A quick search with the 2nd District Court of Appeal yielded no results for any appeals of Judge Michael Pastor's decision in January to keep the case going and bail in place.

His ruling came after Brown's attorney, Pat Harris, argued that the jury's deadlock of six in favor of second-degree murder and six for involuntary manslaughter meant Brown was acquitted of first-degree murder. Harris, who indicated his firm Geragos & Geragos will likely not remain for the third trial, also argued that "basic fairness" dictates the dismissal for his client who has remained jailed for about six years.


But Deputy District Attorney Craig Hum countered that there was no verdict, and even submitted declarations from six panelists that indicated such, and that one of them actually favored first-degree murder. Hum argued that, as far as fairness goes, it wasn't fair that he murdered 4-year-old Lauren Sarene Key, his daughter, over child support.

while they can make an argument that it's an acquittal of first degree murder, there's no way in hell letting this killer go is 'fair'. neither jury deadlock on his guilt, just on his level of it

It looks like it will be quite some time before the trial starts.

Harris (Brown’s lawyer) indicated to (Judge) Pastor that the ruling will be appealed. An appeal will likely include a stay of the case until a decision is made.

Harris, an attorney with Geragos & Geragos, also said he did not believe his firm, which has gone through a drastic downsizing recently, would remain on the case.

Firm principal and high-profile attorney Mark Geragos represented Brown during the first trial, and Harris agreed to do the second on appointment from the court.

Brown likely will be given a public defender, who Harris predicted will take a year or two to become familiar enough with the evidence to handle the trial.

At least he will remain in jail until this comes to trial, whenever that will be. Can't believe they have not been able to reach a verdict twice. Maybe we should hope this takes a really long time to go back to court so he will stay right where he belongs, imo.

If the delays keep piling up, time served will equal the penalty he would have received for manslaughter. Maybe they will decide against a 3rd trial. I would rather see him tried and convicted for premediated murder since that's what I believe this was.

Geragos turns Cameron Brown case over to new lawyer

The famed law firm that represented Cameron Brown in two trials for the Rancho Palos Verdes cliff death of his 4-year-old daughter will not be there for the third.

In Los Angeles Superior Court on Friday, Mark Geragos and his firm turned over the nearly 10-year-old case to Glendale attorney Herbert Barish, according to Deputy District Attorney Craig Hum.

Barish is on a list of private attorneys available for appointment by the court in situations where the Public Defender's or Alternate Public Defender's offices cannot take a case.

Hum said he expected it would be about a year before the case goes to trial again.

An appellate court has declined to review post-trial rulings in Cameron Brown's murder case in which a judge refused to dismiss or decrease the charges or set bail.

Brown appealed to the 2nd District Court of Appeal on March 30, and it denied his petition on April 8.

That's what is alleged. He has been in jail since November of 2003, and is awaiting a third trial for murder. The first two ended in mistrials.

It's actually amazing that this case seems stuck in the slow churning of the wheel of justice. If Mr. Brown had accepted a manslaughter plea deal, he would likely have been a free man by now. It case against Brown is overwhelming but I recall reading an expert witness report related to Lauren's injuries and whether they were inflicted due to a tumble-fall or due to throw-fall. The report was very convincing in support of a tumble fall. Technically Brown could have pushed her (rather than lifting and throwing) her to her death. But these hung juries clearly have reason to find reasonable doubt in rendering a first degree murder conviction.

Cameron Brown is guilty of child endangerment and at least voluntary manslaughter or second degree murder. However with the DA pursuing a first degree murder conviction we may see the case bounce around in the system for a lot longer.

This is an interesting case I had not heard of.

It is pretty much inexcusable for a father to allow a 4 year old to get close enough to a cliff to fall off, but it isn't First Degree murder. Normally, at best it would be manslaughter. Deliberately throwing your own child off a cliff to avoid child support, on the other hand, a particularly heinous type of First degree murder. Second-degree murder, which is this case would mean that Cameron didn't mean for her to be hurt but he was completely indifferent (didn't care) if she got hurt, was probably a "compromise" verdict.

Apparently, in two trials, only two jurors voted for first degree murder. The others were pretty much equally split between second degree murder and manslaughter.

Since the defendant gets credit for time served awaiting trial, he would walk if he were convicted of manslaughter and he could very well walk if he was convicted of second degree murder. At most he would only serve about two more years. In addition, there is a serious "double jeopardy" issue and a first degree murder conviction could very well be thrown out on appeal. Common sense says "cope a plea for time served and send this guy on his way". Save the county a lot of money. The only reason I can see they aren't doing that is that The DA's office and the last judge really believe he is guilty.

The only evidence against him is the injuries to the child and his overall behavior and demeanor. There are no real smoking guns.
