T. IMO the jurors have made up their minds by now, one way or another.
Time to allow them to deliberate. MOO.
I reckon the prosecution will subpoena Ms Riccobene. And maybe Dan's girlfriend at the time, Lauren I think her name was.

Or perhaps someone to talk about IP addresses.

I totally agree with this. When the two youngish sounding females jurors addressed the judge, the sounded very casual and relaxed. I think they have made up their minds. Gotta say, I am kinda worried they have settled on a not guilty verdict (just my analysis on their voices and the two or three sentences they spoke, LOL)

You could be right, Mony. But it's time to go with it ,IMO.
Been long enough.

McGee is still not back? Maybe he is having a crisis of conscience.

IMO, an older person, white, middle class, residing in the suburbs, that views LE as righteous and beyond reproach, essentially, a person believing the BS portrayed on the old TV show Dragnet would be the person voting guilty.
A younger more open minded, likely a minority but not necessarily, and views LE with skepticism and is aware of the malfeasance they're capable of is going to be the juror voting not guilty. Now, only if we knew the makeup of the jury some insight could be had.

Yes, I think he feels he has not come through for his client and let him down.

From what I read in chat today... he is seriously ill or has been diagnosed with a serious illness. A few weeks back, right before they took that long break, McGee had made a comment about being at the doctor on a particular day and he would not be available for a hearing. It sent off bells in my head back then lol

So although we all love to hate defense attorney's, I don't think we should really make light of it unless we find out he just had the sniffles, which I do not believe to be the case. Even the prosecution was noticeably subdued last week when Maline/McGee wanted to speak to the judge in private. It seems that it is not really affecting the trial, Maline seems to be carrying on without McGee, but I just don't know the legalities of it all. Maline being death penalty qualified seems to be in question? If this could be an appeal issue later? Even if Merritt agrees to continue now, does he understand the impact? And then could it still be appealed later?

I am a fan of McGee, I think he is a better talker than Maline and I just imagined McGee doing the closing. And I think this case could come down to the closing arguments. JMO

I, for one, do not hate defense attorneys. My father was a well known, well respected defense attorney, as was my older brother.

But I do know their tricks. :-}

Thanks for the info, missy!

I don't believe McGee is pulling a fast one. I think he is seriously ill. :( He was doing a great job and there's no reason at all, from what I can see anyway, for him to want out at such a late stage in this trial! MOO

They were speculating today that it is either cancer or something with his heart. Someone in chat claims to be in the know. Take that for what it is worth, since in the end, we are all pretty much anonymous.

Hate to read that this young man is seriously ill, and I would never make light of it. He is by far the best on the DT. However, it does appear to be affecting the trial, IMO.
Maline seems frazzled and disjointed at times. Kinda feel
for him as he is left holding the bag. And, IMO, CM is disgusted and feeling let down. Seems they are going out with a whimper and not with a bang.

Cathy Russon also said something about it. I know she has someone in the court room that keeps her updated, maybe the camera guy? someone else? If she is in chat, she will let us know that the jurors are on their way in... today she said they were taking notes...

Perhaps, but if so, it is not really due to McGee’s absence and more because the facts of the case are not really on their side. Besides, I do think they’ve made some headway. I no longer think that could have been Chase’s vehicle, based on the 60” high light on the back and the explanation of that witness today. He was a terrible witness, but what he said made sense (to me).

I don't think Maline is any different than he normally is. He did seem way more comfortable questioning video guy today, but to be fair, last week he did what he could with the witness because he was not his witness so he needed to get up to speed, which it seems he did. Maline has a different way of questioning... and I find he does a lot of uhmm's and ahhh's and not really stuttering, but stuttering haha

I really can't wait to see Dr. Rudin's testimony. I want to see what he came up with after getting the Faro Scans. From the 402 hearing, he said that once he had the info from the Faro Scans, he was actually able to give the angle of the camera on Mitchley's front porch! (fascinating to me lol) The guy did it on his lunch cuz well... he had nothing better to do LOL

In that 402 hearing... Dr. Rudin had that back light matching to Merritt's truck back light... I think it was after Dr. Rudin did more calculations that the State had to switch gears and it was now a "reflection" on the latch.

The guy that testified for the defense... what I liked is that he actually showed it with the side cam view as well, I don't believe Rudin in the hearing anyway, or Liscio did that (but I don't 100% recall on Liscio)

IIRC I was more convinced with Dr. Rudin's 402 hearing testimony that it was Merritt's truck.... they lost me when they put Smith on the stand saying oh it was a reflection. JMO

Rudin is going to be fun regardless... he has no filter LOL

Yes, unfortunately I must agree. A knowlegeable, younger person may not have the life experience of an older person that would confer wisdom.

Yes . He did have periods of confidence. But he can't seal the deal without his wing man.

Well if McGee is too ill to return, IMO, they should scrap this trial and start over. Although I believe the two timed felon is guilty AF, he deserves a complete defense. It is a death penalty case. I don't want to see a window for an overturned conviction on appeal due to McGee being unavailable.

I went back to Thursday's video. The judge said they would move Dr. Rudin to Wednesday and they should have an update on McGee's condition then, and in the event he is unable to proceed, then it would at least give Maline time to prepare to question Rudin since it was not his witness. So maybe we will get an update tomorrow :) I went back to look because I recalled something about "Wednesday"
