‘The world is watching’ as Cal City murder trial unfolds

The trial will not be in session this week but will return April 10. In the meantime, here’s what a summary of events to date, including particulars that didn’t make the paper and other details of note.

WITNESSES
Chief Deputy District Attorney Eric Smith began building his case at the moment the case first caught the public’s eye: Dec. 21, 2020 when the Wests reported Orrin and Orson missing while they played in their California City backyard. Smith called to the witness stand a dispatcher, three California City police officers and two of the Wests’ neighbors to explain what happened that night.

Smith has already presented more than four hours of body-worn camera footage including interviews of the Wests. It’s expected more footage is yet to be played...

There was never a complete search of about 40 sex offenders who lived in California City, according to statements elicited by defense attorney Timothy Hennessy.

There were at times heated exchanges during the cross examination between Hansen and an attorney representing Jacqueline West, Alekxia Torres Stallings.

Hansen had testified he had a 3-year-old at home, and therefore knew what smaller shoe prints looked like. Through this line of questioning, Prosecutor Smith brought out testimony from Hansen to show he was able to discern there were no kids’ shoe prints in the California City backyard — a possible clue to what might have happened to the boys.

But Hansen appeared to fail Torres Stallings’ fatherhood test. She noted there were diapers inside the house, in fact, and they were a size 6.

She asked Hansen whether he knew a diaper’s size doesn’t correlate to age, but weight.

No, he didn’t: Hansen said he doesn’t buy diapers and instead leaves that task to his wife — an answer that produced a look of disbelief in Torres Stallings’ face.

She also elicited testimony that Hansen lacks formal training in analyzing footprints.

There were questions, as well, about Hansen’s experience interviewing children. He testified he had some training in police academy about interviewing children but wasn’t able to say how long it lasted.

Under cross examination, Torres Stallings implied there’s a special method for interviewing children who are witnesses, as distinct from the method for young suspects. But when he interviewed children, Hansen used a method geared toward children suspected of committing a crime, not witnessing one, Torres Stallings asserted.

It was heartbreaking to hear the Wests’ other children will testify about Orrin and Orson dying, they said. Smith said during his opening statements one of the other children told a forensic interviewer how Orrin’s color changed before he started vomiting one night, which may have preceded his death. The same boy also allegedly told investigators there was a thud in Orson’s room one night and that Orson was never seen again.

“That’s the one that’s really gonna hurt the most,” Wills said.

Coverage of West trial brings new audience from outside the courtroom

The trial began on March 28 with cameras allowed for two days of opening statements. Those who couldn’t make it inside the courtroom could listen through an audio stream provided by the Kern County Superior Court.

On March 28, the trial had 948 listeners. On March 29, 1,425 listened. On March 30, 1,797 listened, according to Davis.

“This is the first time there has been a need to increase the number of licensees to accommodate the number of people accessing the audio livestream,” Davis said in an email.

With a highly sensitive case, Judge Charles Brehmer has implemented restrictions for what is allowed to be recorded. There are no cameras allowed for witness testimony, but the audio is streamed through the Kern County Superior Court’s website.

WEST TRIAL: First week’s testimony featured details previously kept under wraps, push back on investigators

During opening statements, prosecutor Eric Smith said the couple’s four other children told authorities Orrin and Orson hadn’t been seen for weeks. One child, 10 at the time, said he witnessed Orrin die, Smith said.

Video surveillance footage showed no one could have snatched the children from the night the couple called police, Smith said. ...

Defense attorneys have argued police botched the investigation by failing to interview registered sex offenders in the area until a week passed, using inappropriate interview techniques on the Wests’ other children and ignoring certain leads, including one from a woman who claimed to have seen Orrin and Orson in Texas.

Jurors watched several hours of video footage during the first week, the longest being a two-hour interview of Trezell West with California City police and the FBI.

The interview, which took place a day after the Wests reported the children missing on Dec. 21, 2020, begins smoothly. Trezell West is calm and laughs at times as he speaks about his background. The questioning moves on to the events of the previous night.

More than an hour in, the mood takes a sharp turn. Police call West a liar. They say the boys were never at the home day the before. And they note his earlier, apparently jovial mood.

California City police Officer Brian Hansen has by far spent the longest time on the witness stand. His testimony lasted all day March 29 and part of March 30.

