The story so far, IMO and pasted together from the msm reports:

- In the days leading up to Samantha's disappearance she and Frank had been using meth and arguing over his infidelities. Frank wanted to add a third person to their relationship, specifically another woman. Samantha wanted Frank to spend more time with her and Justice.

- At 2 or 3 am on the 23rd Frank administered a “butt shot” of meth up Samantha's behind. She said she had an unusual reaction of feeling dizzy.

- Later in the evening Samantha and Frank planned to go to Knight's landing to meet a woman. They took separate cars and stopped at a gas station where they began fighting over Frank's lack of interest in Samantha and Justice.

- Samantha, angry, returned home but when Frank failed to return she packed up a diaper bag and took baby Justice with her to Knight's landing. Meanwhile Frank was having sex with the woman in his car and again at the boat ramp at Knight's landing.

- At this point Samantha's memory gets hazy; she abandons her car near the slough. She's hallucinating and imagining a man is trying to sexually assault her. To escape him she runs into the water, carrying baby Justice.

- She spends the night in the slough with Justice. As morning approaches on the 24th she realizes Justice is freezing cold – and dead. She props him up against a tree and tells him she'll be back. She then tries to make her way out of the slough, calling for help.

- Samantha emerges from the slough, disoriented, on the evening of the 24th, without Justice. Searchers begin looking for him. Samantha is taken to a hospital then interviewed by detectives. Her story makes no sense. Detectives believe she is coming off a meth high.

- Justice's body is found on the 25th. On the 26th Samantha and Frank go to downtown Woodland, looking to score meth.

The preliminary hearing continues today, starting at 1:30.

The mind boggles. Going to get drugs the day after your baby's body is found? Yet another child totally let down by his parents.

I can understand a junkie wanting drugs to ease the pain when their child has just died. But taking drugs when you have an infant in your care, when you could easily have left him safely with a family member instead - there's no excuse for that.

The big question here is, did she kill Justice intentionally? I agree with the poster who said she was probably attempting a murder-suicide.

Samantha Green will be arraigned for second-degree murder and felony child endangerment!

WOODLAND, Calif. (KCRA) —A woman accused of killing her newborn son will stand trial, a Solano County judge said Thursday.
...
At the end of the hearing Thursday, the judge also struck down involuntary manslaughter as a possible charge in the case.

Green will now be arraigned for second-degree murder on Nov. 20. She also faces a felony count of child endangerment.

No report yet on today's witness testimony but the judge found probable cause for murder two and dismissed the lesser charge of involuntary manslaughter.

Photographs displayed during a Thursday court hearing showed where Justice Rees’ life ended: first, a murky slough, heavy with overgrown trees, thickets and brush. Then another, taken from deep in the brush, where his lifeless body lay, clad in a onesie and a diaper. Justice’s grandparents fled the courtroom at the sight, as their daughter, Justice’s mother, Samantha Lee Green, sobbed beside her attorneys.

“There is no evidence of any physical infliction of harm. … What we have here is an act of involuntary manslaughter, no more, no less,” said Yolo County Deputy Public Defender Dave Muller, arguing Green fought through heavy brush and swam across the slough to find help for her son.

In an interview with detectives, Green said she went to the levee out of jealousy, frustrated that Rees didn’t try to find her, testified Yolo County detective Sgt. Dean Nyland.

“ ‘Why didn’t he come find me? He knew where I was at,’ ” Nyland said Green told investigators. “ ‘He left me out there with his son.’ ”

While the defense had attempted to argue that Ms. Green, covered in scrapes and cuts, protected Baby Justis to the best of her ability, the Prosecution argued that the temperatures in the low to mid 30s in February, were “freezing cold.” She had a jacket on, but Baby Justis only had a wet- onesie with his arms and legs exposed.

She intentionally, Mr. Couzens would argue, persisted in staying out there despite his cries which he called the baby’s attempt to communicate cold and discomfort. She could have chosen to seek help, he argued, but chose not.

Mr. Couzens called this a “callous indifference” to human life. When “the chips were down,” he argued it was about Frank Rees and meth.

Not only did she leave her baby in the elements, but she was not cooperative with law enforcement’s efforts to find him. Mr. Couzens argued that Officer Pelle had to convince her to help find her child.

