We got a 50 page report today from the Oakland Fire Department as to the cause of the fire. It's going to be released to the public soon. It has lots of photos and a ton of info about the electrical situation, the configuration and where everyone was found, and the condition of the area around the victims. The cause cannot be totally determined. But among the possibilities is candles/incense, smoking materials or electrical. No evidence of arson, and natural gas or propane was ruled out.

It also has a ton of witness statements.

Ugh, it's heartbreaking and infuriating.

Following along. As an emergency fire dispatcher, this is the stuff of nightmares.

That Derick Almena seemed to think fire safety was too mainstream for him makes me so angry.

Reading about extension cord upon extension cord makes me nauseous.

Ugh. And Micah Allison saying obviously they believed it was safe since they had their kids there won't last three seconds in court. They lost custody of their kids for having them in an unsafe environment.

They are blaming everyone but themselves. They even blamed the firefighters!

That place was a tinderbox waiting to go up. Reckless disregard for human life - absolutely. Heartbreaking.

I just read the report, and truly feel sick! Seeing a coroner # next to each victim's name brought me to tears. This case has hit me hard!

Poor Pete Wadsworth with his broken ankle couldn't get out. I don't know why but that really gets me.

It sucks that they can't identify an absolute cause of the fire, but it sure seems likely it was electrical. They mention the charger for the cordless drill, and that it wasn't recovered, which would mean it was completely burned up, right? I wonder if that cord was what caused it. I guess the laptop power cord could have overheated as well.

So many lives lost and so many more lives damaged by this. I hate it.

IMO the essence of the defense team's argument is that the case against Almena belongs in civil court not criminal court. And, (also IMO) I believe the main reason for that argument is because Almena has no assets.[/QUOTE

Since when is manslaughter a civil crime?

Don't worry Almena, you'll get your civil action when your are slammed with Wrongful Death suits. Just be patient, you uncaring, selfish $*% *# @ &!^(%.

Here's the latest creation by Almena: You can locate his info at the Alameda County Jail (Santa Rita) -

https://www.acgov.org/sheriff_app/inmateSearch.do

----------------------------------------------------------------
Wow, Almena has vastly improved his living quarters -- new jail, all the lights seem to be in working order. His meals are prepared for him. Lots of folks to meet and be chummy. Clean bed in a no clutter cell. His clothes are given to him -- a laundry on the premises -- shower facilities. Similar to a motel, but it is a bit like The Hotel California, I must say. And, as you can see in the info below, it is accredited by the ACA, a very "prestigious award," according to the article below.

The New Santa Rita Jail
The facility holds about 4000 inmates housed in one of eighteen modern housing units. It is considered a "mega-jail" and ranks as the third largest facility in California and the fifth largest in the nation. Santa Rita is accredited by the American Correctional Association, thus making it the only facility in California holding this prestigious award.

My husband has 10,000 sq feet of warehouse space.
His buddy with a full size tour bus is MOVING IN THE WAREHOUSE!!! He will live in his bus, and set up a place for bands to "jam" and possibly record.
It makes me feel very ill and mad.

Please talk me off this ledge..........
The risks are tremendous.

I'm so sorry. He's probably just thinking about doing his friend a favor, but...
Is your husband aware of this case and the potential tragedy he's risking? Has he, or you, checked on the legality? I'd be ill and mad too. But I think I'd fight it with all my might. Liability could fall on you too.

Who insures said warehouse? They need to know that Residential and Entertainment are being added to the location.

Might check with the city/county/township about Residing in an area zoned for warehousing.

Make certain you are not on any Warehouse papers!

If you can't appeal to his moral conscience on this one (although from his perspective I'm sure he is torn as it is his friend who he is "helping" and trusts), then seek legal assistance before it ruins potentially many lives. Your city/township/county may have free Legal Aid if you can't afford legal advice.

My name is on nothing regarding the business. The business is set up as a llc
I don't know how much that will help if the unthinkable happens. Even with a fire.with only loss of stuff.
I think I need to speak with an attorney and discuss potential senarios.

Gross
I'm so impossibly exhausted and sadly inert.

Yes, the guys are gung ho like Frat Boys and they are in their late 50's. The RV planning to move in is a full sized tour bus.
I think they are all thinking about how it will be benificial for each other. I think that is nice.
I need to be sure I am covered. I have 3 teenagers, one with Autism and I can not risk jail, lawsuits, loosing our house.

Maybe we can legally disentangle from one another and continue to provide a "marital front" for the kiddos.

First of all {{{{{{{{{mom2four}}}}}}}}} Of course you're exhausted and inert...this is hard stuff and you've shut down temporarily. One phone call to an attorney is all you need to do right now. One step at a time will help lift the exhaustion and end the inertia.

It seems that their hearts are in the right place and their excitement will probably deafen them to your concerns. So you don't need to try to stop this from happening and rain on their parade (knowing me I'd probably be using a fire hose!! :D). You just need to protect yourself and your kids. And you are wise to look into how you can do that, with the help of an attorney.

Maybe we can legally disentangle from one another and continue to provide a "marital front" for the kiddos.

I hope it doesn't come to that Mom. Once you have quietly lined up the legal ducks in a row you can present the various options to him, perhaps with the help of the attorney you consult. That may bring him back to earth and help him see how seriously dangerous this situation is for you and the kids...and for him! Here's hoping he responsibly chooses family and legal considerations over friend and fun. If he doesn't, you can figure out your next steps at that point. But for now, one step at a time. More hugs. :heartbeat:

What an overwhelmingly sad and avoidable tragedy. Just finished reading all 50 pages of the Oakland Fire Department's Origin and Cause Report, which was shared here earlier. On the last page, just before the summary, it says

S***** M****** was seriously injured and remains hospitalized at the time of this report. His eyewitness account of the event is not available.

I Googled him. His friends know him as Peaches. His name is on page 46 of the Oakland report under the heading "known injuries." I apologize if this has already been posted here and I missed it.

He's still healing and making progress! He's no longer in a coma. This is a ray of light. I've been deeply impacted by this event for some reason, and I have to admit seeing the single name under "known injuries" at the end of this harrowing report, then seeing his progress, made me weep.

Someone started a YouCaring crowdfunding page to support his recovery.

And the magnitude of hard work the police and fire departments did sifting through this crime scene is heroic. Thank you @MsMarple for sharing those links.

I'm not an attorney but depending on where you live, if the unthinkable happens, you will be wiped out along with hubs.
Do the right thing and see an attorney.
