Re. Randolph Beasley (sponge expert) he emailed his report to McGee yesterday - Pros filed an additional motion (at some point I'm not sure when) to exclude some of the testing and testimony of Beasley, and Pros still has not received all of the discovery, defense can't respond to pros without knowing what his report is, he will put the footage on a thumb drive and give it to the pros, pros motion will be heard April 3rd pm.

Rodriguez and Daugherty are going on Friday to Pittsburgh DNA lab

Defense doesn't have enough witnesses to fill April 3rd (am) or April 4th - so call Mike McStay next week instead of this week. They tried to get another witness but although they located her she has a doctor's appointment.

Rodriguez - at some point they need to address the issue of scheduling because the jury is only "10 qualified" through to the end of April
Judge says he thinks it was until mid-April - Rodriguez says we are going to have some issues with the "10 qualifications" - Judge doesn't think that'll be a big problem unless someone has a big vacation scheduled but they'll work around anything else.

McGee still thinks he will be able to close by end of April.

The Provecho discussion in the jail house tapes is this mistake IMO. You can see that Chase has prepped Maline that he didn't get the 19K. Then he is prepping CJ to manufacture testimony. But he accidentally admits in the tape that he did get the 19K (and we know it from the email).

In these cases, the staging/fabrication always seeks to point away from the defendant. So we need to reverse the process. Why is he trying to lead the state away?

Chase shows us what is sensitive and what he is trying to hide.

You've said it yourself. Why does the defence care so much about blood in the house when DK did the murders?
I must admit I'm still struggling to see what their strategy is regarding Provecho.

Defense must have only realised since trial started that the prosecution's case is stronger than they thought that the murders did happen at the house :D

Maybe with the faro scan witness.

What I dont understand is why the sponge expert just turned this over yesterday???

I thought the defense mentioned this guy months ago in their OS?

So is the state going to ask for video footage of all of his (cough cough) experiments that didnt fit the defense's theme?

They usually have to turnover all experiments they did even those that were duds.

I must admit I'm still struggling to see what their strategy is regarding Provecho.

I'm glad, I'm not the only one. I dont see how this project is going to save CM one way or the other.

It sounds to me as if the defense is responding to what's come up in trial. Maybe they were just going with popcorn on the couch and dogs outside = breakfast but then they've panicked a bit since the dismissal hearing.

They're reacting rather than planning because they don't really have a case, letting off a smoke bomb here and another one there kind of job. Like Mikey not paying money to Jonah's parents and Susan writing cheques to herself etc. They only got the bank statements for the trading period after the murders since trial started.

Thanks for detailing the hearing, Tortoise. I just can't believe the defense is having such a hard time getting their witnesses into court (and that the judge is so lenient about it), esp. if they're coming close to problems with jurors and the length this is dragging on, it's just nonsensical to me.

My understanding after listening to that is that Cathy Russon's tweet is completely incorrect.

It's TSG's response to the People's subpoena - filed by TSG not the defense
With respect to some interviews they had done - wasn't stated who they interviewed, although I suppose it could include Merritt
And an additional response filed under seal by TSG - not the defense

I just listened to it... in the first minute, Rodriquez says they were ready to go forward but Mr. McGee has filed something as well under seal and they would like additional time to respond.

Am I hearing things? LOL Unless McGee is representing TSG....

I don't know exactly how it works in California, but I am almost positive that Merritt is not paying for his defense. I recall early on a comment being made by I think McGee that because they put the death penalty on the table, it allowed them more resources for experts.

It makes me laugh to read the comments about the defense not being ready, etc. Again, everyone forgets how many days ended early in the beginning because the prosecution "ran out of witnesses". Dr. Rudin had been asked to do work on this case back in 2014, yet he was still writing reports, doing experiments, and ultimately the State decided not to even call him (that 402 hearing probably did them a favour)... and then they had to hire a new guy and everyone had to wait for his report and for him to testify.... Smith tried the key finally after the trial started... he used his google maps expertise to make a 'chart' of casino pings after the trial started... they recorded Chase and Cathy after the trial started... I am sure there is more, but these are just off the top of my head.... I sure hope the jury has a better memory :D

Wonder where the other witnesses are - DK, his ex-girlfriend, the forensic accountant...who else did they allude to in OS? McGee opened with such a promising array of experts to destroy the state's case, where are all of them?

Seems to me it'll be hard to get a jury to believe that the spatter from hitting a wet sponge could equate to the same spatter as hitting a hard skull with a sledge hammer.

Days ending early is different than having no witnesses for days on end, IMO.

The only explanation for the delays that I can see (other than the judge's dental appts, juror acvidents, etc) is perhaps the defense needs the witnesses to go in a specific order, and if one cannot make, it delays everything.

Geesh, some of this stuff no one can prove but the killer, but got to hand it to the defense, they sure ran with the knife business.
And where's their cell phone expert? Seriously, they think they can change what has been a pretty constant level of consistency with phone pings and towers more than sufficient to place defendants in certain areas, for years, in hundreds of trials and flip it upside down?
Who was in debt to Joey?
And who would write checks to Chase on the sly? Some random person to set him up?
Who's childhood stomping grounds was the high desert?
The Jarvis, Merritt witnesses are as sketchy as all get out, and none of them can give him a solid alibi for the times in question.
And the FARO.....REALLY? It's NOT Chase's truck?
Who else had motive, means, and opportunity? And ABSOLUTELY no ALIBI?
It all hinges on his creativity, the "desert rat Picasso", who's being persecuted for creating objects de art......if only he had cut off his ear.......

Tongue in cheek, folks.

Seriously, Chase doesn't have a single receipt, a random video clip from a gas station, a time card, NOTHING that proves he was somewhere else.

Well, this is the second time Chase has stuck his foot in his mouth and the defense has had to deal with it. At least since the trial started. They also have to contend with his interview with CNN.

The more Chase talks, the deeper the hole. I picture McGee telling him "put the shovel down already!!"

Any way, I found this article from 2016.

Suzy Israel, a former deputy public defender of 16 years in San Bernardino County, is pending appointment to Merritt’s defense team. Forensics expert Randolph Beasley has also joined Merritt’s team, as has media advisor Robert Wallace. Gary Robertson, a retired homicide sergeant for the San Bernardino Police Department, is now Merritt’s assigned private investigator.

I'm assuming these experts were approved by the court at the court's expense. That was 3 years ago. It's not like "sponge guy" was just recently hired.
