A preliminary hearing is specific to felony offenses and is a hearing conducted in a specific manner for a specific purpose. Basically, it is an evidentiary hearing- much like a mini-trial, but without a jury and only before a judge- where the DA has to put on enough evidence (through live witness testimony, physical evidence, whatever) to show that there is enough evidence of a crime and enough connection to the defendant to take the matter to trial. These must be held within a certain period after the initial arraignment- unless the defendant waives his right to speedy trial- or the case must be dismissed.
So first- another one of these pre-trial conferences. Looking at the court filings, there have been a lot of them in the four years that have passed.
Then, if the case cannot be settled- it will proceed to a preliminary hearing, before a judge, without at jury present.
Then, if not settled or dismissed, it would go toward jury selection ahead of a trial.
It's apparent that Mr Krah long ago waived his right to a speedy trial.
