GUILTY CA - Gavin Smith, 57, Oak Park, 1 May 2012

 • #201
This is a total stretch and I am throwing it out there---don't believe it is likely but it would validate potential sightings of Gavin.

Johnny Creech is into the drug dealing scene. He also has a number of businesses which are questionable. What if either he knew people in the fake ID business or he himself was in the fake ID business? Gavin decided to run away and JC hooked him up with a fake ID. Then G leaves town with the car. He is seen getting tacos with his girlfriend on the way to wherever (Canada?)

LE knows there is contact between Creech and Smith and Creech is already on their radar for the drug stuff. They assume that this is a cut and dried drug deal/money deal gone bad and take the car to search for evidence.

It seems like Gavin wouldn't have left his children, so that is why I think it is unlikely. In this theory's favor is the fact that he and his wife were on the outs and he was having financial difficulties. Maybe he felt a disconnect with his family and went through a midlife crisis?

Good creative thinking. :)

I think there's only been one potential sighting of Gavin, though, and LE appears to have debunked it.

True that in the drug dealing/trafficking biz, Creech could also be involved with fake IDs. Given that he's about to enter prison again on his most recent conviction, I'd think if Creech had given Gavin a fake ID, he'd have rolled fast and given that info to LE right away, especially when they're searching his home with dogs and CSI for five hours, as some reported. Seems he'd turn over the ID info so they could track Gavin and determine he's alive ASAP.

IMO, it's never looked like a voluntary disappearance, given his clothing when last seen, no personal items missing, time of disappearance, love for his family and job, level of professional success, no apparent financial trail, and the fact that his family and friends were already aware of his transgressions.

Drugs are being trafficked everywhere daily, no reason to connect Creech to that one restaurant. We just had an entire restaurant of 20 years shut down and 11 arrested for dealing heroin out the backdoor.

We have to assume there was no credibility in the man from Michigan traveling on business and the Taco Palace waitress since LE dismissed it after looking into it.

Two motives in my mind: Creech for jealousy of Gavin with his wife and CW for jealousy of whomever he was staying with the night he went missing, possibly combined with money owed. Of the two, my bet is on the female owner of the house.

I think he was close to his 3 sons when they were younger, but in the last few years it seems the SMITH parents have been drifting apart. From the tweets of the eldest son, he seems to have followed his mother's religious turn ... since that is what distanced him from his wife, Gavin may have also felt that some alienation from his children. His eldest son's tweet of 2012/04/14 certainly showed that he sided with his mother. So maybe Gavin felt more & more estranged from his family ... we KNOW that he moved out of the family home around the tweet time.

In MY understanding of the timeline, the family set up the "help find" website to conduct local searches & they had one planned for a mid May weekend ... WHEN the Taco Temple sighting became publicly known (which I believe is on video), that was when the weekend search was called off.

Since that time the family has not updated their website & NO formal searches have been organized. It has just been recommended that people conduct private searches on their own. I tend to think this is significant. This was also the time when the family stopped doing interviews. As I mentioned before, I think there is more going on in this story then LE has shared with the public.

Last week I had postulated that drugs might have been involved & that JC had a long rap sheet which was why LE took took precautions when searching his family's home, so thanks S&F for finding some facts on that!

Gavin is on the crimestoppers missing list at ... http://lacrimestoppers.com/missing.aspx

This next site would seem to indicate that John Lenzie CREECH
has previously had residences in Indiana & Ohio ...
http://publicrecords.onlinesearches.com/CA_LosAngeles.htm

I don't know how to do links so am just posting the web addresses. For the past week I kept going to the older webpage here thinking it would show me the latest entries & I was wondering why no body was posting any more ... so I am still getting accustomed to this website.

This is the explanation given for the search cancellation from a previously linked article :

Without a specific area to comb for missing*20th Century Fox executive Gavin Smith, volunteers have called off a search they had hoped to conduct this weekend.

