There were many people in the courtroom when Barrick made his opening statements, including some who shook their head or wiped tears from their eyes. At one point, a Ventura County sheriff's deputy gave Albers a box of tissues for his client.

Some of the evidence as to Kimberly's death came from her father, Omar Lopez, who told authorities the girl hit her head while Chavez was changing her diaper on June 22, 2015. Kimberly died later that night after suffering seizures, authorities said. The parents took their daughter's body to Mexico to allegedly hide her remains, authorities said.

Lopez, 33, of Oxnard, is also accused of second-degree murder in his daughter's suspected death but has taken a plea deal with prosecutors in exchange for a lesser sentence should he testify against Chavez. He has pleaded guilty to felony child endangerment and felony perjury.

The perjury charges against the parents stem from testimony they gave in a dependency case over Kimberly’s whereabouts. Chavez has pleaded not guilty to the perjury charges.

The grandmother of Oxnard girl Kimberly Lopez was sentenced to 180 days in jail and three years of probation for conspiring to conceal the 3-year-old’s death from authorities.

Maria De Jesus Lopez, 45, of Oxnard, took a plea agreement with the Ventura County District Attorney’s Office on March 13 in which she agreed to plead guilty to the felony offense and an unrelated misdemeanor in exchange for no more than 180 days in jail. The court had discretion to honor the agreement and possibly sentence Lopez to less jail time.

Until the grandmother was arrested in July 2018, Kimberly’s parents were the only ones charged in connection with her death.