Hansen testified no children’s shoeprints were found in the dirt where Trezell West had said Orrin and Orson were playing the evening they were reported missing. Police dogs found no scent of them outside the home. Extensive searches involving multiple agencies and a helicopter turned up nothing.

Plantz testified she had a pool in her backyard she cleaned every day. A fence separated her backyard from the Wests’, but there were gaps in it and she said she had a pretty clear view into their yard.

She said she saw a man in the Wests’ backyard carrying something the night the boys were reported missing but didn’t see or hear children.

“There was never, in 21 years, any children in that backyard,” she said.

Dobbins, who lived across the street from the Wests and has since moved to Texas, testified he gave police access to his Google Nest camera. Full-length video capability had been disabled because he and his wife were planning to move, but the motion-activated camera took still photos of the Wests’ van parked out front and law enforcement arriving the night the boys were reported missing.

Testimony in the fourth day of the West trial focused primarily on witness statements regarding the number of children seen in the California City home.

The realtor who helped the couple buy the Cal City home and an exterminator who visited the home shortly after they moved in were called to testify Monday, both asked about how many children they saw in the home. While both recalled seeing a number of children at the home, neither could remember exactly how many the saw.

According to realtor Robert Dees, he began working with the Wests some time in May 2020. He said while the looked a few homes together over several months, the children would remain in the car so he never noted how many there were. Dees said after he sold the Wests their Cal City home, he went by on Sept. 11, 2020, the day they moved in, and noticed the kids on the back patio.

The other witness to testify to seeing children in the home was Antelope Valley Pest Control owner Joseph Karschamroon. He said he visited the home on Sept. 15, 2020 and noted seeing several children, but couldn't remember how many he saw. He said he asked the couple to take them outside while he worked in the house. He said he remembered a carseat and child carrier, and that the children were well-behaved inside the car.

West Trial: Realtor, pest control agent questioned over children seen in West home

In court, Dees identified a photo of Orson West as the upset child he believes he saw on Sept. 11, 2020, three months before Orson, 3, and Orrin 4, were reported missing. They were the youngest of the six children the Wests’ cared for.

Later Monday, California City resident Robert Avelar testified he was outside working on his truck and doing yard work the day the boys were reported missing. He said he didn’t see any toddlers or anyone else walking through the area before police and citizen volunteers began showing up.

Avelar said he saw a couple vehicles go by before 6 p.m. One was the Wests’ white van, the other a car driven by a Black woman that went driving through unmarked roads in the desert before returning to a street where Avelar later lost track of it. It doesn’t appear the driver of that car was ever identified.

Multiple clips taken from surveillance cameras on Avelar’s home were played. Timothy Hennessy, one of the attorneys representing Trezell West, noted there was a gap of 14 minutes from one clip to the next and asked what happened to the intervening footage. Avelar testified he gave all the footage to authorities and said the cameras are motion activated.

The last witness called Monday was California City Police Chief Jesse Hightower, who testified to calling in support from Kern County search and rescue and the California Highway patrol to help with the search. A lieutenant at the time, Hightower established a command post outside the West home where he gave assignments to officers and citizen volunteers.

A CHP helicopter circled the neighborhood and desert for three hours using infrared imaging but located no children. Questioned by Torres Stallings, CHP Officer Zachary Edwards said infrared can not pick up heat signatures in homes or vehicles unless a person is near an open door or window.

Hightower will resume testifying at 9 a.m. Tuesday. Clips from his body-worn camera will be played for the jury.

Defense weaves doubt into Cal City police investigation of missing toddlers

As the trial resumed after a one-week break, Officer Michael Kelakios testified he went to the Wests’ house soon after the parents reported their children missing just for his “own peace of mind” and wasn’t directed to do so by an officer investigating the case. ...

Defense attorney Alekxia Torres Stallings, who represents Jacqueline West, asserted some portions of footage from Kelakios’ body-worn camera shown in court were only partial clips and the area where Kelakios looked for footprints was contaminated.

Kelakios testified he remembered there were other people in the area searching for the boys, and became upset when they weren’t following a “grid search.” The area where boys’ footprints could have been found had also been walked over by several others trying to help find the boys, Kelakios testified.

Torres Stallings asked Kelakios if he understood the importance of staying unbiased throughout an investigation while asserting a narrow-minded focus could lead officers to overlook important pieces of evidence. Kelakios testified that yes, this was important.

