IMO, the reason the prosecution did not use Rudin is because Rudin was unavailable when needed. At the end of the hearing, McGee asked for a delay in Rudins testimony and the prosecution wanted him on the stand the very next day. They all discussed Rudins schedule, and he had a lot of unavailable days.

In the end, IMO, the guy they eventually used to testify regarding the faro scans was a much better witness. His answers were clear and concise. Rudin goes off on tangents and can be confusing. IMO.

Any wagers on whether McGee will be ready to proceed with Dr Rudin today or do you think Maline will ask for another delay?

You can believe that if you choose to but that is not the case. I have been involved with personal injury litigation for 40 years and have been involved in many trials ( I am not an attorney )- I can tell you without any hesitation, that juries make many of their decisions based on whether they like or don't like the defendant: if a juror believes the defendant is not truthful, they don't like that. Trials are always about more than evidence. Choose to believe it or not- We have had good cases that we could not take to trial because the plaintiff lied in their deposition (usually about stupid stuff),but we knew that if the little itty bitty untruth was brought before the jury, we would lose the case. We had decent facts and the plaintiff sustained damages and injuries due to the defendant's negligence, but credibility is a huge element in a trial. Of course evidence is important, but it is not the only factor in the overall picture of a case and a trial.

Thank you for the input. This explains why the thread is flooded with negative talks about CM's character, especially as the trial approaches its end.

When CJ said CM cares about no one it shows he was perfectly capable of murdering the McStays, and never blinking an eye.

Really? I've said so-and-so cares about no one, and I've heard other say it about others, I doubt it shows those people being said about were perfectly capable of murder.

Imo, the DT has done much more to help the state's case than helping their guilty client. SMH

The jury has so many ways to weigh CMs lack of moral character.

The jurors are all adults with life experiences. I trust they can make their own judgement independently.

Merritt himself tried to minimize his criminal record by saying he did things when he was much younger and everybody has a record, or words to that affect. In my experience jurors are responsible upstanding citizens who might not have so much as a traffic infraction let alone a criminal record. Indeed, their own life experiences may be Merritt's undoing.

Maybe it was always a ploy by the defence to allow in his criminal history and give him grounds for appeal later down the line, if they thought his chances of an acquittal were so poor. That could be twisted into ineffective assistance of counsel I imagine.

I totally agree wth your last paragraph. The jurors will be able to spot a pathological liar, and one who gives inconsistent statements.

I have no doubt they have also had the unfortunate life experience to come in contact with this type of individual.

That is why the prosecutors often tell juries in closing to pull from their own personal life experiences when weighing the evidence.

Imo, and they will ...just like any reasonable minded individual does in their daily lives.

They will know what evidence adds up, and what doesn't. What makes more logical sense, and what doesn't based on the evidence presented to them.

I don't think coming in contact with a lying and thieving conman with multiple felonies under his belt is interesting. I think it's scary as hell.
