Yes he has. But since he just delivered his report.... makes me believe those pics of him (sponge guy) experimenting with the sledgehammer and sponge are actually for this case. I kind of had my doubts. I can't wait to see what his conclusions are. :confused::)

Me too Tortoise. I don't know where they want to go with this. Chase made such a big deal about it when talking to CJ. I'm so glad that conversation was recorded. Especially the part where he said something like ... well, I was supposed to pay him back....

So is the state going to ask for video footage of all of his (cough cough) experiments that didnt fit the defense's theme?

They usually have to turnover all experiments they did even those that were duds.

Wonder if the defence is having a hard time paying its witnesses and sponge guy as good as it gets

I think the expense is on the taxpayers and already approved by the court. But that's just MOO.

Wonder where the other witnesses are - DK, his ex-girlfriend, the forensic accountant...who else did they allude to in OS? McGee opened with such a promising array of experts to destroy the state's case, where are all of them?

Seems to me it'll be hard to get a jury to believe that the spatter from hitting a wet sponge could equate to the same spatter as hitting a hard skull with a sledge hammer.

Where is the DNA expert? What about the DNA the defense expert found on the items from the graves/grave sites? I know Patrick and Summer's sister were subpoenaed. My guess is they want Patrick to testify to statements he's made in the press about how much Joey liked Chase. Remember, Chase wasn't even on Patrick's list of suspects.
Summer's sister...I have no idea why she's on the defense list of witnesses.
However, just because someone is subpoenaed doesn't mean they will be called.

When do they plan on playing some of that 8 hr interview with Chase and detectives?

What if it was a box cutter instead of a knife? Or a pair of a pair of children's safety scissors?!? Bawahahahaha!
Geesh, some of this stuff no one can prove but the killer, but got to hand it to the defense, they sure ran with the knife business.
And where's their cell phone expert? Seriously, they think they can change what has been a pretty constant level of consistency with phone pings and towers more than sufficient to place defendants in certain areas, for years, in hundreds of trials and flip it upside down?
Who was in debt to Joey?
And who would write checks to Chase on the sly? Some random person to set him up?
Who's childhood stomping grounds was the high desert?
The Jarvis, Merritt witnesses are as sketchy as all get out, and none of them can give him a solid alibi for the times in question.
And the FARO.....REALLY? It's NOT Chase's truck?
Who else had motive, means, and opportunity? And ABSOLUTELY no ALIBI?
It all hinges on his creativity, the "desert rat Picasso", who's being persecuted for creating objects de art......if only he had cut off his ear.......

And I’d expect a witness to DK being in California during the relevant time period, too.

I can’t see how what Patrick said would be deemed relevant to the trial. But if allowed, it also could backfire terribly on the defense.
Showing that the murder victim liked CM isn’t proof that CM didn’t do the murder—it simply makes it potentially a more horrific murder, (if that’s possible.) Just my opinion.

When we look back at this, WHY is it an ISSUE? The PT/LE said he was in Hawaii. Why are we even being sucked into the DT's "Nuh uh, no he wasn't".

Joey still owed DK that last $2K for the website, DK was still getting monthly web master payments. DK didn't have the where with all to run the business and I really doubt he wanted to. He didn't hate Joey, Summer, or the kids.

I don't believe there's anything sinister with DK. Yes, he's a bit eccentric and full of himself but a dog with bark and no bite.

I just listened to it... in the first minute, Rodriquez says they were ready to go forward but Mr. McGee has filed something as well under seal and they would like additional time to respond.

Am I hearing things? LOL Unless McGee is representing TSG....

Well, this is the second time Chase has stuck his foot in his mouth and the defense has had to deal with it. At least since the trial started. They also have to contend with his interview with CNN.

The more Chase talks, the deeper the hole. I picture McGee telling him "put the shovel down already!!"

Actually, I'm not sure who's interviews they are looking for, it wasn't specific, it just said "interviews". The difference between CNN and the TSG interviews are, the CNN one was aired... remember when the judge told the defense, you can subpoena CNN for the full tapes, but good luck ... I wonder if TSG footage could also be somewhat protected. Like I said yesterday, this happened to the film makers of Making a Murderer around the trial time too... the judge in that case quashed the subpoena. JMO

I also looked at the archived IMDB last night, the guy filming didn't have the McStay doc listed back in 2016, so if it wasn't being filmed before he was arrested, if they are looking for Chase's interviews, they should already have recordings. IMO

Any way, I found this article from 2016.

Suzy Israel, a former deputy public defender of 16 years in San Bernardino County, is pending appointment to Merritt’s defense team. Forensics expert Randolph Beasley has also joined Merritt’s team, as has media advisor Robert Wallace. Gary Robertson, a retired homicide sergeant for the San Bernardino Police Department, is now Merritt’s assigned private investigator.

I'm assuming these experts were approved by the court at the court's expense. That was 3 years ago. It's not like "sponge guy" was just recently hired.

It could be that the defense didn't know that the State was going to go with the theory that there was no blood as a result of the injuries until the trial. Dr. C testified at the end of January though, so not sure why Beasley took so long to do any experiments lol It seems to be the theme in this trial, on both sides IMO The pro's didn't know the defense was going to make a big deal over the key not being tried... so they tried it, Rudin was still doing his report and still doing things the day of the 402 hearing lol The accountant checked after he started testimony about transactions that could have been checked before he started testifying. The list goes on and on and on... IMO

I'm also the same understanding that the State is paying for these experts.

I was actually thinking they would want Patrick to maybe talk about his interactions with Dan in those first few days? Maybe even about emails. Who had access, etc. He also spoke to Joey that morning and has stated that "everything was fine". Didn't Summer talk to her sister that day as well? Could just be they want her to say that everything was fine, Summer didn't mention anything?

The 8 hour interview thing... they were supposed to have hearings or 'work out' what they were going to show and not show. I think I recall that from last week so will say JMO

After listening to the testimony of the States expert... I am not sure DNA could survive, but I guess it might depend on the method. DNA forensics is changing all the time, and who knows, maybe even between 2014 and now, it's more sensitive? Their expert will have to convince me lol

I think this is a bit of a catch 22 though for the Prosecution... if the DNA got on there after they were discovered, how did that happen? And then it becomes an argument for the defense to say it was a sloppy job that DNA from those working the scene was left... and not just from 1 person... I believe it was 4 different profiles? 3 male, 1 female? JMO
