience at all >.<

I'm wondering if Jon can get a "hardship" discharge from the Marines, with all this going on. How can he ever give 100% after all this, especially since this all came to his doorstep because of his assignment to 29 Palms.

I see your point...

but... Perhaps on the other hand... Serving the country may give him the purpose in life he needs to live a somewhat fulfilling life at this time in his challenges...

Just a thought...

It needs to be considered a "special circumstance". I don't think it will qualify.

2. Types of special circumstances murder /
capital murder

2.1. Murder carried out for financial gain

2.2. Prior murder conviction

2.3. Multiple murder convictions

2.4. Murder by bomb or destructive device

2.5. Preventing arrest or escaping

2.6. Murder of a police officer, federal agent, or firefighter

2.7. Murder of a witness

2.8. Murder of a prosecutor, judge, government official,
or juror

2.9. Lying in wait

2.10. Murder because of race, religion, or nationality

2.11. Murder in commission of a felony

2.12. Murder involving torture

2.13. Murder by poison

2.14. Drive-by shootings

2.15. Murder by a street gang member

Multiple murder victims... Erin and Baby...(and... What if there were twins?)

Just wondering...

I had my last baby in 1985 and I am just amazed at the First Response pregnancy tests that show a pregnancy six days sooner than a missed period! Are these pregnancy tests accurate?

I think they can determine pregnancy by certain enzymes in remains?

I totally agree with everything you said. I just don't exonerate the third party yet.

Was for my youngest. Didn't take one for my first until later.

I am certain forensic analysis will be able to determine the stage of pregnancy, based on this:

Forensic pregnancy diagnostics with placental mRNA markers
http://www.ncbi.nlm.nih.gov/pmc/articles/PMC2795858/

I also believe specific serum (blood) hormone levels fluctuate, especially in the 1st trimester.

I may be wrong, But I always thought the baby had to be far enough along to be counted as another murder death. Like a baby that was 3 weeks or 5 wks along, might not be considered viable. But little Connor Peterson was 8 months already.

I thought the same, but I think it was revised to include any fetus during any stage of pregnancy

"The Unborn Victims of Violence Act of 2004 (Public Law 108-212) is a United States law which recognizes a child in utero as a legal victim, if he or she is injured or killed during the commission of any of over 60 listed federal crimes of violence. The law defines "child in utero" as "a member of the species 🤬🤬🤬🤬 sapiens, at any stage of development, who is carried in the womb".[1]"

That is what I thought. I thought a fetus had to be viable in order for it to be counted as a murder of a person.

So, am I understanding this correctly? If he is tried in a state court and (miraculously) found not guilty, he could be re-tried in a military court? But, if he is tried in a federal court, he cannot be re-tried in a military court?

Yes. I think it would be in a federal court if tried in civilian court though since it was federal land.

Thanks to everyone for transcribing info from the presser. I didn't think they would ever find her, especially this quick. Does anyone have any idea when more details will come out, or will he have to wait for trial? Also thanks for all the great photo links.
I think Erin was just young and naïve and made a mistake. I feel so badly for her family and friends. I hope this is the beginning of some closure for them.

That would apply if he's charged with a federal crime.

State laws differ widely. I don't know what California statutes say.

That's what I was thinking....even though it's been handled so far by San Bernardino County. Another thing, he was on active duty at the time of the murder. That throws another kink into everything, doesn't it?