She then asked the officer if he remembers making a Facebook post in which he stated opinions about the case, landing him in trouble with the police. Kelakios repeatedly said he doesn’t recall making the Facebook post.

Kelakios also testified he didn’t write a report about his meeting with Trezell West and didn’t follow up on any information Trezell provided about the biological family potentially getting involved in the case and other tips. The officer added he did pass along some information to another officer investigating the case.

West Trial: ‘She just seemed neutral,’ officer says of Jacqueline West

In speaking with Jacqueline West shortly after she reported two of her children missing, then-Lt. Jesse Hightower noticed something off about her demeanor.

It’s not what she showed, Hightower said, but what she didn’t show. Her adopted sons Orrin, 4, and Orson, 3, were missing from her California City home yet there was no indication of frustration, anxiety or anger, he said.

“She just seemed neutral,” Hightower said Tuesday, the fifth day of trial for Jacqueline West and her husband, Trezell West, on charges including murder in the deaths of Orrin and Orson.

During Hightower’s cross-examination, Jacqueline West attorney Alekxia Torres Stallings focused, as she has with other California City officers, on issues with the department’s body-worn cameras and officers’ failure to write reports documenting actions taken during the investigation. Hightower is at least the third officer in the department who admitted failing to write reports. He was the incident commander the night the boys were reported missing.

Hightower testified the body-worn cameras used at the time had glitches in which they would turn on or off at random and sometimes listed the wrong date and time.

The video so far shows a flashlight being shown in a lot filled with brush and dirt. It's pitch black out. #WestsTrial

The bodies of Orrin and Orson have never been found. The Wests have pleaded not guilty to the charges and maintain the boys went missing. Prosecutors have said the children died 3 months before the Wests reported them missing. #WestsTrial

Hightower in the video tells a couple people he's looking for two young children. He's also looking for camera systems on homes. #WestsTrial

Asked about Jacqueline West's demeanor, Hightower said he noticed what wasn't there -- no frustration, no anxiety, no anger. #WestsTrial

There were differences in the clothing descriptions of the boys that were sent out over the radio compared to what the Wests told him, Hightower said. #WestsTrial

The metal gate in the backyard was "heavy and difficult to open," Hightower said. The implication is a young child wouldn't have been able to open it. #WestsTrial

Smith has displayed a photo of the metal gate on the east side of the West home. #WestsTrial

Smith followed that by playing a video of an officer opening the gate. It scrapes along the ground -- there is a slight groove mark in the concrete -- and appears to take some force to move. #WestsTrial

Hightower said he received information after the Wests' other children were interviewed that changed the course of the investigation. He said they gathered more information and began writing search warrants. #WestsTrial

Warrants were authored for the West home and van. #WestsTrial

The FBI was contacted. Hightower said he provided them with information and later requested assistance. #WestsTrial

Hightower said he requested a forensic dig team from the FBI. Nothing was located in the Wests' backyard. #WestsTrial

Computers and cellphones were seized from the Wests, Hightower said. They were given to the FBI for analysis. #WestsTrial

They were looking for images, data and GPS information, Hightower said. #WestsTrial

Hightower said officers should watch their body-worn camera footage before testifying, and when writing their reports. Two officers during the trial have testified they didn't write reports in the case, and yesterday one said he never viewed his footage. #WestsTrial

Torres Stallings is going over a call log from the search and asking Hightower to identify volunteers referred to on the log. There are two volunteers listed. Hightower said there were 5 officers, 2 volunteers and 1 other person present. #WestsTrial

Volunteers had taken classes to be able to assist the department but did not have the power to arrest anyone, Hightower said. #WestsTrial

Hightower said the 2 volunteers were told to write down which residences they went to. He doesn't know if the notes were written or given to an officer. #WestsTrial

Hightower said he asked Jacqueline West if she closed the gate in the backyard, but that interaction wasn't captured on his body camera. #WestsTrial

Torres Stallings is attempting to point out discrepancies from the time listed on Hightower's body camera footage to what the actual time was. #WestsTrial

A man Hightower spoke with that night had cameras on his property. The man only reviewed his footage as far back as 5:26 p.m., not earlier. #WestsTrial

