it is... it was in response to Cathy's tweets from earlier in the day, and it said that Boles was on the stand again. Court was only in session for 1 hour this morning, and they weren't starting until 1:45PT this afternoon, reason given was because the defense wasn't given the FBI cell tower data for Feb 6/2010

*I would have liked to have heard that argument between the lawyers LOL

ETA: for Feb 6th

Didn't Boles say no handoffs were in his report- only original requests from phone to tower? My notes are scribbly.

Suprised the Judge has let this sham continue..

There is nothing on Merrit. If he did it, they did an awful job of trying to convict him of it and without evidence the truth doesn't matter it's only what's proven and they haven't proven anything close to a quadruple homicide. Why has the defense not asked for a dismissal?

I am sure they will. But how can they do so before all of the witnesses have testified?

Despite that thanks to Cathy Russon. Otherwise we would be in limbo today.

I can't find anything searching Twitter on anyone tweeting from the courtroom, I did find this from Linda Kenney Baden, it's the last tweet showing with the hash McStay:

Goo 4 defense- that portion of tower received the ping. Historical cell data the weakest BTW for location.Could be a hand off from tower further away depending on lots of factors. The original reason for pings BTW was related to billing tel co to tel co that operated tower.#mcStay

Linda Kenney Baden---in my opinion, she is very biased for the defense. Always has been, in all the cases I have followed. JMO

I don't understand the point you are making, about him gambling before Feb 4th. Is that helpful to the defense in some way? I don't think it is , at all.

To me, it just means that he was digging himself a bigger and bigger hole. And Joey had been paying him less and less, because Joey had to farm out much of the welding work, and had to pay MSMetal a larger amount.

So the fact that Chase had been gambling for quite awhile, to the tune of thousands of dollars, and was behind on rent and bills, and even began missing work to go gamble, is a strong potential motive, in my opinion. He thought he could begin draining Joeys account and also keep the checks that were coming in, like the ones for the Saudi Deal. JMO

Also, he had screwed up and began creating checks for himself, and was possibly worried about Joey's reaction. Could it send him back to jail?

It's a fact. The gambling was not a new issue, this was something that he had done for a long time. I don't know if helps the defense or not, I'm stating my opinion.

I don't know if he was behind on rent and bills, do you? Do we have proof of that? I know he said it in his interview, but I know as much about his rent being paid or not as I do about his heart attack that he may or may not have had. I was actually curious about his rent, but I don't recall seeing anything on his bank records that resembled a payment, wondering if it was paid from CJ's account or if he paid cash?

As for MSM they had an agreement with Joey. According to Sequieda... Metro was going to do all the sheetmetal work, Joseph was selling and handling whatever invoicing, and Mr. Merritt was going to do the plumbing, the pumps that operated the water features, the electrical, etching, rocks, tile, etc. and he was going to videotape them, crate them and ship them. (Day 8 Part 4 12:50)

It was implied by Sequieda that he was missing work to gamble, but I don't know this. It was also implied by the defense when questioning Sequieda that he was busy installing fountains or something like that, but I don't know that either. I would like to see the proof to believe either side. The prosecution could get Smith to make some new charts showing all those days he was at the casino's in January. The one's he did, don't show many days in January (3 times that I would feel confident saying he was definitely there playing, the 1st, the 12th, and the 20th - found on Day 22 part 2 30:00), but I am unsure if they are complete.

Enlighten me about the Saudi deal... what did he make off of that? Who did the Saudi's pay? How much was the fountain, etc? How much of what the Saudi's paid went to Chase? I don't know much about the Saudi deal.

Again... all just my opinion :) I respect that some think the gambling is a big deal, I think I just have different view, possibly because I do gamble, don't think it's that big of a deal, might be seen as a waste of money to some, but meh! I have read comments over the last few weeks about the gambling that make me hope that no one ever has to look at our bank records LOL I think it was ocean that said, who stops at the casino when ill. uhmmm we did once! LOL Hubby was stuck in hospital for weeks... he got out and wanted to stop, so we did! Different life experiences bring different views on things and what is a big deal to some, just isn't to others.

I wonder how the court feels about no live streaming/YT videos? We've heard more than once references to the defense being able to have their experts watch the stream or a replay when they can't be there in person to hear the testimony.

Maybe they'll do us all a favor and not hold court until the camera is brought back (rose-colored shade-y thinking there).

Yep, everytime the defense says "we want our expert here" , the prosecution says "they can watch it online or on you tube". The stream has been so bad at times though, no way would I want to rely on it. The you tube clips are edited.

That's what I thought. It would be detrimental against him instead of helpful.

If its brought out how much he had gambled heavily throughout the years, and kept it up, maybe even increasing his trips when he began working as a sub for Joey it will hurt him. Imo.

It shows a pattern, and how his money was shrinking, but NOT his gambling addiction. That can become a very dangerous combination.

As you said, his pay was dropping due to no one's fault but his own.

Maybe his addiction had become even worse with each passing year, and he spent even more time at the casinos gambling instead of welding like he should have been.

Something sure happened for CM to be reduced to doing work anyone could do, most likely for far less than what Joey still paid him. But of course it's hard to make a living welding when he's else where.

His money was much less, but his gambling addiction was soaring. He was running out of ways to feed his addiction.

When any addict of any kind gets desperate, and are running out of options to feed it, sometimes they will do anything to feed that addiction, even resorting to murder, and stealing the dead man's money.

This sure wouldn't be the first time it's happened when other victims wound up being murdered by addicts, and that was the motive.

The evidence about his gambling patterns are extremely on point, and of great importance. It clearly goes to his motive.

All of it matters. His consistent pattern of gambling away thousands before the murders.

What did he do with the money he stole concerning Joey's QB?

What did he do with all of the money he received from the SA money?

Where did the money really go that Susan Blake loaned him, with his promise to pay her back, but never did?

If most of those funds were spent at the casinos by CM, he is going to be in a world of hurt.

I don't think the jury will take it lightly that he scammed Joey's own mom out of thousands. To do that, to the very mom of the man he had murdered he had to be beyond cruel, and cold as ice with no conscience.

He better hope he can come up with receipts showing he donated thousands to some non profit organization during these important timelines. LOL!

We already know it wasnt spent on rent or food to feed his family.

Follow CMs money!

Speaking of LKB, looks like she may be too busy in the near future to comment on the McStay trial:

Taking it by paragraph. Nothing to say about the first one.
Paragraph 2. I'm thinking he lived with CJ, thus no rent.
Paragraph 4. Why must the PA support Sequiedas testimony? It's up to the DT to refute it.
Paragraph 5 . Saudi deal is a complete mystery. Was it ever completed? Did Chase actually go there? We don't know that yet.
Paragraph 6. To me, the gambling is a big deal. His got out of control based on testimony.