"After consultations between the L.A. County Sheriff's Department and the Gavin Smith family, it has been decided that there will be NO search this weekend," family spokesman Howard Bragman said in a statement to the media. "There is not a specific area of defined interest to make this effort productive at this time."

Per this article:

Daniel J. Teola, an attorney who represents the family, said John Creech was not home at the time of the search, but his wife and children and an elderly woman were there. He said the house had been previously searched about three weeks ago, by a smaller group of deputies.

As the second search warrant for Creech was served Friday, June 8, and the attorney said the previous search was 3 weeks prior, that'd place the first search around May 18. The Gavin search was cancelled May 17. Looks like LE was looking at Creech then. As he was already convicted of the new drug charge at that time, I'm thinking he already had Teola as his attorney. In addition to not having a specific area to search, LE may also be cautious about having info released and citizens searching to protect the case.

To create a link in a post, copy the URL of the piece you want to link, select the icon that looks like a globe and a chain link, paste URL into pop-up box, click OK. You can leave the link that way, or, after you click ok, you'll notice it looks like the URL is listed twice in your post, with the second part highlighted blue. You can type in a different label for it, as I did for the one above shown as " this article". Sorry if that's clear as mud. :)

To all the newbies that joined for Gavin, warm welcomes, and thank you for caring.

I don't think it's a stretch to notice drug deals were occurring at the same restaurant where the Gavin sighting was reported, and that Creech is a twice convicted drug trafficker/dealer. Creech may have nothing to do with the debunked sighting, but it's still interesting, IMO.

Given that LE stated they were specifically looking for Creech, they asked him to take a LDT, his sentencing on the drug conviction was just postponed and he's being held pending the new sentencing date, I think he's the one under suspicion. Moo

I was hoping we would hear more too. I feel like this case is stalled. I know Gavin's family must be extremely sad and confused.

I was hoping the same. Given that Creech's sentencing was postponed and he's still being held, it leads me to believe LE wants more time to develop evidence/find Gavin/work on Creech re: the Gavin case. I don't think the case is stalled. I'm so glad LE seems to be working hard on this case, and may have a potential suspect. We see so many missing cases languish with little movement. Considering he went missing May 1st, and they already had someone they were looking at by mid-May, that's pretty good, IMO. I can't imagine how hard all of this must be on Gavin's family. Praying for comfort for them, and that Gavin is found soon.

While going through the Pg 5 links, I came across Creech's second appellate court case again. Ronald Richards and two attorneys from Richard's law firm represented Creech in that case. Looks like he specializes in drug cases. Link

Teola appears to practice both family and criminal law. Here's a high profile case he worked on. Link.

Sleuths here had pretty much guessed he was probably still doing his illegal activities/drug dealing, so this is no big news:

http://latimesblogs.latimes.com/lanow/2012/06/gavin-smith-missing-fox-executive-1.html

http://www.eonline.com/news/sources_missing_fox_exec_gavin_smith/325213

So now we know the couple were in an "open" relationship for awhile... Why was Gavin couch surfing on the couch of another woman in Oak Park that night? Did he go over to this house to get some dope/weed/whatever and then things went bad with Chandrika or Johnny? Thing is, it would take two people minimum to deal with the body and the car.

I'm thinking CW is a loose cannon and very unstable -- capable of flying off the handle and her husband would be the 'take care of the aftermath' person. The grandmother is 80-something. i'm sure there was concern of who would take care of those daughters if CW went to prison and LE was working on another drug charge on Johnny and he's back in jail now. So at least he's not a flight risk.

Any other ideas?

Thanks for the links, LL!

I don't know that it was open, as much as they were apparently "separated", per the articles. Not sure why someone would stay in the house with a convicted felon, who was facing, then convicted of new drug charges, with children. Maybe she owned the house prior to the marriage and she was afraid to ask him to move out, or couldn't afford it alone? I think I'd still kick him out/move out, if it were me. (I'm also not a fan of dating while separated yet married.)