At another home Hightower didn't notice surveillance cameras but said he didn't ask the homeowner if they had any. He doesn't know which agency eventually asked. #WestsTrial

Hightower said he directed a California Highway Patrol helicopter on locations where to look the night the boys were reported missing. They performed a 5-mile radius, he said. #WestsTrial

He agreed that what he says, as police chief, reflects upon the entire police department. He testified he was not aware Officer Michael Kelakios made comments about the case on Facebook and got in trouble for it. #WestsTrial

Hightower testified he doesn't know of any specialized training any of the Cal City officers had in dealing with children. #WestsTrial

Torres Stallings asked if he watched the interviews Officer Brian Hansen conducted with the other West children. Hightower said he's never seen them, and yesterday was the first time he saw the form with the children's answers. #WestsTrial

"Okay," Torres Stallings said, paused, then moved on. #WestsTrial

Hightower said Hansen did not use the words "murder" or "assisting in murder" regarding his interviews with the children. He said Hansen told him the children said Orrin and Orson were never in California City. #WestsTrial

Torres Stallings asked if the department teaches an officer to touch a suspect while they're being interrogated. He said there are a couple different contexts that could be taken. #WestsTrial

"I don't think that's appropriate," Hightower said of touching a suspect on their leg. He said he wasn't aware Hightower did that to Jacqueline West while questioning her at the department. #WestsTrial

Asked about the first dog that was sent to the scene to search for the boys, Hightower said it was a tracking dog. He said he directed search and rescue to follow the route that Trezell's van took. #WestsTrial

Hightower testified he had the dog follow the van route because he wanted to see if the children had been driven away. Search and rescue did that route first then went to other locations, he said. #WestsTrial

Hightower said he had a signed search warrant from a judge before entering the West home in the video that was previously shown. #WestsTrial

He said he moved the gun for the safety of himself and other officers in case one of the Wests became angry and made a run for the weapon. That's why he took it from the closet and placed it underneath a blanket, he said. #WestsTrial

In sending Officer Hansen to Bakersfield, Hightower said he was getting other people ready for more searches. He didn't know what Hansen would bring back but it changed how they conducted the investigation. #WestsTrial

Prosecutor Eric Smith has shown her a map of the apartment complex. Martinez said she doesn't understand it. #WestsTrial

The apartment where Martinez lived has been identified. She lived there 15 years. At some point Trezell and Jacqueline West moved into the apartment complex. #WestsTrial

Asked how often she visited Jacqueline and the kids, Martinez said, "Almost never." She said she had to take care of her kids and Jacqueline had to take car of hers. #WestsTrial

Under questioning by Smith, Martinez said Trezell had nothing to do with her not visiting. She said she rarely visits anyone. #WestsTrial

Martinez testified she never watched Jacqueline and Trezell's children in 2019 or 2020. "No, we wouldn't see each other," she said. #WestsTrial

Martinez said she just got the plants from the car then she left the Cal City home. Jacqueline helped her get the plants from the car. Martinez said she didn't go into the home that day, Oct. 10, 2020. #WestsTrial

During video chats with her daughter, she never talked with the children, Martinez said. "It was weird that she wouldn't show them," she said. #WestsTrial

Martinez said she found out the boys were missing when the FBI came to her home. #WestsTrial

In December 2020, Trezell West dropped Jacqueline off and they went to eat tacos, Martinez said. She said Jacqueline told her Trezell and the kids were going to Trezell's mom's. This was around Dec. 5 or 6. #WestsTrial

Day 6 of the trial of Trezell and Jacqueline West is about to begin with Maria Martinez, Jacqueline West's mother, back on the witness stand. #WestsTrial

The Wests have pleaded not guilty and defense counsel has said they had nothing to do with the boys' disappearance in December 2020. #WestsTrial

Prosecutor Eric Smith is playing an interview Martinez had with authorities on Dec. 23, 2020, two days after the Wests reported the children missing. #WestsTrial

Martinez said Jacqueline West came to visit her after the Wests moved to California City. She said she didn't see the children and believed they were in the Wests' van. #WestsTrial

Jacqueline West stayed with her a couple hours, she said. Trezell came back later to load wooden planks. Martinez said she still didn't see the kids and Trezell and Jacqueline left. #WestsTrial

Martinez in the video said Jacqueline told her the kids were with Trezell's mom. #WestsTrial

