So - I see this question was asked, but no one answered -
Who is M. Perlin - re witness on the other hearing on 4/5?

Is anyone knows? TIA! :)

It's not even clear they had lunch. His description of the meet is all over the place. He's calling Jarvis constantly up until 2 o'clock and Joseph was on the internet up until then as well.

i think it's clear they didn't have lunch

His blog has been down for over a year and the jailhouse phone recordings Rick reported two years ago at least. Smith testified that it was standard to record phone calls and inmates are aware. Rick made it sound as if Merritt's rights were being violated by the "very corrupt SBSO".

Nope. I was reading it every day after the start of trial. It wasn't the same blog as before, but I knew it was him. Then one day I clicked on the link, and it said "Domain is Parked." I have no idea what that means though.

If a neighbor had threatened JM, as DK had done, then it certainly wouldn't be "wild speculation" to consider that neighbor a potential suspect.

It would be speculation if two detectives testified that the neighbours had a solid alibi

As missy is saying, we need to focus on evidence at trial.

So far, the defence has done nothing to rebut the witness statements of the detectives - so prima facie, DK has an alibi unless the defence can make this a live issue at trial.

The point i am trying to make is that evidential procedure matters.

So unless and until actual evidence is introduced for the DK done it theory I think we should not wring our hands too much!

For some reason I don't get any volume on the posted utube.

Then probably not him imo. We're talking about the "Great Rick Baker" who would make a big Cosmo type entrance stating he was back. His ego is too big to come and go quietly.

I missed what happened on 4/3, Tuesday with the jurors. Can someone give me a synopsis on who was called?

No, i don't think so, but the Trial is decided and based on evidence from a Preliminary Hearing.

2 Q Did you find all of the stuff that we've just talked
3 about being from the house, did you find any evidence from the
4 graves or gravesites that was consistent to those items we've
5 just talked about?
6 A Yes.
7 Q Can you please itemize those for us?
8 A In the grave itself there was like a black nose, eyes and
9 a whisker and some padding consistent with the bathrobe that was
10 depicted in the picture with Joseph, Jr.
11 In the gravesite there was a black backpack containing
12 what was a paintbrush and looked like, maybe, like a small pick
13 or hand garden tool. These items were depicted in a photograph
14 of Gianni wearing a similar black backpack and Joseph, Jr.,
15 posing, holding the same type paintbrush.
16 Joseph McStay was wrapped in a tannish woven blanket or
17 article of cloth that had seams on it, which appeared to be
18 consistent with the cover from the futon that was missing at the
19 time they went missing, the family went missing.
20 There was a blue painter's tape that was in the white
21 shop towel, in the grave. That white shop towel was consistent
22 with the roll of shop towels that was found in the garage.
23 There was also another white towel which had flower
24 imprints on it and was consistent with what would be a typical
25 bath towel that would be found in a house. However, there was
26 no other in towels found in the McStay house. There was nothing
27 to compare it to. They were all gone.
28 Q Did you find any white terry-type material consistent

2 A Yeah, there was some small patches of white terry cloth
3 material consistent with either a bath mat, because photographs
4 depicting the McStay house showed that there was a toilet cover,
5 the typical kind that's sold in, like, sets, where you have a
6 floor mat and another rug in front of a shower. However the
7 floor mat and the rug for the shower was gone, and only the
8 cover for the toilet seat was there. And also it would be
9 consistent with the terry cloth that was depicted as missing off
10 of one of the hooks.
11 Q In the excavation of the gravesites, did you notice
12 whether any type of footwear, shoes or sandals, anything of such
13 were found in the excavation process?
14 A None were found.

All of this evidence found in the graves, and missing from their home, sure supports they were all murdered inside of their home.

He must have used all of the other towels to clean up, and most likely put them in another hole in the desert where he discarded their cell phones, and other items that have never been found.

He may have not wanted to put blood soaked items inside the graves, thinking that wildlife may have completely uncovered the bodies, where they may have had a chance to be uncovered much quicker.

Michael McStay was recalled. As well as Ryan Smith was recalled.

It didn't happen Niner.... the defense received a video from Beasley that morning, they gave a copy to the prosecution, so neither had time to look at it yet is my understanding.

Exactly.

Even though the defense doesn't have the burden of proof they must put forth evidence to support the claims they have asserted for them to retain any credibility with the jurors.

They must keep all of the promises they have made to the jury.

After all what they are really asking this jury to do is completely ignore all of the evidence pointing to their client, and believe it was done by someone else.

The jury will expect them to do just like they told them they were going to do in OS.

Over promising without delivering will not bode well for this DT, and I think that is exactly what they have done.

They do risk a horrible blunder if the prosecution has hard evidence of Hawaii

What are some of the examples of what you'd consider to be hard evidence of DK in Hawaii?

What are some of the examples of what you'd consider to be hard evidence that the McStays were not murdered by their next door neighbours?

If I were a next door neighbor of JM I would feel extremely uncomfortable to be compared to someone like Dan Kavanaugh.

It's easy to do this - its wild speculation.

We've had two detectives testify that DK was eliminated from inquiries - so prima facie, he didn't do it.

Detectives can err.

The evidential onus is on the defence to introduce even one piece of evidence that implicates DK in the murders.

The burden is on the prosecution to introduce even one piece of evidence that implicates Chase Merritt in the murders. There is ZERO.