In an article/interview, Gavin's wife identified the person he was staying with as a family friend. (To clarify for those jumping in on the thread, the woman Gavin was staying with/last seen by is not John's wife, CW/CC.)
'He was still watching TV downstairs when our friend went to bed, and he was going to be going up to bed shortly,' Lisa Smith told ABC News.

He was spotted driving away from the friend's home in Oak Park, north of Los Angeles at around 10pm in his black Mercedes sedan.
link BBM

It wouldn't necessarily take two to dispose of both. John could've found out his wife and Gavin were involved again, contacted him to meet him via a ruse or while the wife was out. Could've harmed him in the car, then driven away and hidden both. Or as others said chop shop. Or used his shipping ties. Or sold the car across the country via the net, given it to a fellow criminal. Could've dropped both somewhere temporary close by, and walked, biked, bussed, taxi'd or gotten a ride with a friend home. Could've had help from friends or fam. Others may have helped, unknowingly, or may have seen something and not realized it. As another poster alluded to, that could be why LE has let a little info out. In case it jogs someone's memory.

We haven't seen anything to suggest CC as a loose cannon or unstable, and as we haven't seen LE say they're looking for her, etc that seems like an unfair/unfounded character assessment, IMO. Of course, one wonders if she knew about John's prior conviction or not, or his biz while married. Not saying she has great or poor character. At this time, she's not open to sleuthing though, and WS has rules about posting rumors... Certainly seems John would be the one with motive if his wife was once again involved with a previous lover that he'd told her to break it off with years before, who had left his own family, just prior to John being sent away for ten years, IMO. John's first conviction was for dealing meth. Often, those who sell started out as those who use, then begin to sell to pay for their habit. If John was a meth user and facing the time he was, he might've been using that night. The circumstances alone might've contributed to a violent outcome, but if John was using that night, makes it even more likely, IMO. Or, if Gavin stopped by for a little score, John could've been paranoid that he was part of a sting to get him again. Gavin could've known about John's dealing from CC, and either turned him in, or John thought he did...many possibilities.

So, this theory is that CC did it (can't see a motive) and John not only helped with the cover up, but is willing to take the heat for it now?

IF Gavin was murdered, both CC & John could've been involved in the murder or both could be involved in the cover up, but I'd think if LE suspected that, they'd put a lot of pressure on her. Sure seems like they're focused on him, IMO.

Those articles just filled in what we had already surmised. Gavin was having a fling with Johnny's wife, and he probably got angry about it. Maybe Gavin went over there that evening, and that pushed Johnny over the edge. I think the cops have the texts and calls showing that Chavandra's home was Gavin's intended destination that evening. He probably picked her up and they went out somewhere that evening, and came home to be ambushed by Johnny. And she has to cover for him for some reason. ?

It sounds like Gavin left his friend's house with no shirt, wearing his son's sweatpants, so I don't think he & Chandrika went out that night, or that he planned to be gone very long. He could've run by their house for a number of reasons, though.

Summary of latest info ...

John Lenzie CREECH was born in in Ohio. He also lived in 3 northern Indiana counties.

Creech was previously married in Indiana to a TW.
He later married CW (different maiden surnames). I think he & CW are both on their second marriage.

In 2008 Gavin Smith met CW when both were in therapy (type not stated ... could it have been for drug addiction ?). They developed an intimate relationship and when her Creech husband found out about it, he told her to stop it. John Creech did have an email exchange with Gavin in 2008 but apparently they have never met.

Creech and CW are currently still legally married but apparently they have been separated since early 2011. They have an arrangement where they both still live in the same house but on different floors. They are both dating other people with the condition that neither bring a date into their shared accommodations. With this type of marital separation agreement, it does not seem likely that Creech would be a jealous husband. However such personal agreements can be tenuous and subject to emotional changes.

At some point Gavin and CW resumed their personal relationship.
Gavin's wife and 3 sons WERE aware of Gavin's extra-marital affair with CW.