Smith is questioning Martinez. She said on the day referred to in the interview she's not sure how much time she spent with her daughter. She believes it was an hour. #WestsTrial

Martinez said Trezell West had been trying to load wood into the van but it wouldn't fit. She said she was present with her friend. #WestsTrial

The Wests left and said they were going to pick up the children, Martinez said. That was the one time the couple visited her after moving from Bakersfield to California City, she said. #WestsTrial

Martinez said the FBI went to her house after Orrin and Orson were reported missing. She called Jacqueline West then went to see her at the Cal City home. #WestsTrial

Martinez isn't sure what day she visited. #WestsTrial

At some point she spoke with Bakersfield police detectives, Martinez said. #WestsTrial

Smith has asked Martinez to identify Facebook messaging between her and her daughter in August 2020. Martinez said she doesn't recognize it. #WestsTrial

Smith displayed a photo showing two of the Wests' children, not Orrin or Orson, in Jacqueline West's home. Smith circled 2 chairs in the photo and Martinez said that's where "the babies" would sit. #WestsTrial

Smith is now displaying photos of the California City home and asking Martinez to identify different areas in it. #WestsTrial

When she went to the house before the children were reported missing she doesn't know if she went inside because she was on her way to San Fernando, Martinez said. #WestsTrial

Martinez said the children were "all there" the one time but she didn't pay attention. They were playing with their father, she said. #WestsTrial

Martinez said she walked into the dining room and it was just her and Jacqueline in the dining room. She said Jacqueline had coffee ready for her, and she left shortly after. #WestsTrial

When Martinez left the dining room she said goodbye and they shouted goodbye, she said. She said she didn't focus on the children. #WestsTrial

The children didn't leave the room, they were playing games, Martinez said. She didn't stop and speak to each grandchild. She didn't look at their faces. #WestsTrial

After the Wests moved to Cal City Martinez visited them two times, she said. Asked if she "focused in" and saw Orrin and Orson, Martinez said she always saw them together in the living room. #WestsTrial

Smith asked for clarification, and Martinez said their backs were facing her and they were playing. Then she reiterated she never focused on any of the children. #WestsTrial

Martinez claims to have seen all the children, but admitted saying she didn't focus on them when visiting. #WestsTrial

Smith ended his questioning and Fatima Rodriguez, one of Jacqueline West's attorneys, has begun cross-examination. #WestsTrial

Martinez said two men from the FBI went to her home. They did not speak Spanish, and Martinez is a Spanish speaker. #WestsTrial

Martinez testified the agents used a cellphone to translate and speak with her. #WestsTrial

Martinez said her testimony to the agents was not that she didn't know Orrin and Orson's names, but didn't know how to pronounce them. #WestsTrial

Martinez said she was not able to clarify her answers during the interview, even after a BPD officer arrived and translated. #WestsTrial

When she visited the Wests at their home on Oct. 10, 2020, Martinez said she walked past them and said hi then had a cup of coffee with her daughter. She said all the children were there playing. #WestsTrial

Martinez testified the FBI examined her phone. She said she had Facebook video chats from her daughter on the phone. #WestsTrial

Rodriguez is asking Martinez if she doesn't remember exchanging messages with Jacqueline Martinez about how Jacqueline and Trezell were looking at a house in Cal City. #WestsTrial

Testimony is focusing on interactions Martinez had with the Wests after they moved to Cal City, the few visits she had. #WestsTrial

Martinez said she was repeatedly interviewed by law enforcement and said she was told she'd be charged with a crime if she lied. #WestsTrial

CPS came to her home once and asked to check for bruising or marks on her own adopted children, Martinez said. #WestsTrial

Fatima asked, when officers questioned Martinez regarding the boys' disappearance, if she was told she'd be charged with a crime if she covered for Jacqueline. Martinez said yes. It happened multiple times, she said. #WestsTrial

Rodriguez ended her questioning and now Victor Nasser, one of Trezell West's attorneys, is questioning her. #WestsTrial

Nasser asked a couple quick questions then ended, now prosecutor Eric Smith is again questioning her. Martinez said she hardly saw Jacqueline West in 2020. She said she simply doesn't like to visit. #WestsTrial

