GUILTY CA - Lana Clarkson, 40, fatally shot, Alhambra, 3 Feb 2003

Panthera, I have a feeling there is at least one person who just is not going to budge from their decision. As I believe PS is guilty, I'm thinking (hoping) the majority are leaning toward a guilty verdict ... at this point I'm not holding out much hope for anything other than a mistrial due to a hung jury.
You're right and maybe I was being too optimistic to think they'd overcome this 7/5 split, whichever way it goes. The judge giving them the instruction again wouldn't change the mind of someone who's definitely leaning toward NG.

A miracle is disguise? Perhaps if they retry the case, the "experts" for the defense will be "unavailable". I don't think they will drag any hile profile names into this mess again, I could be wrong.

In a second trial, I bet they could get a conviction. Too messy, this one, with LKB and her liar husband, Dr. Lee, etc.

I'd prefer to see a fresh start and give Jackson another crack at it.
I wonder how much money PS has to spend on a 2nd trial if it's needed? He still is facing the civil lawsuit by Lana's mother which he has to pay attorneys for. I definitely think the relationship between LKB and Dr. Baden testifying was a problem, but obviously the defense has done something right if even one juror ends up NG. I just don't know what else the State could do to make their case better a 2nd time.

More questions...According to CourtTV.com blog: The clerk says the jurors are requesting a VCR.
“They want to listen to a tape,” she says.
Defense attorney Bradley Brunon says to his knowledge, the only VHS tape in evidence is DeSouza’s police interview.

There was another videotape according to the article at msnbc.com. It was of the fountain and the noise it would make.

LOS ANGELES (AP) - An Internet posting that appeared to threaten the judge in Phil Spector's murder trial has become the latest twist in the lurid court case.

The jury was set to enter its 12th day of deliberations Wednesday, a day after court officials disclosed the MySpace.com posting that stated "I love Phil Spector" and "The Evil Judge should DIE!!!!."

The posting was on a MySpace Web page called "Team Spector," said Steve Whitmore, a spokesman for the Los Angeles County Sheriff's Department. It was subsequently taken down, Superior Court spokesman Allan Parachini said.

Sheriff's investigators were looking into the messages, which were signed "xoxo Chelle," according to Parachini. Spector's wife is named Rachelle, but one of his defense attorneys, Christopher Plourd, said she denied having anything to do with the notes.

Unbelievable that the jury is taking this long to convict Phil Spector; I didn't watch the trial and haven't followed it, but I don't understand what the jury is hung up on. It was his gun. He has a history of threatening people with guns. She didn't commit suicide. What did I leave out??

There was a guy right outside the front door who saw him WITH the gun and WITH blood on his hands who actually said the words "I think I just killed someone." That would have been IT for me right there!!!!!

Note that Scott Peterson is sitting on Death Row at San Quentin on far less evidence than there is against Phil Spector.

Jury has requested 3 blank notebooks this morning.

Jury has requested 3 blank notebooks this morning.
One for all the reasons he is guilty
One for all the reasons he might be innocent
and one for any points of question.

the innocent one will remain blank

Nothing person, but each case, just like each jury, is different. You can't base one on another.

Here we go again. Court will be in session at 1:30
http://blog.courttv.com/phil_spector/

The clerk comes out carrying a manila folder. She takes it into the judge's chambers. A moment later she tells the gallery, "We will be having a session at 1:30." In the meanwhile, she adds, the jury will not be deliberating.

I'm wanting to hear from the two jurors who were stuck on NG, and the other three who were against First Degree. There must be something in the water in Southern California. They should require IQ tests before they qualify people for jury duty.

It's not going to look very good if one of the hold outs was the juror who is still married to the man serving life ... justice just doesn't seem to matter in these murder trials of wealthy Hollywooders. Unfortunately they are such high profile cases that so many in our country seem to just give up totally on our justice system.
