Merritt wrote and deleted cheques in the custom account. Joey used the contacts account for cheques and vendors, well everything.
BBM, So does that mean the info. in the Prelim was wrong?
(quote)
A Yes, there was. The original account, the Contact
account that was created in 2004, had a mixture of Joseph's
personal finances as well as his business finances.
The Custom account was strictly business, but he was not
writing checks from that account.

It's correct - Joey was not writing cheques from the custom account.

Maybe you're thinking the he in that sentence was referring to Merritt?

And further
(quote)
Okay. With regard to the Custom account, were any checks
from, you said it was opened in January of 2008, from January of
13 2008 until February 1st, 2010, were any checks listed on
QuickBooks or written from QuickBooks on the Custom side of the
account?
A On the Custom side, no.
Q So, all the checks during that time period were listed on
the other account?
A On the Contact account, yes.

It's all confirming the same thing Karinna.

Joey used contact, Merritt used custom.

Yes i did, because of Merritt being in the Contact account on 1st. Feb. adding his name in lower case letters.

THE WITNESS: Okay, on February 1st, 2010, at 12:24 P.M.,
Joseph McStay, the user Joseph McStay added Charles Merritt as a
vendor. The next activity was at 12:34 P.M., where there was a
check made out to charles merritt, all lower-case letters, for
the amount of $2500
. The memo line on that one said: "deposit."
Q (By Mr. Daugherty) What else did you see happen on the
1st?
A At 12:37 P.M., there was another check added to charles
merritt, for the same amount, $2500. The memo line also stated:
"deposit."
Q Is that all lower case under charles merritt?
A It is.

Joey used contact, Merritt used custom.
Getting myself confused LOL, because of Merritt being in the Contact account on February 1st, 2010.

Merritt was in the custom account on 1st Feb adding himself as a vendor.

I'm not sure where you're getting contact account from that snip.

So I think we're almost on the same page now, except for this bit :D

  • #910
Its really good that Chase is that stupid he added himself using all lower case lettering.

Something Joey had never done so you can tell straight away it’s not Joey doing it.

BBM, Probably my assumption because Merritt was in the Contact account adding himself as a vendor in lower case letters on February 1st.
And in this snipped quote apparently February 2nd. was the first check written on the Custom account.
(quote)
On February 2nd -- and just so we're clear, this was the
first check ever written on the Custom side of the QuickBooks
account?
A That's correct.

That part is wrong - he was in the custom account adding himself as a vendor.

Okay, we will just leave it at that then Tortoise, :)

Joey used contact, Merritt used custom.

This is what I would have expected Forensic dude to explain

How did Joey enter and code his cheques to MSM and Chase for business accounting purposes?

And why therefore would they suddenly be created and deleted in custom?

This part makes no apparent sense but if alternative accounting were real the defense surely could have explained this by specific reference to course of dealing

Apologizing for off topic question, but what materials will the jury have access to during deliberations? Will they be able to see any of these transcripts or do they have to rely on memory alone? The written transcripts here are so powerfully persuasive as to Merrits guilt and would be helpful to pursuade any undecided jurors during deliberations.

First hurdle they need to get over is that Joey was busy making and receiving phone calls while all this new activity (creating new vendor, printing and deleting cheques) was taking place on February 1st.

Not off-topic at all! They’re getting close.

I’m not an expert, but I believe that they’ll have their own notes with them. I feel confident that they won’t have the court transcripts with them, but I believe that they can request specific parts to be played back—they’d have to ask the judge.

Anyone who knows more, speak up!

Thanks wary. I know they can request readbacks but the written words are so powerful Maybe not on here lol but in the real jury room

I'm expecting the prosecution to hammer home all the salient points they will need to remember for deliberations, in their closing argument.

That's when any clouds will clear, IMO.

I don't think they get court transcripts but if they wanted to listen to a part of the tape of his interview again I believe they will be allowed to do that based on other trials I've seen.