A decade ago, Creech served 63 months in federal prison in southern Indiana (probably Connersville, Fayette County, IN) for conspiracy to possess with the intent to distribute more than 100 grams of methamphetamine. He was released in 2003.

Yes, Creech was a free citizen when Gavin went missing on 1 May 2012,
But on 21 Jun 2012 Creech appeared in Los Angeles County Superior Court, where he was scheduled to be sentenced on a single count of selling and transporting drugs. Instead, Judge Clifford Klein ordered that Creech remain in custody without bail pending a new sentencing date of 26 July 2012. So Creech will be spending his 40th birthday on 22 July behind bars and facing up to 10 years in state prison on drug charges.

I am wondering now if on the night of 1 May 2012, CW was arguing with her estranged husband and phoned Gavin for support. He went to her home to try and help ... but since that broke Creech's rule about no dates in their mulual home, it incensed him and an altercation ensued.

2rose, do you have the date of John & CW's wedding? Just curious how long they've been together.

Could've been drug therapy. She married a convicted felon drug dealer. A friend said Gavin dabbled in rec drugs, IIRC. Could've been relationship counseling, given that some say problems began in Gavin's marriage in 2007. They both could've been in therapy for a thousand different reasons. Could've just initially met in passing at the office while pursuing individual therapy.

I bet that 2008 email exchange between Gavin & John is interesting.

I wonder if CC & John are legally separated? (I knew a woman who tried to stay in the house with her ex for financial reasons and the kids. Generally, exes are exes for a reason and the tension was very tough, eventually for the kids as well, so they moved apart.)

I'd wondered too if CC felt threatened and called Gavin for support and that's why he left suddenly just in sweats...? Or someone pretended to be CC in distress...

As John had exchanged emails with Gavin in 2008 and told his wife then to break it off with Gavin, could be he tolerated her dating while separated, but had a visceral dislike for this particular blonde, successful Gallahad being back in the picture.

It sounds like Gavin's sins may have had a role in his disappearance. So sad for him and his family. Certainly doesn't justify any harm, just adds to the sorrow, IMO.

http://www.deadline.com/2012/06/mis...-searched-valley-houses-owner-in-therapy-lat/

So this says that LE believed a crime was committed at the house when they last searched. This still leaves the need for at least a couple of people to clean up/hide the body and evidence and probable collusion by CW.

Thanks for the link!

Her husband faces up to 10 years in state prison on a February 2010*drug charge of selling and transporting cocaine*and admitted to*Glendale police that he was a middle-man between drug producers and lower-level street dealers.

Sounds like John would have some connections to help dispose of things...

If Gavin was killed at the house, it didn't have to be particularly messy, i.e. strangulation. Or if shot in his car outside the house... We have seen cases where one person kills and disposes. Might be collusion/accessories, might not.

Eta: Hm. Given the above quote, and that John had been facing multiple charges, and only one shows the adjudicated outcome online, I wonder if he gave LE any info on his drug contacts...

More "news", about the female resident.

Once again, the alleged male resident was not named as a POI by LE.

Have at it:

New lead in Smith disappearance

Lt. Margarito Robles of the Los Angeles County Sheriff’s Department was unable to confirm a connection between Smith and Chandrika Creech, but said that the media were “probably right” in their reports of a possible affair between Smith and Chandrika Creech.

And that's all she wrote...MSM, that is.

:waitasec: This article doesn't say anything about anyone being named, or not named, a POI...

John is a person. Given all we've seen so far, seems LE is interested in him.

SWAT team ordered home's occupants out, neighbor says

But one law enforcement source told The Times that serving a search warrant in a missing person case is highly unusual and it suggests the case is more complex than originally believed.

Much more at link above, plus video report.

~jmo~
BBM

Well we know it takes a good reasonable cause to get a search warrant.
<SBM>

"We're following up on leads and all the information we've gathered about people that he has come into contact with and that he has known in the past," said Dolson.

