McStay Family Murder Trial Day 38 Part 3 04/10/19

With due respect and in all honesty, I actually thought (and still think), when I read about his burglary crimes, that it's possible he committed the burglary in order to help his family. It reminded me of Jean Valjean who was jailed for 19 years for stealing bread to feed his nephew. :)
Did Jean Valjean steal so he could play poker?

Remember one member said just a few days ago, that Chase "lies in everything"?

Chase lies in everything. So why do you believe what he said here about paddling his son's butt?
I don’t believe it is the truth. I do believe he spanked his 4 yr old for hours. But I think he tried to downplay the incident and pretend he did it lovingly with kind words and gentle swats

He has a very bad temper. I believe he was angry and said mean hurtful things to his don snd probably yelled much of the time. And he was not giving him gentle love taps either, in my opinion

yes, I already read that...but she just graduated highschool 2012. How can she be an "expert" with so little years of experience under her belt? LOL It's laughable in my opinion.
She’s quite different than the PT's witness, Professor Poindexter, explaining in a wacky Russian accent why reality really doesn’t exist.

Did you hear what CJ, the mother of his children , said to him in her rant about his cold, callous obstinate behavior?

She wasn’t thanking him for his loving sacrifices for his family. Quite the opposite

She was calling him out for creating the chaotic, crazy tense situation for her and the children

Do you know how uncomfortsble it is for young children to live in that kind of dysfunction? And add that to having a parent addicted to gambling and bring in financial stress every day?

And then to spank a 4 yr old every 5 minutes for 2 hours? Unreal

I cannot believe that those kinds of actions—being in snd out of jail for parole violations, ripping off multiple clients and facing lawsuits over it, facing thousands of dollars in unpaid taxes , not paying monthly bills and rent but spending thousands in casinos, often several times a month, even while facing eviction——

All of the above, and some want to label him a loving caring father? It is a riddle to me

IMO, It's all trying to defend the indefensible.

for those that don't want to listen to all of Dr. Perlin's stuff..the cross exam of him doesn't begin until Part 4...which hasn't been uploaded yet by L&C.

People in desperate situations do desperate things.

I’m reminded of the recent Caneiro murders in New Jersey.

In that one, a man who was in business with his brother, had been embezzling from the companies that they shared.

When he realized the the wheels were about to come off the gravy train, and he was about to be exposed, he massacred his brother’s family, and tried in vain to make it look like a mob hit.

CM was a little smarter in regards to how he carried it out, but I’m confident that he will pay the price here.

Thanks for the quote. Well, guess what, I didn't even expect this, but: I have a better opinion of Chase than before I read this. It reinforced my opinion that Chase sounds like a loving father (recall the discussion on that a while back?).

Honestly, when I mentioned I've known men who beat their children but were some of the kindest men, those men didn't even sound so loving to their children as Chase.

People see what they want to see. If you want to believe Chase is a violent man, you pick the "I paddled his butt", but to me, that's nothing, not even close to the violence that could progress into murder. Absolutely Zero implication here. The only thing this tells me is Chase seems to be a loving father.
Oh wow, for real??? Never heard of sending a naughty 4 year old child to his/her room for some time out? Or removing a favorite toy until they do what you require them to do? You know, things like that where there is no hitting involved, but you can still get the child to do whatever it is you need them to do.

I was just looking for it! wow, that was hard to "listen" to a power point presentation LOL

I am still fascinated with the technology though! Wish we had the actual video as it would have been way easier to understand.

Has anyone actually listened to the testimony that came out today?

I am only partially through it and have not been able to take notes or anything, but I have to say, I'm impressed with the technology, regardless of what it says or doesn't say in this trial. The fact that it can take DNA that would be discarded or considered inconclusive in a regular lab and can develop profiles has to be a good thing for the justice system as a whole.

I still have no idea what the results of the testing is yet, but amazed at what they can do. JMO
I have to admit, I just couldn’t follow it. I could have gotten rudimentary foundation if I could watch it. But listening to it makes me feel old, like I am. Lol

Katy, you CAN'T be old. Either that, or you've had a brain transplant. You have a good thinker, in my book.

For real.

And it was my opinion, so why the "???"?

I stand by my opinion. I actually didn't and don't know much about what kind of a person he is, but, I repeat: that account actually made a positive impression of Chase on me. He sounds like a loving father.

Nope. But his lack of a criminal history doesn't mean he is less likely to have committed the crimes he standing trial for.

His lack of (violent) criminal history certainly doesn't mean he is more likely to have committed the crime he is standing trial for.

I had to read this over and over to try and process the conclusion that you come to.

Are you around 4 yr olds very often? If so, can you imagine spending 2 hours spanking them repeatedly? Seriously, does that seem like a loving thing to do? It seems abusive to me.

4 yr olds are fragile and they have very short attention spans. And they are very sensitive. There is no way that little boy saw that as a loving experience with a loving father

I think it explains his motive for the murders.

It's imaginable that someone who accuses Chase Merritt of murdering a family of 4 could accuse me of killing her. I can see how easy it would be to transform the image of me into a cold blooded violent killer in no time.
I am seriously confused.

