GUILTY CA - Justice Rees, 2 wks, Woodland, 24 Feb 2015

She is scheduled to appear in court Wednesday, but a spokesman for the Yolo County District Attorney's office said that as of late Tuesday afternoon, no decision on charges had been made.

Legal experts said charges could range from the most serious -- first-degree murder -- to child endangerment.

She's due in court at 11 am my time - about 2 1/2 hours from now. The rest of the article is mostly about why Justice was allowed to go home with SG and FR. It's pretty much what we've already talked about - desire to keep family intact, living conditions (grandparents' house), safety plan and so on.

ETA: Hmm, now KCRA is saying the proceedings start at 1 pm. Maybe the DA is still working on charges?

ETA2: News 10 is also saying 1:30, so about 5 hours from now.

While we're waiting...

Wanda Cozart has not spoken to her daughter, Samantha Green, since Green was arrested for the murder of baby Justice Rees.
...
“Justice is not going to have peace, until the truth is known. And you are the only person who can tell us what happened to him. So, so that his spirit can be at peace, you need to do that… and take responsiblity for your part in whatever happened,” Cozart said.
...
“Grandparents don’t have rights. I’m horrified that not all grandparents were made aware by the CPS system, that my grandson did test positive for drugs. Because I held him in ICU,” she said.

Baby Justice Timeline: How The Search For A Missing Mom And Infant Turned Into A Murder Investigation
baby-justice1.jpg

Feb. 21
Green and her son were supposed to visit a family member, but did not arrive. Friends and family posted fliers that following Monday (Feb. 23) to find mom and son.

Feb. 24
Green emerges by herself from a Knights Landing slough, telling a man who lived nearby that she had spent the night there, and that she had been attacked. “‘Just call 911, I was kidnapped,’ and that’s all she told me,” Ricardo Villasenor said. “She said she spent the night out in the slough.” While she said she couldn’t remember who attacked her, she already knew the fate of Baby Justice. “She couldn’t tell me anybody that did, or she don’t remember, all she told me is ‘My baby’s out there, it’s dead. It froze to death,’” he said.

That's a good synopsis. The mystery remains:

That's how it's been reported all along. The mystery is that grandmother R said she last saw SG Monday morning as she (grandmother) was getting the other kids ready for school. SG was reported missing when she failed to pick the kids up from school later that day.

So what is the point about SG not showing up on the 21st (Saturday)? Is it faulty reporting or are we missing something??

I can't find any different time from 11 am Pacific. Frank is to appear in court today also.

The mother accused of killing her 3-week-old baby in Yolo County was transported to court Wednesday morning for an arraignment that is scheduled for this afternoon.
...
The boy's father, Frank Rees, will also appear in court later Wednesday on unrelated charges.

They were both transported early Wednesday morning.

They were originally scheduled to appear at the same time - 11 am PST. I wonder if they now have different times?

Mom accused of killing baby in court today. She's set to enter a plea, but I'm hearing lawyers might argue for that part to be postponed.

Right now, Green is being held with no bond. Her lawyers may argue for bail to be set. We'll learn more at the hearing this PM. @News10_CA

I take it her dad just talked to her on the phone on Saturday, the 21st? Made arrangements to see her and the baby, but they never showed.

Randy Green told reporters last week that his last contact with his daughter took place on Saturday, Feb. 21, when they made plans to visit with Samantha and her new baby. But the pair never showed up.

Grandma Rees said something odd about that, dismissing it as they didn't go visit because "she didn't like to leave the house (paraphrasing because I can't find the article)" I thought it was odd and wondered if there was another reason. It's why I asked earlier if anyone outside the Rees family said they saw her between the 21st and Monday.

Yeah, that's how I took it. Sometimes I think too literally so it bugs me that msm keeps reporting it as part of the timeline - it's not. But it does seem like something unusual was going on that weekend.

I work for Child Protective Services in another state and we do these "safety plans" pretty frequently but we allow children to go back into a home that should have been thoroughly checked with caregivers that should have also been thoroughly checked. For this family I could see CPS allowing the infant to go home with the parents under the "safety plan" that they would remain in the grandparent's home and the grandparent's would supervise all contact between the parents and child. To the caseworkers in my state that means that the grandparents are the responsible caregivers for the child and the parents are only residing in the home to continue to bond and learn to care for the child while they are addressing their substance abuse issues. The concept is that the grandparents would not allow the child out of their sight to ensure safety for the child. These kinds of safety plans are only allowed while the parents are testing clean as well so if either parent tested dirty they would be asked to leave the home or the child would be taken into foster care. I am imagining that either CPS did not explain the concept of a "safety plan" or the grandparents may have just ignored it thinking what could happen if they allowed the mom to take the baby out of the day to give them a break. Unfortunately CPS caseworkers cannot 100% ensure safety for these children even if they lived in the homes with the family so they do the best they can with the resources they have available. CPS cannot remove a child into foster care without a court order signed by a judge so often a judge will not sign that order if there are appropriate family members stating they are willing to step in and help create safety for the child while the parents work services especially if the parents are testing clean. It is a terrible system trying it's best so it relies on the family to help create safety which obviously did not happen in this case.

In the documents, prosecutors charge Samantha Green with involuntary manslaughter. The complaint states that Green killed her baby “without malice, in the commission of a lawful act which might produce death, in an unlawful matter…”

http://fox40.com/2015/03/04/yolo-county-da-lessens-charge-against-baby-justices-mother/

'Our family is grieving not only for the loss of our grandson Justice, but also the possible loss of our daughter Sami Green,' Green's parents, Randy and Laurie, said in a statement released on Sunday morning and shared by CBS.
'She has never been in trouble with the law. We know in our heart that Sami would never do anything to intentionally harm her newborn son Justice. She loved him very much.
'Her entire family supports her through this most unbelievable time in our lives.'

Maybe it's just me, but I have never heard charges expressed in this manner?

Trying to figure out what the hell happened to that baby. The wording is puzzling.

I've worn out my welcome with the Sacramento Bee (too many clicks I guess) but I managed to see that SG pleaded not guilty and her next hearing is March 30. Bail set at $250,000.

The charges are confusing but what I've been able to figure out so far is that there may be no or little prison time. However, since the child endangerment charges are the felony version (versus misdemeanor) that may change the result.

I also wonder if the DA is still waiting for the tox results to come back. IOW, if meth shows up in Justice's labs would her charges get upgraded?

I am so confused lol I am wondering if it means she did not deliberately do anything thing to cause his death such as smother him but she is charged because she endangered him by taking him to the slough to do drugs, where he died???
The district attorney announced it filed a formal criminal complaint against the Woodland mother for involuntary manslaughter, which is not a felony, and child endangerment, which is a felony, with enhancements for infliction of great bodily injury upon a child under five years of age during the commission of a felony.