Authorities also said the man they were looking for at the residence, Johnny Creech, wasn't home.
<SBM>
link
(Johnny named by LE)

If he has been named by LE and they are obtaining and executing search warrants, he is fair game. Not his mother, brother, sister, aunt, uncle, etc. But you bet you can sleuth him.

Go Sleuths!

Salem

Authorities reportedly left with boxes, a computer and a black SUV belonging to the husband.
BBM

A source close to the matter told the station that police were pressuring the husband to take a lie-detector test.
link

Per video here, they said wife "has had contact in the past with Gavin Smith", "questions by detectives lead toward naming the husband who lives here as a suspect in Gavin Smith's disappearance." Said someone close to the fam said John's being pressured by LE to take a lie detector test, but on advice of counsel, he declined. From the quotes attributed to unknown source, it sounds like it might've been his attorney, Treola, as statements in vid match statements attributed to him in linked pieces above. Treola is a criminal defense/family law attorney, per Martindale. Also at vid, two cellphones were confiscated from this residence as part of first search/warrant three weeks ago.
BBM

Just a few quotes, links, etc that show LE's interest and focus. Many more in this thread and media links thread. No one has said LE held a formal press conference naming Johnny a POI. They don't need to. The term "person of interest" is not a legal term.

“A person(s) of interest simply means that Law Enforcement is interested in speaking with those who they feel can assist or provide information regarding an investigation,” she said in an email.
A person of interest does not carry any direct implication of culpability without an admission of guilt or further evidence that links the individual with the crime.
Tony Gaskew, director of the criminal justice program at the University of Pittsburgh’s Bradford campus, said the term “person of interest” carries no legal definition. Police may use the phrase to identify any individual connected with a case, such as a possible witness to a crime or the person they believe committed the act.
Gaskew emphasized that law enforcement distinguishes between a person of interest, which does not implicate a person directly in a crime, and the term suspect, which does.
link

Nor is it a necessary or required step in an investigation. In Sierra Lamar's case, for example, no one knew they had someone in mind until he was arrested.

Just enough info has come out for individuals to deductively reason that LE is interested in John regarding Gavin's disappearance. If anyone else was involved, intentionally or unwittingly, or observed something they only now recognize as perhaps relevant, they can choose to give that info to LE.

Regarding your link, Robles is the spokesperson for the Sheriff's office, so he likely would not have information regarding specific cases or updates, beyond what he's been told to release. That's standard and we've seen that in other WS cases.

<snipped> Lt. Margarito Robles, spokesman for the Los Angeles County Sheriff's Department.
link

From your link:

“I’ve received no updates since the last time a few weeks ago,” said Robles.

The officer in charge of the case is homicide Sgt. John O’Brien. Calls to O’Brien were not returned.

Not sure that article is terribly accurate to begin with. Lt. Dave Dolson seems to be heading up the investigation, per multiple news sources, and Lieutenant outranks Sargeant...?

Now, perhaps we can get off the ridiculous is John Creech a POI merry-go-round?

If some have theories that differ with LE's or other posters', that's fine. Please post them, your reasoning, links, etc. More the merrier in trying to help Gavin and his family. Two heads are better than one, we all have different life experiences, skill sets, perspectives, etc that could help. But to keep coming back to this one point is unhelpful and myopic, especially when a mod has reviewed the info twice, and ok'd sleuthing John Lenzie Creech twice.

Where is Gavin?

 • #213
I wonder why LE thinks there was a relationship if they can't confirm anything. I mean, was there calls back and forth between GS and CC? Did friends say they were dating?

The statement does not mean that detectives haven't internally confirmed it. It means the spokesperson cannot confirm it to the media, IMO.

 • #214
The house is in the name of CW. Creech lives there along with an older woman (grandmother?) and two daughters. Because of the SWAT search with cadaver and/or drug dog, everyone living in that home is a potentially a POI, if the house is that interesting to LE.

