CHULA VISTA, Calif. (KGTV) -- A court battle is brewing in the case of missing mother, Maya Millete. Maya's parents are asking for visitation to see their daughter's three children that she shares with husband, Larry Millete. In a 9-page court document, Millete argues why his wife's parents should not receive frequent visitation rights in their home.

Maya Millete was last seen in her Chula Vista home on January 7th. Her parents are asking the courts to grant visitation every other weekend and virtual visits each week. They say Millete cut them off from the children after their daughter's disappearance.

In the filing, Millete claims his wife has "mental stress and health issues and battled depression." He claims his parents have helped raise the couple's children since birth and that they have moved into their home to help him raise his children. He says the children are not close with their maternal side, a claim Maya's family strongly opposes.

The two sides will go before a San Diego County judge next week to hash out a visitation agreement.

Richard & Maricris were on The Interview Room Sunday. They told Chris it was obvious LM has alienated the kids from their family. They barely spoke in a recent call. As if losing their Mom wasn't bad enough, now they are quite likely being told negative information about their maternal family members. I hate that they are being further victimized. IMO it speaks volumes about the care they are receiving from their paternal unit.

Sadly, I think it's pretty clear that LM is using that the maternal grandparents live with Richard and Maricris to strike out directly at Maya's sister and brother-in-law.

LM allegedly offered the grandparents weekly visitation at his home and/or nearby park via their respective attorneys, and now LM alleges that the grandparents failed to respond to his offer and instead are asking what LM calls "custodial" visitation versus grandparents visit.

This is a lose, lose, deal. Very sorry for the minors that are caught in the middle. MOO

Now I know whom he ''talked'' to in the interview he gave in the beginning. His parents...

He has to keep up appearances for his parents. The obvious victim blaming comes from the fact that his parents probably only ever heard his side of the story. So him maintaining she left him and the children, makes more sense as an argument now. I always wondered, but he cannot lose face for his parents (and probably his own family).

I think its safe to say he battled mental stress and depression...

What ? Insane. I hope this goes toward him being an even stronger POI. First he basically trashes her immediately after she goes missing. Now this ?!
My intuition tells me he does not want her family access to any recall /information leading up to the “missing” .

Surely the judge will see what is really happening here.

His unfounded, pathetic attempts to discredit his missing wife will do nothing but backfire on him. *He is the POI*. Apparently he isn't smart enough just to keep his mouth shut. This dastardly circus will be over soon. Poor Maya.

In a nine-page declaration, filed Sept. 2 in Chula Vista family court by the husband, Larry Millete, he accuses his in-laws of everything from drunkenness and child neglect, to contaminating the family home with second-hand smoke.

And yet he would have been okay with these same relatives spending time with the kids at the planned birthday party at Big Bear, despite all the supposed drunkenness and neglect? (Also, kids don't usually invite family they're not close to to their birthday parties, just sayin'.)

We all know smoking around kids is bad news, but if that ever had happened in the past, why didn't he just put his foot down and tell them no smoking was allowed in the house? It seems weird that with his wife missing, he'd fixate on a fairly minor grievance like that now. And if it did happen in the past, pretty sure they'd be willing to forgo smoking during future visits with the kids.
