Drug-use details emerge in Baby Justice case

WOODLAND — The Woodland woman accused of killing her infant son told investigators she used drugs throughout her pregnancy and in the days leading up to the baby’s death, according to documents filed recently in Yolo Superior Court.

“Samantha Green admitted to using marijuana during her entire pregnancy with Justice Rees,” Yolo County Sheriff’s Detective Rafael Vicente wrote in an affidavit for a search warrant filed shortly after Green’s Feb. 28 arrest.

Green also acknowledged using methamphetamine during the first five months of her pregnancy and on the day before Justice’s birth, as well as “for three days prior to her going missing and her child having died,” the affidavit says.

So I assume that's the issue coming up in the June 18 pre-hearing conference.

(bbm) yes i think so........and as for the rest........OMG :furious: can you believe it? talk about trash! and to think there was a "safety plan" with CPS in place and they let this baby go home with these monsters? and his parents were supposed to be over-seeing this great safety plan???

tell me they (the grandparents) didn't know this was going on........tell me they couldn't tell SOMETHING was being being taken or snorted or smoked or done........good grief they lived right there in the parental home the whole time she was pregnant and after the delivery........i am livid and i don't know who i'm madder at.....these 2 monsters, his parents or CPS!!!!!!!!! :furious: :furious: :furious:

talk about failing a baby, THEY ALL FAILED THAT CHILD :tears:

it just makes me sick :mad: i could just scream :tantrum:

In addition to marijuana and methamphetamine, Green told detectives she took the prescription drug BuSpar for anxiety and was experiencing delusions, according to the Vicente affidavit.

“She has seen lights under her bed. She further indicated that Justice Rees was going to eat her,” the detective wrote. “She indicated Frank Rees’ children were telling her about baby killings.


And no one in the house noticed? Um, no. We're talking about multiple instances of SG ingesting legal and illegal drugs and delusional thinking.

IMO the grandparents were aware of something going on and were afraid CPS would take not only baby Justice but the other children away. So it was all about them and their needs. One phone call to Samantha's doctor would have stopped this tragedy in its track.

And as for the <cough> father, well... :censored:

Discovery remains an issue in Baby Justice case

Defense attorneys still need more information before moving forward with a Woodland mother&#8217;s murder case.

Samantha Green, 23, faces a single murder charge related to the death of her three-week-old son Justice Rees, whose body was found in a slough outside Knights Landing in February.

Discovery issues were discussed at a prehearing conference Thursday morning, where Public Defender Tracie Olson indicated her office is still missing vital information related to the case.

Olson, along with co-counsel Deputy Public Defender Dave Muller, filed a motion to compel evidence from prosecutors, which would illuminate why Green is being charged with murder.

When she was first arrested, Green pleaded not guilty to involuntary manslaughter and child endangerment charges, with an enhancement for infliction of great bodily injury upon a child under 5 years old.

However, prosecutors changed their minds a week later, changing the lesser charge of involuntary manslaughter to murder.

What remains a mystery to Olson is what evidence came forward to support such a claim?

This question prompted the motion to compel, which Yolo County Superior Court Judge David Rosenberg addressed in court Thursday.

Deputy District Attorney Ryan Couzens &#8212; one of two prosecutors assigned to the case &#8212; indicated he would file a written response to Olson&#8217;s motion.

Lawyers for Green, who is accused of killing her 3-week-old son Justice Rees in February by leaving him overnight on the bank of a Knights Landing slough, They are saying the baby died of exposure? That is new to me.

Justice’s body was found by searchers Feb. 25 in Knights Landing. Autopsy results were inconclusive but Justice is believed to have died of either drowning or hypothermia. More tests — specifically for drugs or other medications — are pending and will probably take several weeks to complete.

The autopsy results were released early on. I guess you could call it exposure. Green was initially charged with murder then the DA changed it to involuntary manslaughter - a misdemeanor in this case - and child endangerment. Then, just days before she was scheduled to plea no contest to the charges the DA changed it back to murder.

Tuesday, the district attorney filed a motion to change the charge back to murder. According to the documents, the district attorney believes “she did willfully and unlawfully kill with malice aforethought.”

This is very upsetting. I think most of us are not surprised by the drug revelations but I am tempted to go back and bump all those quotes from Rees's parents wherein they describe what a wonderful loving mother she was and how good and responsible she was caring for Rees's other children. I won't though as it will only serve to make me hotter.

Safety plan my hind quarters. So disgusted with all involved, parents, CPS, those grandparents who were allegedly supervising. The lot of them.

Yep. Both of those parents should have been required to have 3 months of regular drug testing with clean results before the baby was allowed to come home, and the other kids should have been removed at that point, too.

Argh! I just found an article in the Sacramento Bee about Justice. It says he had heart disease. Unfortunately I can't read the article - it keeps flipping to a different one. Here's the link if anyone else can read it:

Pretty sure his mother leaving him on a riverbank CONTRIBUTED TO HIS DEATH, Mr. Attorney. Oh, and her constant meth intake while pregnant may have contributed to his heart disease, so IT'S STILL HER FAULT.

I hate defense attorneys like that. I don't have a problem with them making sure their client gets a fair trial, but making comments like this is dumb.

An autopsy revealed that Justice Rees suffered from a congenital heart disease, which may have contributed to his death.

According to Yolo County Public Defender Tracie Olson, Samantha Green held her baby &#8212; who she is accused of murdering &#8212; close to her body, under a coat, all night.

She said Green fell asleep and found her baby dead when she woke up.

Two search warrants, one under review, were thrown out in the case Monday.

Green, 23, nodded her head as the judge confirmed that she never told evaluators she was having psychological issues during her medical intake screening.

So they threw out the warrants because her dr. client privileges were in play..

The July 24 status conference is still scheduled. The Sac-Bee article mentioned a September 10 pre-hearing conference. So far no mention of dropping charges but I wonder about the direction the case might take regarding the information about Justice's heart condition.

In the meantime, Frank is still facing possible jail time:

In related news, Justice’s father, Frank Rees will appear in court Monday for a preliminary hearing, facing drugs and weapons charges stemming from a search of his Woodland home.

Rees, 29, was arrested for possession of methamphetamine, possession of drug paraphernalia, being an ex-felon in possession of ammunition and violation of probation after investigators found methamphetamine, a narcotics smoking pipe and ammunition during the search of his residence in the 700 block of West El Dorado Drive in Woodland in March.

He was initially arrested on March 1 on misdemeanor warrants unrelated to his son’s death — two from driving on a suspended license and without vehicle insurance in Yolo County, as well as one alleging child endangerment, driving on a suspended license and impaired driving in Lake County.