My point about CW is, she is married/living with a previously convicted felon and he's back in jail on another charge. Normal mentally healthy women usually do not marry/live with drug dealers, especially not with 2 young daughters. <modsnip>

As I had posted WAY upthread, this case is just the type that MSM loves, for its entertainment value (nice-looking guy/local "hero" type, remote connections to the industry, "Hollywood", etc). Max ratings fodder!

Of course, LE does not have to disclose any details about personal lives UNLESS it considers them key to finding a missing person and they need the public's help. Not so, in this case, so far.

I think LE is doing well on its own, sorting thru the vast info it has collected (many many search wts, not just at the house which got attn), interviews with family, friends, & associates, and so on.

Unfortunately (but I place no blame), family has not been forthcoming with information that could help the public understand what might have happened. Worse yet, the family's silence has raised even more questions. :-/

Is anyone searching the canyons anymore, as if he had driven over a cliff intentionally or by accident? Any other planned searches? If not, quite telling...don't you think?

Also to add: If LE found any bad eggs thru their investigation and locked them up, good. Kinda like an Easter Egg for them. :-) Such persons may have nothing to do with Gavin Smith's missing status, but they got caught in a broadly-cast net. Fine with me!

~jmo~

I agree that LE seems to be doing a great job in this case. I think they are keeping details to themselves to protect the case and they have leads to work with. The family may be silent both to protect Gavin and the family and to respect LE/protect the case.

I don't think we know whether searches are being conducted. Apparently over 20 search warrants have been executed, and two have found their way into the media. Lt Dolson has briefly commented on those two. I'd say that indicates their focus on John. Of course, search warrants were probably obtained for Gavin's phone, his wife's, the family home, the friend's home, Gavin's office, the two phones seized at the Creeches, etc. What do you think it indicates if no searches are being conducted? Is it your theory he ran off?

So, are you saying Creech was a bad egg LE found through this investigation and locked up, or are there other arrests you're aware of? Considering Creech was charged with multiple drug charges in 2010, he certainly wasn't found by LE through this investigation. LE acknowledged the search warrants executed at Creech's home were part of Gavin's investigation.

We don't definitively know if John was involved in Gavin's disappearance yet, but it certainly seems LE suspects it, and that there's enough potential evidence to obtain two search warrants.

Also one of the articles said that LE said their more recent interest in the case is the female owner of the house, not the male felon -- cannot seem to find the article that states this right now. It's one of the more recent ones. I'm sure someone else here can locate it.

Yes, they could be considering CC too, but they haven't publicly said they're looking for her, as they did John. No one's said they've asked her for a LDT, etc. More may come out about her involvement/noninvolvement later.

Yes, I agree. Doesn't seem healthy. She may or may not be involved.

Yes, please find that link, as I've seen nothing stating anything remotely similar to that anywhere. That'd be a change worth exploring, for sure!

<snipped>

So I can see that the family really might have nothing to say. Maybe they are worried that they will come off angry. And maybe they are quietly advocating in the background?
SBM

Good way to put it. I bet they are quietly advocating, praying, hoping, grieving for Gavin. They know his flaws and his strengths and still love him, IMO.

 • #218
Since it has been reported that his cell phone bounced all over that night well after bar hours, there's probably way too many cliff-side drop offs to start a bunch of searches all over the valley. LE would want to suspect a specific canyon to search. If your heat is as high as ours here in TEX, it would endanger the searchers for a slim or negligible possible find. Especially since they have no specific area, LE may think GS went right from that house to body disposal somewhere -- possibly why there are no searches.

BBM

I just noticed this part. Do you mean he owed her $, or vice versa? We haven't seen anything to indicate a debt between Gavin & CC, have we??

As many in this thread are new, I'll just say posting rumors is against TOS per many mod posts in many threads... I'm sure a mod will clarify here soon.

I am not a mod. Just trying to help.
