Nina Fathizadeh, 31, and her mother Shahin Gheblehshenas, 64, surrendered to San Jose Police on Friday, KGO reported. They have been charged with felony child endangerment and are scheduled for arraignment on December. 6.

The Santa Clara District Attorney’s Office said that Gheblehshenas left the house that morning, on October 2, leaving four children under her daughter’s care. Fathizadeh was making breakfast with one child in a crib. She let the other three into the rear play area, unsupervised and out of her sight.

On Monday, Oct. 2, according to the charging documents, Happy Happy Home Daycare was expecting to take care of five children at the home.

But the day before, an assistant at the daycare reported she was not able to come in to work the following morning. According to the court records, Gheblehshenas also was not expected to be at the home on Monday morning, believing she had a doctor’s appointment scheduled.

Fathizadeh expressed concern she wouldn’t be able to handle all five children at the daycare by herself, yet she and her mother never made plans to address the staffing shortage or notify their customers, police say.

Since the drownings, there have been questions about how the children were able to access the pool in the first place. The court records help answer that question.

Yes, and when it turned out the mom didn't have a dr. appt (she got the date wrong), she didn't return to help with the kids at her house. Instead she went to the daughter's house where she was running an unlicensed daycare out of that home. It's infuriating.

Just saw this article below. Please forgive if it is a repeat.
Two young children gone due to drowning -- a sad loss that could have and should have been avoided. I feel sure that the women who were in charge of the day care are very sorry for these deaths -- but these two deaths were totally preventable.
Two families each now missing a precious child -- a special gift that cannot be replaced.
Such a sad, sad situation all the way around. SMH.

A mother and daughter from California have been arrested and charged after two allegedly unattended toddlers drowned earlier this month in a pool at the residential daycare they owned together.
Nina Fathizadeh, 41, and her mother, Shahin Gheblehshenas, 64, are charged with felony child endangerment and are expected to be arraigned on Dec. 6, the Santa Clara County District Attorney’s Office announced in an Oct. 13 news release.

A little more about the children. Beyond heartbreaking.


SAN JOSE, Calif. - More details are being revealed about the two toddlers who tragically drowned at a San Jose day care earlier this month.

One of the girls who died – 18-month-old Payton Cobb of Hollister – was beautiful, energetic and personable, and a daughter who "brightened every day" for her parents, Jacob and Angel Cobb, according to one of two GoFundMe sites for her.

"We have no words to describe the grief that their family is experiencing right now," family friend Jeanna LeFave wrote.


Police say Payton, 16-month-old Lillian "Lily" Jade Hanan and a third child ended up in the pool after they were left unsupervised in a backyard play area of Happy Happy Home day care on Oct. 2.

Lily Jade was a bubbly, loving, silly, super-fast little girl, whose funeral was held at Oak Hill Funeral Home, the company's website states.

She was a "miracle baby" for Josephine and Scott Hanan, who tried to have a baby for 15 years, according to her obituary.

They adopted her in Savannah, Georgia, and Lily knew baby American Sign Language.

Her family made a touching video tribute to her that begins with one of her favorite songs, "Baby Beluga."

The third child is a 2-year-old boy who survived.

Such a tragedy :(

My God when you are responsible for safeguarding other people's children, you take extra precautions. Like walking out to make sure they couldn't access that pool. Who was going to do watering, was there a landscaper who was coming that day?
