A complicated legal issue must be settled before prosecutors will be able to amend their case against a Romoland man to charge him with murder in connection with the death of his father, whose body was found buried in his back yard.

Prosecutors are trying to formally charge Gerard John Gallo, 52, with the murder of his father, but have yet to be able to because Gallo has already pleaded guilty to a different count in the same case.

The former dishwasher at Bernie's Deli in Temecula twice was convicted of second-degree murder for the August 2005 death of his father, Joseph Gallo. The Fourth District Court of Appeals overturned the first conviction and ordered a retrial.