The defendant had produced increasingly fantastical stories, such as that of being sexually assaulted by a man – when the police quickly determined the man could not have been there. Then it was secret government agencies, the Illuminati, that were out to get her.

Mr. Couzens argued that this was crazy, but not a real delusion as there was no consistency in the story.

Mr. Rees had characterized Green as totally normal, when he was on meth, to Sgt. Nyland. Mr. Couzens put together testimony to argue Green was perfectly capable of conducting herself normally while on meth. Sgt. Nyland testified that Mr. Rees showed no signs of intoxication, even when he was sure Rees was under the influence

Green waived her right to a trial within 60 days of her second arraignment Friday morning, opting instead to push it out until late April 2016.

The Yolo County District Attorney’s Office dropped a felony child endangerment charge and will focus solely on a murder count in its case against Samantha Lee Green, 23, whose 19-day-old son Justice Rees was found dead on the bank of a Knights Landing slough last February.

But some legal wrangling is expected beforehand, starting Jan. 12 when prosecutors will seek Rosenberg’s reconsideration of an earlier ruling in which he voided a DA search warrant seeking access to Green’s medical and psychological records from the Yolo County Jail. Green’s lawyers had argued that it violated her privacy rights as well as attorney-client privilege.

Meanwhile, the defense reportedly is preparing several motions of its own, including bids for a change of trial venue and to disqualify the Yolo DA’s Office from prosecuting the case.

The judge will hear motions on January 20. Trial is scheduled to start on April 25. It's expected to last three weeks.

Now why would the defence not want her medical records to be seen by the prosecution? I had imagined that her defence would be insanity, in which case wouldn't the defence.be presenting her medical records as evidence anyway? It can't be to hide drug use, because the court already knows about that. Maybe she has a history of faking insanity or something? :dunno: or she has admitted something incriminating in counselling sessions? Or she has exhibited character traits to a counsellor such as anger and violence when jealous, which could be used to show that she killed Justice on purpose in a rage?

Eta I just read the quote again, and it sounds like the medical/ psychological records they don't want the prosecution to have are just the ones from her time in jail. So I guess she's said something incriminating to a doctor.

Yeah, I'm scratching my head too. Here's an old article about the warrant for those records. A lot of what was in the warrant was reported in the article at that time so the cat was kind of out of the bag. And it seemed to center around lots and lots of drug use. Maybe you can make better sense out of it than I could...

Now, Green’s public defenders are seeking to quash, or void, the search warrant through which sheriff’s investigators gained access to Green’s medical and psychological records at the Yolo County Jail — an act the defense says violated Green’s privacy rights as well as attorney-client privilege.

A motion to quash filed May 1 takes aim at Vicente, the Yolo County District Attorney’s Office that reviewed his affidavit and Judge Samuel McAdam, who approved the warrant without appointing a “special master” to maintain the confidentiality of the documents, which the defense lawyers say is required by law.

Public Defender Tracie Olson has demanded that the 119 pages of records obtained by sheriff’s detectives be returned to the court or destroyed, a request Judge David Rosenberg will consider at a June 2 court hearing.

Two search warrants, one under review, were thrown out in the case Monday.

“That ruling was correct then and I believe it is correct now,” Yolo County Superior Court Judge David Rosenberg said about the first search warrant.

Green, 23, nodded her head as the judge confirmed that she never told evaluators she was having psychological issues during her medical intake screening.

According to Rosenberg, a warrant can be quashed if there is doctor to patient privilege, which he ruled a factor in the second warrant.

When Samantha went home to get the baby, and then took Justice, nobody noticed that the baby was only wearing a diaper and a onesie? And nobody was worried when she failed to return home? Nobody called the police? Did the grandparents actually have custody of Justice or did the parents? Did the boyfriend even return home that night? His parents must have been worried yet nobody was called??

Justice was born with meth in his system so he wasn't released from the hospital until both Frank and Samantha tested clean for drugs and a "safety plan" was established. The safety plan included Frank's parents but I don't know who had official custody. The first news of Samantha and Justice missing came out when she called 911, so no, his parents didn't notify LE about what was happening.

There's no information on whether his parents had any idea of the heavy drug use going on in the house or the circumstances of Samantha taking off with Justice. It's hard to imagine all this slipped past them but I do think if they had suspicions the grandparents would have notified LE or children's welfare so maybe they were just too trusting and naive. I'll leave it at that...
