On Tuesday, a San Mateo County judge declined to review new evidence that was submitted by Scott Peterson’s defense team in an attempt to prove he did not murder his family, attorneys said.

Peterson, 53, was convicted by a jury in 2004 for the murders of his pregnant wife, Laci, and their unborn child, Conner.

His habeas corpus petition was filed in August 2025 by attorneys with the Los Angeles Innocence Project. LAIP claims it uncovered “compelling new scientific evidence” with its own investigators that can prove he was wrongfully convicted.

This week’s ruling in San Mateo County Superior Court marked a major setback for one of California’s most notorious inmates.

Also says they will continue to waste everyone's time and money:

The Los Angeles Innocence Project said it intends to file the petition in a higher court to appeal the judge’s decision.

And they still have a separate petition pending.

He has a separate habeas petition pending in the California Supreme Court alleging that juror misconduct denied him the right to a fair trial.

And they also have those motions for discovery that are being heard 5/6/26 in the Superior Court. It looks like SP will be appearing and that it will be streamed or recorded.

Stop and think of the cost of this. And how much court time, judicial assistant research/writing time is eaten by this.

I guess I don't understand why the judge/court won't just look at it?? If SP is guilty (and I believe he is), why doesn't the state just continue to prove it?

“We disagree with and are disappointed by the court’s ruling on every level. The ruling demonstrates a profound misunderstanding and misapplication of the law applied to habeas corpus petitions,” LAIP deputy director Hannah Brown wrote in a statement.

The Los Angeles Innocence Project said it intends to file the petition in a higher court to appeal the judge’s decision.

“In the court’s ruling, strong exculpatory evidence was disregarded as ‘inadmissible’ which is not the correct legal standard,” Brown wrote.

LAIP investigators conducted over 50 interviews with various witnesses who have information “shedding light on what really happened,” according Peterson’s defense team.

In an order issued on Monday, California Superior Court Judge Elizabeth Hill declined to review the evidence and denied the petition's claims, finding they are procedurally barred or lack merit.

Scott Peterson's attorneys said they plan to appeal to a higher court.

Why do reporters submit these articles without linking to the actual document (court order) in question?

I am completely ok with giving him a new trial. But only if it is agreed upon that if he is found guilty he gets 30 minutes to say good bye to family, talk to clergy, and then promptly executed. His games are on par with Bundy and the night stalker.

So - question - does he still have a motions hearing on 5/6/26? Or was "this" appeal going to be heard OR the juror problem? I can't tell from my notes! LOL! TIA! :)