CM IS accused of murdering a family of 4. By the California courts, not by websleuths.

According to forum rules, that means we can say whatever we want about his guilt. We're not the jury, we're not required to hold to the principle of innocent until proven guilty. This is a court of public opinion, not a court of law.

If you want to argue that he's not guilty, fine, state your reasons, but be aware, most other posters won't be persuaded by you, because you're not LE and you aren't the team of prosecutors.

I will admit... I didn't try that hard to follow it Dr. Perlin's, I listened, but didn't even take that many notes because without the visual, it was pointless lol

This is what I learned today...

Christine Nash from Bode Technology...

They got some dna on 4 items to put it simply. It was degraded, I listened earlier today, but IIRC she said it was consistent with DNA that was exposed to the elements. When asked about them being contaminated with people processing the scene, she explained that if the evidence was stored properly, they would expect to see 'more' DNA, or more complete DNA profiles. (all paraphrasing, because honestly, I'm not listening to all of that again if I don't have to haha)

When the samples were sent to them, CODIS search was requested, but they (the defense) decided to forego that. Bode lab themselves do not have access to CODIS, but they can request it from another lab before they start processing the evidence, that other lab has to come and access the evidence or something first as well. It makes the process longer, no clue how much longer, but it delays the process. April 9, 2018 skip on the CODIS... her report was done June 18, 2018.

In regards to the above... I don't recall all the pre-trial stuff, when it was supposed to start, when delays came about, I could go back and look in the old threads, but does anyone know .. in April 2018, when did they think the trial was going to be?

Beatriz Pujols - Cybergenetics

She ran all the computer stuff lol There is way more to it, anyone that is interested can read it for themselves. Her work was reviewed by 2 other analysts, and then Dr. Perlin. Her report is dated January 11, 2019.

Dr. Mark Perlin - Cybergenetics

I mentioned it in an earlier post, but will mention it again, 90% of Cybergenetics work is with the prosecution, other 10% is defense, post conviction, family testing for paternity. The software TrueAllele is in crime labs, and of course, in that case it's 100% for the prosecution.

THE RESULTS:
I am not going to give the numbers, they were somewhat confusing, especially without the visuals.

They went through the exclusionary statistics for the following.
E15 - electrical cord ( I believe this is the one around neck/head based on the photo I have)
A3 - left bra cup - was in grave
E11 - white cord - was around Joey's waste area I believe
A25 - strap
When McGee asked him "does this mean he is excluded?" Perlin's answer was 'no, it means there is a statistical support to him being excluded'. (I believe this is wording they use with the probabilistic genotyping)

They were able to make DNA CODIS profiles for some of the evidence, which can be used to do a keyboard search in CODIS. If they were to get hits, they can then go back and check the probability like they did with the other known samples earlier with the McStay's/Merritt's DNA.

There was a weak association between E09 (right bra cup) and E01 (white cord). E01 didn't have as much information as E09, that is why it's considered weak. This must the be the 'crossover' that was referred to in that article the other day. Those processing the scene... if one processed one and another processed the other... how did it get on both? I can't recall at the moment if Jones did all the swabbing of evidence himself or not, but he may be the only one that touched both, IF they are the same profile and IF it was contaminated during or after the discovery JMO

Cross exam of Dr. Perlin is not available yet.

I'm not of fan of intervening much, but if I had seen an adult spanking a four year old every five minutes for two hours, I would have reported him. I'm not against spanking in general. I think if a small child runs into the street, there is a case to be made that a swift "spank" -read, on a fleshy surface, like the bottom- that makes a child stop before doing it again (or some other situation where they absolutely cannot disobey the parent without coming into danger- is okay. However, I think it goes without saying, that "hitting" -in other words, in a place or hard enough to cause damage, isn't proper, because the goal is to stop the child and protect him/her from real danger, such as a car.

There's nothing at all appropriate or positive about the repeated spanking or hitting of a child -especially a four year old! That is just beating him/her. Not to say that a child certainly couldn't overcome such. Many of us have overcome that and worse. We go on to forgive and to love even. Some children survive horrific abuse and, indeed, ultimately love and care for the abusive parent. That doesn't make it okay, though.

It seems strange to even be discussing this. It simple astonishes me that anyone hearing Chase's interview couldn't have come away with the idea that he's a monster. He preys on people, abuses children and animals, and steals from the very people who help him, all the while neglecting his own family. I know, I know: Where is the proof that he abuses animals? I'm quite inclined to believe it, as it is consistent with the other criminality and reports of violent behavior -hitting walls, children, etc.

I continue to follow the discussion here and watch/read regarding the trial testimony/evidence, but the totality of evidence fits together to point to a very guilty Chase Merritt. And Chase's stories and the anecdotal comments of various people who have come into contact with him over the years are the surrounding and supportive pieces of the main puzzle.

All my opinion.

Answering my own question since it was way easier to find than I expected LOL The prosecution asked the question about when the defense decided to forego the CODIS request, and she said it was April 9/18. Looking at that date now it sounds like they would have had a lot of time; however, according to this post from Mica on April 26/18, the trial was scheduled for July 30/18 at the time, so I can understand the need to get it done sooner.
