Is that in the latest video? I can't listen right at the moment... pretending to listen to hubby instead LOL Is the jailhouse glass talking through in there???? That's what I was expecting to hear today lol
They played two recordings. One was an actual call
(guessing they used phones) and the other was the glass talk visit.

Are you asking for this Maline's OS?
Yes, but screenshots of it--posted on this thread, so all can view!! :D Many folks don"t actually click onto links for one reason or another so screens shots posted here would be good!! :D

  • #444
Can you not share it here, missy? It is part of the Defence's OS, surely you're permitted to post screenshots of it?

I can... and I will... just for you ;):p No screenshots... it was such poor quality, I don't think they would have been readable. Each group of statements was a different slide up on the screen.

Tracey Riccobene

October 26, 2018 went to investigators and defense to give statement.
Dan confessed to her that he murdered the family
Detailed statement
Held one of the boys at knife point to get the family out of the home

DK raped Summer
Wanted revenge against Joseph McStay for cheating him
DK buried the sledgehammer in graves
Was not in Hawaii - DK lied and provided false alibi
DK came back to the house and pretended he was Joseph

Known DK for years - Best Friend
Like a brother to me
Share music in common
Says DK is a genius manipulative mastermind
Full confession 2 weeks ago but had been hinting at it for a longer period of time
She told him to come forward - he refused.

After Riccobene told DK to come forward
He has been threatening her
She is terrified of him
He has no empathy toward other people
She feels it is her duty to come forward even though DK will harm her
Requests witness protection

Yep, good point, I will maybe go back and see if I can get some of the other one's that he had up about DK as well. Cathy mainly caught the Dan stuff because she knew everyone would be wanting to hear that lol

I'm just listening to Part 1 of today's testimony now, when Maline asks for the date of the jailhouse call Rodriguez says this is "a transcript from a call that occurred on October 11th 2014, prior to the defendant's arrest."

ETA I think it was the day after she was interviewed by detectives, so I'm wondering if they bugged the phones.

His actions in the subsequent days do support their claim that they were alarmed enough to consider calling the cops. Why didn't Cathy call? She painted a picture that they were all friends. Or did she have a warrant for her arrest too? If they would have just left at , " I thought it was strange I couldn't get a hold of Joey", I would believe it. It is the addition of considering calling the cops that sound like embellishments.

and liars adding too much detail is what trips them up

I think she & Merritt's daughter have been the best 2 witnesses for the Prosecution to date...LOL

Maybe the family members went to the restaurant because MM said he saw the family in the neighbor’s surveillance video getting into the Trooper to go out to dinner.
Mike was the one who Chase told, he and Susan went to the restaurant.

You are putting your own spin on this. Where is the PROOF that the checks were cashed without Joey's permission? That the checks were backdated in order to commit fraud, as opposed to expediency when drafting them? There was no recording of the call to QBs so we don't actually know for certain what Chase said to the rep.

Where is the proof that the checks were cashed without Joey's permission?

I guess that is one of the upsides for Chase, that his boss vanished. Only he or Joey could tell us in words, and Joey's gone.

There are a few clues though.
-For example, didnt Joey issue Chase a check for 100 dollars that same week? Why would Joey go to the trouble to write chase a 100 check and take it to him, if he had already told Chase he could write himself all his own checks?

-Looking back on some of the prior testimony, about Joey getting complaints about Chase's work product, and Joey farming out most of his new work to MSM, who didn't want to work with Chase anymore, and Joey saying that Chase owed him a lot of money and it was a problem for him------Knowing all of this, why would Joey suddenly give Chase, who he wanted to eventually replace, access to the bank account?

With Joey knowing that Chase had a bad gambling problem, and he also had a criminal history for theft and fraud, and knowing that Chase was in bad financial straits---WHY would Joey suddenly decide to give a broke, gambling addict access to the McStay money?

What should we make of the wild coincidence of timing? Joey tells Chase, 'go ahead, take these 76 black checks and sign my name if you need some money, and go ahead and delete any notifications of it in the QB', -----and this happens within 24 hours of Joey and family going missing?

That the checks were backdated in order to commit fraud, as opposed to expediency when drafting them?

Expediency? What expediency? He couldn't cash a check that was dated Feb 5th? It had to be backdated and deleted?

And what kind of 'accounting system' wants all notations concerning a debited check to be deleted, so it is no longer visible in the books?

There was no recording of the call to QBs so we don't actually know for certain what Chase said to the rep.

Chase already admitted he was trying to close down the online account. And he did so by pretending to be Joey. And he claims Joey asked him too, even though Joey didnt give him the necessary passwords. But of course Dead Men Tell No Tales.

Mike was the one who Chase told, he and Susan went to the restaurant.

Maybe Chase told him about Joey’s favorite restaurant after Mike told him about seeing his family getting in the Trooper and going to eat dinner.

mcstay family murder trial day 30 part 1 (this is from today 3/14/09)

CJ was a GREAT witness for the Pros, which I said earlier. They had "the goods" on her and what she would say.

I am amazed at how the Pros can remember the dates, calls, non calls etc. in their memory. For that, I commend them.

  • #459
CJ has the same can't-remember-itis for the afternoon of the 4th (and the reason for 13 phone calls back and forth between she and CM) that CM has for that night.

  • #460
Ouch. Cathy is being BRUTALLY honest with CM in that jail call. Said CM pissed everybody and doesn't care about anyone.

Which goes exactly to what WS'ers have been saying since the trial began. Imagine that! She basically laid out the motive the Pros has laid out thus far.
