Just to quote your post again missy, according to the San Diego search warrants and what was taken by LE from the McStay home, they seized
8.) Dell Inspiron Laptop from shelf in kitchen.
9) E Machine Computer T2040 from den.
10) H.P. Computer HPM 700 from den.
So i imagine that 9 and 10 were desktop computers?, and as it states in the warrants that 8 was the Dell laptop. Why would MM say he took the tower without the actual computer i wonder? Or did he take the actual computer as well? And when did he take it and then bring it back for LE to take it from the home according to the SW?

Yes the e-machine and the HP M700 were both desktop computers. Mike apparently only took the tower, nothing else, not even the cord. There was a laptop found, but I also have notes about other laptops that are no where to be found (that I know of yet)

From my notes during Schroeder's testimony:

DEVICE 1 - asus laptop. do you have the owner's name? State objects, requests to approach. Sustained on beyond the scope.

Device 3 - dell inspirion laptop computer


No clue what Device 2 is or was. There is mention of another laptop though... were you ever able to find Giuseppe black? Joseph's laptop computer,ever find any evidence that the computer existed? (I don't have a note to whether he answered or if there was an objection)

None of the family (including Michael McStay) placed the crosses at the gravesite. The crosses were erected by some citizens who live here in the high desert.

Did HE actually put up crosses or was it the citizens of Victorville? According to the SB SUN Newspaper, it was "community members and businesses, planted 4 crosses..." MM attended the memorial service, that was all.

IMO that was the only purpose of getting him back today. Why else would any of these matters be relevant to the trial?

1. defense wanted to bring in a photo of Mike by a hole in the ground but the prosecution successfully objected
2. taking the computer.
3. the missing laptop.
4. holding out that he was owner of EIP.
5. something to do with his loan in early 2010.
6. his comment about driving by the house on 4th.
7. his truck lights.
8. his cell phone records on 4th.
9. his shallow graves comments.
10. his fall out with Summer and her dividing the family.

I do. I think they were angling towards he would only have said that if he buried them. They didn't bring up any other interpretations so that the jury would think Mike was suggesting someone else in particular put them in shallow graves.

It's called being Open-Minded, as opposed to Tunnel-Vision.

I do believe there is a missing laptop... just based on questions and what has been objected to, etc. Maline seemed to want to pin Mike down on a time of when he took the laptop, was it before or after talking to Dugal type questions... not sure if that means one that is listed on the warrant is "missing" or if there is possibly a laptop that is just plain missing from the home that should have been there.

The statement from Mike about the graves...

This IS in testimony now, I don't think he really denies saying it, when asked about the "..." in the article, he says he maybe paused, he maybe said something else that was omitted... he's really not sure. I think at the time he was playing every possible scenario in his head, as most that were close to the family would... doesn't make him guilty, but it is coincidental. There are many reasons he could have said that, I wish he had a better answer as to why he would have phrased it in that way.... could have been a tip, could have been different things he had been reading around that time, could have been from crime forums.

Joey's ex and her new husband...

The judge sustained that objection ... it's on Day 32 Part 2. I think he may have left the door open if something else comes up... can't recall, but I do have a note that it was sustained.

He is not convicted Yet. The trial isn't done. And yes, LE charged the killer with the murders of the McStay family.
There is no other information by LE anyone else is involved.

Would you agree that it's a good idea, in criminal prosecution and any other endeavors, to keep open to any possible new information, instead of locking oneself in to what has been obtained?

I recall reading somewhere, that CJ had it in storage in AZ and after she turned it over to LE, they arrested CM.

Is there anyone here who only heard about the two adult shallow graves comment for the first time from this testimony? If so, I'm curious what your reaction was.

Are you sure about this? I recall that CJ had a laptop in storage but it belonged to CM, not Joseph.

Better find and tell the source, otherwise it could be rumor. Was it mentioned in the trial? Sounds like it would be a small scale bombshell.

They weren't discussing everything they were questioning Mike and inferring he did it. I don't know why there is a reluctance to admit this obvious fact. I'm not saying it's wrong it's just a plain observation of the defense's tactics.

The prosecutor said "let's talk about the elephant in the room" did you kill your brother?

The list of 10 issues the defense raised was not about anyone else.

I don't see the defense trying to infer MM did it. It's MM's own words that made him stand out, as if he somehow had some knowledge about what happened to his brother's family.

Is it possible that both CM and MM somehow had early knowledge or suspicion (with good reasons that we are unaware of) that the family had met foul play, without being actively involved in the crime?

The search warrant was dated Nov 10/14 for that laptop. It was an HP Pavilion ZV6000. I can't tell when they actually received it but the forensics on it was not done or received until the 29th of December 2014, if I'm reading the search warrants correctly.

It's the strangest defense strategy I ever saw.

They had Mike back specifically to infer he did it, so how on earth are they going to put on their case that Dan did it? They remind me of headless chickens.

Maybe DK can't stack up

They do risk a horrible blunder if the prosecution has hard evidence of Hawaii