In 2020, Martinez said she didn't know the names of Orrin and Orson. #WestsTrial

Smith is showing Martinez video clips of her speaking with law enforcement. He's going to move the clips into evidence and provide transcripts to the jury. #WestsTrial

In one of the clips, Martinez said she doesn't know the children's names because they were changed. Smith asked if that referred to her knowing the names of Orrin and Orson, and she said, "Correct." #WestsTrial

Martinez said she can't speak with Trezell West because he doesn't speak Spanish, but she likes him very much. #WestsTrial

Latoya Spry Sanders has been called to the stand. #WestsTrial

Sanders said she has fostered children. She began doing that in 2008. The agency she went through was Safe Haven. #WestsTrial

There's a home inspection, interviews, training, Sanders said. #WestsTrial

There's training required every year to stay licensed, Sanders said. She currently has 2 foster children and 4 biological children. #WestsTrial

Safe Haven made contact with her once a week, and a county social worker once a month when fostering a child. #WestsTrial

After adoption, there are no check-ins on a regular basis, Sanders said. #WestsTrial

Smith showed Sanders photos of Orrin and Orson West. She said she recognizes them. "I fostered them," she said, becoming emotional. #WestsTrial

She fostered Orrin beginning Dec. 12, 2017, when he was almost 4 months. She fostered him until March 9, 2018. #WestsTrial

She fostered Orson when he was 11 days old, Sanders said. She fostered him also until March 9, 2018. #WestsTrial

Orrin was named Cinsere Pettus and Orson was named Classic Pettus at the time she fostered them. She said Orrin was a "happy little baby." When she first got him he finished therapy for an injury to his leg. #WestsTrial

Sanders said she fostered Orrin a little over a year. There were 4 other children in the home. "They were family, my children were accepting of him," Sanders said. #WestsTrial

The children loved him, Sanders said. He needed a little more care because of his injury but "I immediately bonded to him," she said. #WestsTrial

Orrin went to Harvey Hall School and learned ABCs, colors, shapes, she said. #WestsTrial

"I have thousands of pictures of them," Sanders said of Orrin and Orson. "Every picture that you see out there is from me." #WestsTrial

CPS came to Sanders' home after her eldest daughter went to school with a scrape on her leg and somehow her husband became accused of kicking her. She said she raised her voice to the CPS worker and Orrin and Orson were later removed. #WestsTrial

"I fought the county to have them returned to me until the day they were adopted out," Sanders said. Everything alleged about the girl being kicked was unsubstantiated, she said. #WestsTrial

Before that incident, the process of adopting the boys was about to begin, Sanders said. #WestsTrial

Sanders said she received a phone call the morning of Dec. 22, 2020, from the biological mother telling her the boys had been reported missing. "We had a thousand questions and we didn't know what to do," she said. #WestsTrial

"I was pissed off," Sanders said. She went to Cal City, knocked on the Wests' door and asked them what happened. What the Wests told her didn't hold any weight, she said. #WestsTrial

They told her they were sorry and didn't know what happened, Sanders said. She left after the Wests did an interview. #WestsTrial

"I was attached to them," Sanders said of the boys. "I needed them more than they needed me." #WestsTrial

Sanders said she had grown close with the boys' biological mother. They were like family, she said. #WestsTrial

Smith ended questioning, and Jacqueline West attorney Alekxia Torres Stallings has begun cross-examination. #WestsTrial

Sanders said she had just started the process of adopting the boys when they were removed. #WestsTrial

Regarding the incident with her daughter, the school made a referral to CPS, Sanders said. It had nothing to do with the other children in her home, only her daughter, she said. #WestsTrial

Only her foster children were removed. Her 6-year-old daughter -- the one with the scrape -- was allowed to stay, Sanders said. She said the CPS worker was responsible for that, had the kids removed 3 hours after going to her home. #WestsTrial

Sanders said the CPS worker thought she was overwhelmed with having 6 kids and taking the 3 foster children would decrease her stress. A BPD officer was at her home while CPS was there. She was never charged with a crime. #WestsTrial

Asked if she had other issues with CPS, Sanders said nothing to that extent. #WestsTrial

Anyone can make a CPS referral, Sanders said. They can be a complete stranger and ask for you to be investigated. #WestsTrial

Torres Stallings asked if children can make a ridiculous statement that can lead to trouble with CPS. Sanders agreed that's true. #WestsTrial
