He would not have a case. But, pretending like he did have a case he would have to prove that what's been said was untrue and then he'd have to prove how he was damaged.

So what would you say about DK (re the other poster's similar question?

I've said all along I wish they'd take the death penalty off the table. California will never put Merritt to death and taking it off the table would simplify the case, in my opinion.

If God forbid a mistrial is declared then it will take us beyind the ten year mark for justice for the Mcstays.

He wouldn't have a case either. I answered that question earlier in a comment up thread.

#McStay - Maline asked if they verified what Kavanaugh said he took against Joseph McStay's PayPal records to see if DK was telling the truth. Bachman said, "I'm sure we did," and mentioned again there were other detectives on the case.

#McStay - Bachman was asked about Dan Kavanaugh accessing McStay's PayPal account within a week of the family missing.
Maline: Did you confront him about the timing of the withdrawal?
Bachman said he doesn't know when they asked but is sure they did.

Does anyone think that after Maline asked the Judge for an ex parte hearing in the Judges Chambers this morning saying it was about McGee. Does anyone think McGee may be asking to withdrawal form the case do to medical reasons? If this is granted by the Judge, do you think there could be a mistrial since McGee is the only Death Penalty Qualified attorney on the defense team.
Personally I don't think he's asking to withdraw. I think that would have been heard first thing in the morning before they started the session.

The testimony by La Rock on the phone records supports Chase's account of having lunch with JM and discussing the new business deal during/after lunch. JM continued to make phone calls to CM on his way home from the lunch and they seemed to be working with the Google Sketch stuff:

Joey was online constantly and as soon as he basically leaves lunch after being with Chase for nearly 2 hours Joey is back on the phone with Chase.

There are no eye witnesses to the lunch and I haven’t seen any lunch receipts for it.


I think Joey was due to meet Chase for lunch and Chase being gutless didn’t turn up knowing that Joey knew he had stolen off him. IMO

I imagine the defense would at least file a motion for such as their Hail Mary.

Personally I don't think he's asking to withdraw. I think that would have been heard first thing in the morning before they started the session.
But perhaps McGee realized he couldn't continue.

If Chase is found not guilty, can he or his family members have a case against libel, rumor spreading and character defamation against him or his family members?

I’m not a lawyer, but I think they’d be unwise to try it.

Not Guilty means: beyond a reasonable doubt.

The civil court judges ‘by a preponderance of the evidence.’ So, he’d risk being found guilty in civil court—which would be embarrassing. (In civil court, OJ Simpson was found guilty of the wrongful death of two people, even though he’d been found not guilty in the criminal case.)

I'm pretty concerned about it, McGee hung back at the sidebar and was sitting by himself at another table this morning, like he's unconnected. I don't know how anyone will be able to take a mistrial at this late date.
I thought that about the seating arrangements but then I thought it was probably due to the set up of the courtroom because the prosecution was off camera nowhere to be seen.

Do you think Chase went directly to the Fallbrook house and waited all day for Joey to return?
