This is going to be interesting if it goes to trial. I understand that baby Justice's heart condition will be a factor but that doesn't excuse his mother's behavior - exposing him to the elements overnight. I'm curious to see how the prosecutor will build the case.

Frank got a slap on the wrist and a plea deal:

Frank Rees, 29, admitted to charges of illegally possessing methamphetamine and ammunition, in exchange for remaining counts being dismissed, according to the Yolo County District Attorney’s Office. He was sentenced to a 180-day drug treatment program — or jail time if the program is not completed — and three years’ probation.

“He was propped up on a tree next to me. He was wearing a onesie. He was so cold,” Green told Woodland Police Det. Tamara Pelle between sobs and hyperventilated breaths on an audio recording played Monday in Yolo Superior Court. “I held him against my side. He was...dead.”

The interview closed the first day of testimony in the preliminary hearing for Samantha Lee Green, suspected of murder in the death of her son, Justice Rees, whose body was found in a remote slough Feb. 25 near Knights Landing. Testimony continues Tuesday in Woodland before Judge David Rosenberg.

More at the link. Frank and Samantha told LE in separate interviews that they planned to meet a female friend in Knight's Landing the day before Justice was found. After an argument Frank went alone. Later, Samantha packed up Justice and went looking for Frank. She didn't find him and eventually ended up in the slough with Justice.

This is just soooo messed up.

Then, suspicious that Rees was cheating on her — as she later told Pelle — Green again changed her mind. She went to her Woodland home to prepare a bottle of formula for Justice, then drove with him to Knights Landing.

GULSTAN: Allegations of a proposed love triangle on the second day of a preliminary hearing focusing on the evidence against the mother in the case of her baby's death. KCRA 3'S Rob Malcom has the story from the courthouse in Woodland.

ROB: The Sheriff's department detailed the crime scene pinpointing where Samantha Green was found. Detectives used on February 24 canines to track the scent and found the diaper bag near the water. The body was found nearby soaked in water. Detectives say consistent with being under water.

A second witness found her peacoat and spandex fabric and spoke about weather conditions being 33 degrees.

Another detective told the court her primary objective while questioning Samantha was to get information about the baby. She said Samantha Green showed signs of coming down from meth. Prosecutors say the night before Samantha Green went missing, she had an argument with her boyfriend Frank Rees over infidelity and cheating and his desire to have a threesome. Prosecutors told the court Frank Rees had sex with a woman while Samantha Green was missing. They added the day after the body of baby Justice was found, detectives found Rees and Green trying to buy meth in downtown Woodland.

The prosecution is finished with their witnesses. Tomorrow, the defense will call the coroner. On Thursday, we will hear from the pathologist. They will meet back here at 1:30.

I think this is a possibility, but I also believe she was so upset with Frank that she methed herself up to the max. Why would she have to cart the baby all around with her when she had family who could keep him safe and warm while she got drugged up before hunting him down?

Yolo County prosecutors have alleged that Green, 23, was under the influence of methamphetamine in the days leading up to her baby’s death, and that she intentionally took him into the desolate slough after concluding that Rees had been unfaithful to her.

Infidelity had been the subject of multiple arguments between the couple, according to Nyland. He said they fought about it in their garage on Feb. 20, and again on the morning of the 23rd, as Green “felt Frank needed to spend more time with her and the baby and not be going to Knights Landing.”

But they were back together on Feb. 26, the day after Justice’s body was found, “on Wisconsin Street (in Woodland), attempting to score dope — dope being methamphetamine,” Nyland said.

On the way there, driving in separate cars, they stopped at a Chevron station, where the argument took place. Green then decided to head back home to Rees’ mother’s house, where they both lived, and Rees proceeded to go pick up their friend from Knights Landing.

During the interview, Rees admitted to Dep. Nyland that he and the female friend had sex with each other in his car after he picked her up, and again at the boat ramp in Knights Landing. When Rees and the friend did not return to Rees’ mother’s residence, Green grew suspicious and headed over to Knights Landing to find them, taking Justice along with her.

I don't think she hurt the baby like with chance but I think she allowed him to die/be in harm's way to get back at frank.

Maybe it was a rage fueled by jealousy and meth. What better way to confront a cheating husband than while holding his baby? Ugh. And so much for the "safety plan."

Day three of the preliminary hearing. Long articles:

“You cannot say … that this is an act of homicide?” asked Deputy Public Defender Dave Muller, one of Green’s two court-appointed attorneys.

“Correct,” Clancy replied, adding that Justice appeared adequately nourished and showed no signs of trauma, other than abrasions consistent with being carried through the dense thickets that border the slough.

However, the deputy coroner did concede that a newborn dressed only in a wet onesie and exposed to a bitterly cold February night would suffer “extreme stress” physiologically, and that Justice’s heart defect — discovered at autopsy — would have diminished his ability to adapt to that stress.

And, at just 19 days old, Justice required the actions of another person to get him to Ridge Cut Slough in the first place, Clancy agreed under prosecutor Ryan Couzens’ cross-examination.

Seeking to escape her assailant — while also thinking “the world was coming to an end” — Green removed her shoes and walked into Ridge Cut Slough, carrying her purse and diaper bag in one arm, cradling Justice in the other while trying to keep his head above water, Nyland said.

Then at one point, around 1:30pm on 2/23 she described, she crosses the water at the slough, with Justice on her shoulders; she was trying to keep his head above water. The water is around 6 or 7 feet at the shallowest part of the deep end, and goes to a max. depth of around 9 to 10 ft.

At first, Samantha Green was convinced that Kerry was the one responsible for the whole situation and Justice’s death. Then, she blamed Frank Rees.

2 or 3am on February 23rd, the day she went missing, Samantha Green and Frank Rees used methamphetamine. He administered a “butt shot” to her anal cavity, which was approx. 0.25 grams of methamphetamine with some water, administered with a syringe and the needle taken out.

Later, she thought Frank might have put something weird in the shot besides methamphetamine. The way she acted at the slough was unlike the previous times she had used meth. She had used methamphetamine for a couple of years but never had she felt dizzy and the way she felt at the slough. Samantha’s sister had agreed with her, that Samantha had not reacted as she had on that day.

Samantha also mentioned Justice was the “baby of the devil” and “half devil, half human” in some interview. Frank had told Samantha some odd things, such as Samantha was a triplet, he was an octuplet, and Justice was a twin but Kaiser had taken Justice’s twin away from them.

Well, you know, some new parents dote over their newborn and post cute selfies on FB while others shoot meth up their rectums. Everyone celebrates the birth of a baby differently. /sarcasm
