This makes a lot more sense as yes they fast for about 15 hours of the day. They don’t eat or drink during daylight hours.

Thank you. She may be planning a trip abroad where she will be during Ramadan.

andddddd on re-direct already lol

Didnt
He briefly mentioned compression artifacts in his original testimony, I believe he wanted to study up on the technical aspects of video codecs and any anomalies associated with them. This way before giving a detailed explanation he'd be sure to be accurate in his testimony.

I believe the vehicle shown in the video is a truck or SUV, it's too high of profile to be a car. The defense is aware of this but like me they don't believe it's CM's truck because the lower side marker light wasn't present on CM's truck but perhaps, MM's truck did have a lower side marker light.
Didn't MM have verified alibi for the night in question?

Finally on re-direct it is addressed that Joey made payments to 3rd parties on Chase's behalf, and that it cost money to make the fountains!!!!!! It's like the State doesn't want to admit that it cost money to make the fountains....

  • #345
Of course JM had to take over and pay for supplies/fabrication, etc because Merritt was blowing all his own money at casinos. LOL
Jeez Louise.

He didn't say "take over".

This was already covered at length in evidence in chief

AFAIK it is not an area that is in dispute.

Joey floated the production out of Chase's end.

So under the 65% arrangement, Joey would pay a supplier and then debit that against Chase in his running ledger.

Yes but he didn’t give Chase cheques to pay off the 3rd parties did he?

Joey paid on his behalf!!

Do you know why the judge didn't allow the prosecutor to say wtte 'if we've heard evidence that he told someone he owed Joey that money for Provecho blah blah'?

Is it because he wasn't under oath when he said it in the jailhouse tape?

Do you have the link at time code for that specific exchange?

  • #352
This "forensic accountant" for the defense is a LIAR. When he knows the true answer is not one he wants to provide, he diverts and tries to cloud things up every time. Wonder if he has any political motives in SB County.

It seems it wasn't objected to as I thought. I must have been remembering something else, if I come across it I'll post.

Ah ok, I thought it was objected to and went to sidebar.

That second question, I wonder where it came from, maybe it was in an email not in evidence because I hadn't heard it before.

There is something strange yet critical about the Provecho business.

In the jail house tapes, Chase clearly tries to arrange manufactured testimony from CJ via "Raj" but admits to getting the money and that he needed to pay Joey back.

Then in CJs EIC, "Raj" tries to get CJ to say 3 x that Chase wouldn't have got the money.

Yet then we find out forensic man has been working on new stuff at the last minute and includes admitting that Chase had this money all along but didn't need to pay it back.

Somewhere Chase has changed his version in recent weeks

Again why does this all matter so much to him?

This is nuts!!!

DK was in HI, he has an alibi. He DIDN’T bludgeon to death a father, mother and 2 babies. Place their bodies in shallow graves near where CM lives.

CM is on trial and the evidence points to him being the murderer NOT DK.

Such BS to be going over and over DK’s financial stuff.

Just BS and waste of time. Defense can call DK and ask him these questions.

This CPA is clearly trying to help The Defense.

I surely hope the Jury sees through this crap!!!

JMO, IMO, MOO

AFAIK it is not an area that is in dispute.

Then why does Rodriquez keep asking and implying that Merritt actually received the 65% and spent it in the casino? He did not actually "profit" 65%. He had to keep saying that payments were made to a 3rd party and it was reflected in the ledgers. I do believe that it's the payments listed on the bottom of the ledgers.

Yes but he didn’t give Chase cheques to pay off the 3rd parties did he?

Joey paid on his behalf!!

I didn't say that is what was said, because that's not what happened. Chase got 65% of the price of the fountain MINUS the costs. If it cost 50% to make the fountains, he would get 15%. The lower the costs, the higher his profit.

If called I believe DK will take the 5th. For this reason I think it would be a good strategy for the defense to call him because if he does take the 5th in front of the jury it will seal the deal for the defense.
This CPA is clearly trying to help The Defense.
He's a defense witness. Do really expect him to help the prosecution?

IMO Because the State is using money and Merritt being cut from the business as a motive to kill Joey and the family, it's only right that others with those same motivations should be examined.

Whether Dan did or did not do this, LE did not investigate Dan in this regard, even with the knowledge that Joey was cutting Dan out (from Susan and from McG) and whether Chase was or wasn't being cut out seems to be up for debate IMO. Dan's paypal and bank records were subpoenaed by the defense, the lawyer that dealt with the sale of EIP was questioned and subpoenaed by the defense. THIS is the defenses defense in this case, that they focused solely on Merritt and made the evidence fit to their theory and ignored all others. Now, I know I'm going to hear 'but he was in Hawaii and it was verified'... my answer to that is, how? what verification was used? It wasn't the paypal records because they just got those 2 weeks ago. And it would not be the first case where a suspect "appeared" to be somewhere that they weren't, or the alternative that they hired someone to do it while they alibied themselves elsewhere. I'm not saying that is the case, but I do not see that they ruled that out either, and it does appear that Dan profited more by the family disappearing than Chase did. ALL JUST MY OPINION!

I don't think either side is calling Dan. As much as I want to see him hit the stand.... I don't think either side will call him... it's unfortunate, I wanted to see him squirm. JMO

According to information previously introduced during the trial, Merritt and Joseph divided the gross revenue between them along a roughly 60 percent to 65 percent/40 percent to 35 percent split, with the lion’s share going to Merritt, though with the proviso that the materials and equipment needed to manufacture the water features were paid for from Merritt’s share of the proceeds.
According to a spreadsheet that Joseph had created and which LaRock recovered, Earth Inspired Products in 2007 had a total income of $330,375.97, of which $204,666.98 was paid to Merritt.
In 2008, according to a spreadsheet that Joseph created and which LaRock recovered, Earth Inspired Products had a total income of $342,099, of which $224,615 was paid to Merritt.
The spreadsheet that Joseph prepared for 2009 that LaRock recovered from the computer was incomplete, running only as far as the end of January of that year. However, LaRock was able to find a spreadsheet that cataloged the company’s 2009 activity that Joseph McStay had uploaded to Google Documents. It showed total income of $297,954, with $158,210 going to Merritt.
