It needs to be considered a "special circumstance". I don't think it will qualify.

2. Types of special circumstances murder /
capital murder

2.1. Murder carried out for financial gain

2.2. Prior murder conviction

2.3. Multiple murder convictions

2.4. Murder by bomb or destructive device

2.5. Preventing arrest or escaping

2.6. Murder of a police officer, federal agent, or firefighter

2.7. Murder of a witness

2.8. Murder of a prosecutor, judge, government official,
or juror

2.9. Lying in wait

2.10. Murder because of race, religion, or nationality

2.11. Murder in commission of a felony

2.12. Murder involving torture

2.13. Murder by poison

2.14. Drive-by shootings

2.15. Murder by a street gang member

It might be considered for financial gain, if they can establish part of his motive was to avoid paying child support.

Erin told her friend in TN she was going to "celebrate" her pregnancy with CL. That indicates, to me, she believed he would be happy about it. Why would she believe that?

I have no idea.Desperation? Stuck in a bad marriage? Married too young? Thank goodness her friend in TN told LE what she knew.

Not trying to hi-jack the thread but I go on Friday to see what's going on with my mammo test results. The doc's office called me to come in ASAP to "discuss results in person". Has me a little nervous. Mrs. Gladden, I actually was going to PM you this week if it's ok?
La2cabo: I will keep you in my prayers!

I really hope that young women think twice before getting involved with a married man. Erin and Heather E. Lost their lives because of extra-marital affairs. So very sad. Emotions run wild .

I should hope we're not going to blame the victim here. Erin was 19. I would rather not be judged about anything I did when I was 19! She had moved away from her all people to a desolate place and suffered a miscarriage. I'm going to go ahead and cut her a little slack. Particularly knowing she was found at the bottom of a 140 foot mine shaft after going on what she believed was a celebratory hunting trip with someone she obviously thought cared about her.

He had to have lied to her or she wouldn't have thought they would be celebrating her pregnancy where he really ended up killing her, he had to have led her to believe that he wanted the baby and wanted a life with her or she wouldn't have been so happy about it and gone with him to celebrate the pregnancy. He had to have given her a false sense of security with him or she wouldn't have gone with him to a remote place alone with him. She obvious felt she was safe with him or she wouldn't have gone anywhere with him. He sold her a line of bull a mile long. Why else would she think he'd be thrilled he got her pregnant when he's married to someone else he wanted to stay with??? Yet she text her friend that he was taking her out hunting and to have a "special day" together to "celebrate her pregnancy."

While I understand he probably duped her and led her into thinking that, how about her husband? Was he not lied to and treated with disrespect? The door swings both ways when someone is unfaithful. With that being said, I am sorry this all came down to this and her murderer deserves much punishment. But, I hope people think again before being unfaithful.

Just using your post as a jumping off point Sulamith, not calling out your POV.

IMO, Erin's child was "viable" at conception.

Considering the child was (IMO) the motive for Erin's murder, I would be very surprised if Ramos does not include a count of murder.

I always thought that viable meant that the fetus would have been mature enough to survive outside of the womb. What the bleep do I know?

I'm thinking Lee sold her a bill of goods, made her think they were going to have a life together and raise their baby together. Why else would she think he'd be happy about the pregnancy that they'd go for a "special day together" and "celebrate her pregnancy?" Because if he had made it clear that he was going to stay with his wife and child with his wife, she would have realized he had nothing to celebrate.

Maybe, or there could have been a premeditation element which involved his wife helping to formulate a plan on how to get rid of the problem. Just saying this could be a possibility.

I think Erin wanted to clarify the relationship with CL before her parents arrived, so she could tell them she was leaving JC...I think that is why she had not yet told them about being pregnant.

I read that Erin and Jon's Fathers already knew about the pregnancy. They were waiting to tell her Mom in person when she arrived for her visit.

Not blaming Erin at all. Her death is tragic just like Heather. I was just commenting on two very young women killed involving married men. You never
Know how people will react when bruised emotions are involved.

Erin and Heather did not deserve to be murdered at all.

I'm not so sure Erin knew CL was moving back to Alaska. The timing of her murder is interesting. Maybe CL chose to get rid of Erin before she could find out he was moving back to AK, afraid that if he didn't, the ***** would hit the fan. She may have thought he was going to live at the horse ranch, and NL would go back to Alaska, leaving the door open for them to be together.

I admit, I am anxious to know if she was pregnant.
The whole situation was so confusing, i.e who could know when, etc
She apparently told CL, but not her mom? I don't think she would have held back if she knew for sure she was pregnant by JC. She wanted to clarify her position with CL. Very naive and also very sad that she believed he wanted a baby with her. I still wonder if she told JC or he found out on his own.

If you are asking me, YES, another clean report! Won't have to go through that again for another 6 months. I have now been cancer free for 2 1/2 years. They tell me the 5 year mark is what I'm working toward. Half way there!

Good News!!!!!

Didn't she find out she was pregnant when she went to the hospital for headaches? I may have details confused.

Erin and Heather E lost their lives because of people who thought that murder was an acceptable way to handle problems.

Well, I feel really bad for Erin's husband. I have to wonder if CL told his wife about his affair...or did Erin contact his wife and tell her about her pregnancy? Like..he is leaving you for me and I am having his baby? Which would, IMO, cause a real s*it storm. CL could have denied fathering Erin's baby and go through the paternity testing after the baby was born. It would have given him some time. How many guys admit they are having an affair and got their lover pregnant? Sincere question.

I am not saying anything bad about Erin or Heather., only that they were involved in situations where emotions are crazy. When emotions run crazy, horrible things can happen. Two young women murdered because of out of control emotions.

I don't know if her going to hospital for a headache was confirmed?
