DA: Teen lovers tried to hide sex before killing mom

Teen lovers Tylar Marie Witt and Steven Paul Colver made plans to get married as they struggled to conceal their sexual relationship from Witt's mother, testimony revealed today as the pair faced a preliminary hearing on murder charges in El Dorado County Superior Court.

In a journal authorities said was written by Tylar Witt, the teen detailed her romantic relationship.

"Last night, he repeatedly told me her loved me; that he wanted to marry me," an El Dorado County Sheriff's detective read. After offering details on their sexual relationship, Witt allegedly added, "I don't know how long we can keep our love away from my mother... It's so dangerous. I wish it wasn't though."

Earlier today, Witt's public defender Mark Ralphs sought to bar the preliminary hearing. He charged that prosecutors had committed "misconduct or at the very least gross negligence" in failing to provide toxicology reports to the defense until just a day before the hearing.

Ralphs said the reports confirmed that his client could not have drugged her mother before the murder as prosecutors had alleged.

Authorities say Witt told a friend that she spiked her mother's drink so she would pass out, and then called Colver to come over to kill her.

Judge Douglas Phimister denied the prosecutorial misconduct motion and allowed the hearing to proceed.

Teen, Boyfriend To Stand Trial For Killing Mom

EL DORADO COUNTY, Calif.
An El Dorado County judge has just decided there is enough evidence to try teenagers Steven Culver and Tylar Witt murdering Witt's mother.

Witt's attorney tried to stop the preliminary hearing, accusing the prosecutor of misconduct and gross negligence.

Colver Will Not Face Death Penalty

EL DORADO HILLS, Calif. (CBS/AP) -- An El Dorado County teen accused of killing her mother has entered a plea of not guilty by reason of insanity.

Tylar Witt entered the plea in an El Dorado County court room this morning. Her boyfriend, 19-year-old Steven Colver, who is accused of plotting with Witt to kill her motherm enter a not guilty plea.

Tylar Witt is being tried as an adult, but isn't eligible for the death penalty because of her age. Colver will not face the death penalty either, but Prosecutor Lisette Suder said she will seek enhancements that could mean life in prison without parole, if convicted. Suder says they include the special circumstances of lying in wait and killing a witness.
 
If she called her friend to come over and murder her mother after she allegedly spiked her mother's drink, can that be considered "insanity" in the eyes of the law?

(IMO, it sounds like premeditated murder.)

I am so glad my years as parent of a teen girl are over. These teens nowdays do not seem to know what a parent is. We don't exist to pay the bills only ! Then we hear stuff like "you are too controlling, you are ruining my life, teens are supposed to do what they like." What is a parent supposed to do but "control" their own kids? Who is telling these kids what a parent is? argh. Bless the spirit of this poor Mom who did what many do not, and filed that stat rape order, she did her best to protect her child.
We need to start social change in this world and get back on track teaching social standards, not just writing standards, when kids are young, IMO.

These cases are heartbreaking because of how blind these girls are. It never ever should have to resort to murder (im leaving out self-defense: too much of a debate). Its not worth it!
 
Insanity will not cut it, IMO; juries in US are very reluctant to accept this defense and in the cased of a teenage girl with the older boyfriend, we have seen this type of crime too many times...this girl is not insane, she just wanted what she wanted, part of the instant gratification era gone awry...she may be evil but not insane. I figured the defense would try to use the innocent young girl led astray by the big bad boyfriend she feared etc...but they must have known this wouldn't fly, so insanity was all that was left...IMO it won't work (it had better not...)

The start of suspected killer Steven Colver’s trial was delayed by several months Friday morning.


...Citing the recent receipt of 37,000 pages of discovery, defense attorney Dain Weiner filed a motion to have the start of his client’s trial pushed back. It was initially slated to begin in February 2011.

El Dorado County Superior Court Judge Daniel B. Proud chose May 3, 2011, as the new start date with a readiness and settlement conference set for March 4, 2011.


...In September, Tylar Witt, 15, pleaded guilty to her mother’s first-degree murder. She also admitted two special circumstances: lying in wait and killing a witness.

Tylar had initially pleaded not guilty by reason of insanity.

Although she was 14 at the time of the killing, she was going to be tried as an adult. But with Tylar’s plea bargain, she will serve 15 years to life if she cooperates with prosecutors.
 
21-Year-Old Murder Suspect Expected To Testify

El Dorado County prosecutors said that Colver killed the mother of his girlfriend as part of a suicide plot for the young lovers to be together forever. The victim had filed a statutory rape complaint against Colver.

The prosecution is expected to wrap up its case Tuesday.

Colver’s defense attorney Dain Weiner said he will challenge DNA evidence in an attempt to prove that Witt, not Colver, committed the killing.

On the stand, Colver revealed for the first time publicly that on the night of Joanne Witt's death Tylar called him to her mom's home and confessed to killing her mother.

"She was holding a kitchen knife and there was a red stain on her right pant leg. I was shocked. She said, 'Boston, I did it. I finally did it. My mom's gone forever,'" testified Colver.
